CC - Item 5A - City Council Vacancy - Box 070TO: HONORABLE MAYOR AND CITY COUNCIL FROM: BILL CROCITY MANAGER ROBERT KRESS, CITY ATTORNEY RE: CITY COUNCIL VACANCY DATE: APRIL 8, 2003 As you are aware, Councilmember Bob Bruesch has resigned from the City Council effective March 31, 2003. The law requires that within 30 days of March 31, 2003 or by April 30, 2003, the Council must fill the vacancy by an appointment to the balance of the term or call a special election for that purpose. Government Code §36512 (copy enclosed). If a special election is called, it must be held on the next regularly established election date not less than 114 days from the call of the special election. Practically speaking, this means that the special election could not be held until November of this year. There is an insufficient time period (114 days) to meet the June election date. The Brown Act does not provide for discussion regarding the filling of the vacancy to be in closed session. If the Council wishes to make an appointment to the vacancy, action can be taken via the attached draft resolution. If the Council wishes to hold a special election, then a minute motion directing staff to prepare, and return for adoption at a subsequent meeting, the necessary documents to call the election. ' 1 MINUTES OF THE REGULAR MEETING ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION JANUARY 28, 2003 The regular meeting of the Rosemead Community Development Commission was called to order by Chairman Bruesch at 7:05 p.m. in the conference room of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the flag and Invocation were waived as having been completed during the meeting just adjourned. ROLL CALL OF OFFICERS: Present: Commissioners Clark, Imperial, Taylor, Vice-Chairman Vasquez, Chairman Bruesch APPROVAL OF MINUTES: None CDC RESOLUTION NO. 2003-OICLAIMS AND DEMANDS The following Resolution was presented to the Agency for adoption: RESOLUTION NO. 2003-01 CLAIMS AND DEMANDS A RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $67,635.85 AND DEMANDS NO. 6896 THROUGH 6919 Commissioner Taylor requested an explanation of the Construction Protection Services check for security at the Garvey Community Center. Don Wagner, Assistant City Manager, explained that this contract will terminate y by the end of this month. Mr. Wagner stated that a security guard was on duty 24 hours a day during construction. MOTION BY COMMISSIONER IMPERIAL, SECOND BY VICE- CHAIRMAN VASQUEZ that the Commission adopt Resolution No. 2003-01.
