MINUTES
CALL TO ORDER - The regular meeting of the Planning Commission of
the City of Rosemead was called to order by Chairman Ruiz at 7:00
p.m., in the Council Chambers of the Rosemead City Hall, 8838 E.
Valley Boulevard.
Pledge of Allegiance was led by Vice-Chairman Ortiz.
Invocation was delivered by Commissioner Lowrey.
ROLL CALL - Present: Commissioners Loi, Lowrey, Breen, Ortiz
and Chairman Ruiz
Ex Officio: Wagner, Price, Lyons, Troyer & Saavedra
1. APPROVAL OF MINUTES- Regular meeting of November 20, 1995.
(MO) It was moved by commissioner Ortiz, seconded by Chairman
Ruiz to approve the minutes of November 20, 1995.
2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City
Attorney, Stanton Price, explained the public hearing process and
the right to appeal decisions of the Planning Commission to the
City Council.
3. ADMINISTRATION OF OATH - The Commission Secretary
administered the oath to members of the audience wishing to
speak.

A. CONDITIONAL USE PERMIT 95-655 - 8736 E. Garvey Avenue -
Request from Mr. Sang Chuong to establish operation of a..
sewing factory, dba C & L Fashion (Cont'd from 11/6/95).
Mr. Lyons gave the staff report and stated that the
application had withdrawn the application.
B. MODIFICATION 95-04 FOR TENTATIVE PARCEL MAP 23320 - 4341 Rio
Hondo Avenue - Request from Eric Friedman to modify an
approved Tentative Parcel Map by adjusting lot lines and
amending the proposed units to be constructed (Cont'd from
11/20/95).
Mr. Lyons gave the staff report and recommended approval of
Parcel Map Modification 23320.

Commissioner Breen asked what the floor area ratio was?
Mr. Lyons stated that it meets all development standards.
Chairman Ruiz opened the public hearing and asked if there
was anyone wishing to speak on behalf of this matter.
Mr. Eric Friedman, 9440 Telstar, #201, E1 Monte, Owner,
stated that the reason for the change to the floor plan is
to have it flow better, therefore a change must be made to
the setback area.
Chairman Ruiz asked if a hammerhead driveway is useful for
the other lots.
Mr. Friedman stated that there is enough room in the rear
lots. No negative impact.
Chairman Ruiz then asked if there was anyone else wishing to
speak on behalf of this matter.
Ms. Barbara Hogan, 4341 Rio Hondo stated that she lives on
the property on a fixed income and has been served papers to
move. Wishes for Mr. Friedman to allow her to stay till the
first of the year.
Mr. Friedman stated that the property is currently in
escrow, but it will not close until the tenant is out. Does
not own the property yet, cannot grant Ms. Hogan's request.
Chairman Ruiz stated that the City has no control over the
seller, but we hope everything will work out for Ms. Hogan.
Chairman Ruiz then closed the public hearing.
(MO) It was moved by commissioner Breen, seconded by Commissioner
Ortiz to approve Modification 95-04 for Tentative Parcel Map
23320. Vote resulted:

C. CONDITIONAL USE PERMIT 95-653 - 3021 Sullivan Avenue -
Request from Mr. Don Long Ly to develop a single family
residence greater than 2,500 square feet.
Mr. Troyer gave the staff report and recommended approval,
subject to the conditions in Exhibit A.
Chairman Ruiz asked how wide the alleyway was behind the
property.
Mr. Troyer stated about 15 feet.
Chairman Ruiz opened the public hearing and asked if there
was anyone wishing to speak on behalf of this matter.
Mr. Wai Lee, 701 S. 1st Avenue, #118, Arcadia, representing
owner, stated that after reviewing the conditions, they have
a problem with removing the existing driveway. Also stated
that since the property was so long (190ft) and the garage
was in the rear, they felt that the existing driveway in
front would be useful because it was closer to the front
door and as additional parking for guest.

Mr. Lyons stated that the City has an ordinance about
driveways not leading to anywhere.
Mr. Lee stated not to look at it as a driveway leading no
where. A lot of houses have driveways leading to the back.
Chairman Ruiz stated that 50 years ago they did have long
driveways. Chairman Ruiz then asked if you have a garage in
the back, why do you not want to park in the garage.
Commissioner Ortiz stated that the City adopted ordinances
to control the front yard paving and to help with vehicle
parking on the lawns. The City is trying to keep the City
green and beautiful for our children to enjoy.
Commissioner Lowrey asked if we need to add a condition
regarding the removal of the front driveway?
Mr. Troyer stated that it was Condition #16.
Mr. Lee stated that he understood the Commission's concern,
but they are not asking for an additional driveway, just
keep the existing one. Also feels that the his client will
not go forward with the project if they are required to
remove the driveway.
Chairman Ruiz then asked if there was anyone else wishing to
speak on behalf or against this matter. There being no
response, the public hearing was closed.
(MO) It was moved by commissioner Lowrey, seconded by
commissioner Ortiz to approve Conditional Use Permit 95-653,
subject to the conditions in Exhibit A. Vote resulted:

for a period of three (3) years.

Ruiz to approve Conditional Use Permit 84-291, subject to

Mr. Troyer gave the staff report and recommended approval
for a period of three (3) years.

(MO) It was moved by Commissioner Breen, seconded by Commissioner
Ortiz to approve Extension of Zone Variance 92-249, subject
to the conditions in Exhibit A. Vote resulted:

E. EXTENSION OF CONDITIONAL USE PERMIT 92-567 - 8208 E. Garvey
Avenue - Request from Manuel Ocampo to continue an on-sale
general (type 48) alcohol license, dba Melody Lounge.
Mr. Lyons gave the staff report which indicated that there
were five incidents reported in the past year and upon
inspection of the premises, condition #10 was in violation,
which involves the back door being opened. Staff is
recommending approval for a period of one (1) year.

Mr. Lyons stated that all five incidents occurred after the
parking lot had been built.
Commissioner Ortiz stated that an employee was beat up in
the back area in the past and asked if the applicant agreed
to the condition of having security to protect the employees
and patrons of the establishment.
Mr. Ocampo stated that it was not his employee that got beat
up, but the store.
Mr. Lyons stated the shopping center east of this location
had a security guard and there seems to be fewer problems.

Loi to approve the extension of Conditional Use Permit
92-567, subject to the conditions in Exhibit A. Vote

be continued to the December 18th meeting.
G. EXTENSION OF CONDITIONAL USE PERMIT 94-626 - 3357 N. San
Gabriel Boulevard - Request from Jesus Garcia to continue an
off-sale beer and wine (type 20) alcohol license, dba La
Esperanza Meat Market.
Mr. Troyer gave the staff report and recommended approval
for a period of two (2) years.
(MO) It was moved by Commissioner Ortiz, seconded by Commissioner
Breen to approve the extension of Conditional Use Permit
94-626, subject to the conditions in Exhibit A. Vote
resulted:

A. PC RESOLUTION 95-48 - A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES,
STATE OF CALIFORNIA APPROVING CONDITIONAL USE PERMIT 95-654,
ALLOWING OPERATION OF A SEWING FACTORY, DBA C & T FASHION,
LOCATED AT 8905 E. GARVEY AVENUE, #B-7 (APN: 5289-019-097).
B. PC RESOLUTION 95-49 - A RESOLUTION OF THE PLANNING

7. ORAL COMMUNICATION FROM THE AUDIENCE - This is the time for
the public to address the Planning Commission on any matter not
on the Agenda.
Mr. Anthony Jaime, 3120 Isabel, Rosemead, stated that he had
a problem with his neighbor regarding the placement of a
fence.
Mr. Lyons stated that he had met with Mr. Jaime and
explained that this dispute was a civil matter not the
City's.
Mr. Jaime stated that the City should adopt an ordinance
regarding a fence line.
Chairman Ruiz stated that Mr. Jaime should contact the
Building Department regarding code requirements.
8. MATTERS FROM CITY OFFICIALS AND STAFF
Mr. Lyons again wanted to congratulate and wish James Troyer
good luck in his new job.
Commissioner Loi asked about Josie.
Mr. Lyons stated that he had called and left her a message
today. She is still having bone marrow treatments.

Mr. Troyer said that he will miss the City, Commissioners
ti and staff.
Commissioner Loi asked about the monthly Planning
Association meeting.
Mr. Lyons stated that there will not be one for December.
There being no other business to come before the Planning commission,
the meeting was adjourned at 8:30 p.m. The next Planning Commission
meeting will take place on December 18, 1995 at 7:00 p.m.
