PLANNING COMMISSION
REGULAR MEETING
NOVEMBER 20, 1995
CALL TO ORDER - The regular meeting of the Planning Commission
of the City of Rosemead was called to order by Chairman Ruiz at 7:00
p.m., in the council Chambers of the Rosemead City Hall, 8838 E.
Valley Boulevard.
Pledge of Allegiance was led by Commissioner Lowrey.
Invocation was delivered by commissioner Breen.
ROLL CALL - Present Commissioner Loi, Lowrey, Breen, Ortiz
and Chairman Ruiz

1. APPROVAL OF MINUTES- Regular meeting of November 6, 1995.
(MO) It was moved by commissioner Ortiz, seconded by Chairman
Ruiz to approve the minutes of November 6, 1995.
2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City
Attorney, Stanton Price, explained the public hearing process and
the right to appeal decisions of the Planning Commission to the
City Council.
3. ADMINISTRATIVE OF OATH - The Commission Secretary
administered the oath to members of the audience wishing to
speak.
4. PUBLIC HEARINGS
A. CONDITIONAL USE PERMIT 95-654 - 8905 E. Garvey Avenue, #B7 -
Request from Tuan Manh Le to establish operation of a sewing
factory, dba C & T Fashion.
Mr.' Troyer gave the staff report and recommended the
approval for a period of one (1) year, subject to the
conditions in Exhibit A.
Commissioner Loi asked if the business address was 8905 or
8909 Garvey?
Mr. Troyer stated that 8905 Garvey was in the front and 8909
Garvey was in the back where this business was.
Chairman Ruiz opened the public hearing and asked if there
was anyone wishing to speak on behalf of this matter. There
being no response, Chairman Ruiz then asked if there was
anyone wishing to speak against this matter. There being no
response, the public hearing was closed.
(MO) It was moved by commissioner Loi, seconded by Commissioner
Lowrey to approve Conditional Use Permit 95-654 for a period
of one (1) year, subject to the conditions in Exhibit A.

B. ZONE VARIANCE 95-274 - 2714 Stingle Avenue - Request from
David Law to reduce the minimum side yard setback of an M-1;
Industrial development adjacent to a residential property.
Mr. Lyons gave the staff report and recommended approval
subject to the conditions in Exhibit A.
Commissioner Lowrey asked how many feet for a side yard
setback?
Mr. Lyons stated 5 feet. The building will be built right
on the property line.
Chairman Ruiz then opened the public hearing and asked if
there was anyone wishing to speak on behalf of this matter.
Mr. Xa, 9423 Guess Street, representing owner, stated that
he and the owner have looked over the conditions and the
owner approves.
Mr. Ed Tervol, 2712 Stingle Avenue, son of an adjacent
property owner, wanted to know how tall the building was
going to be?
Mr. Lyons stated that the building will be about 24 feet
high, about the size of a two story house.
Chairman Ruiz then asked if there was anyone wishing to
speak against this matter. There being no response, the
public hearing was closed.
(MO) It was moved by Commissioner Lowrey, seconded by
commissioner Breen to approve zone Variance 95-274, subject
to the conditions in Exhibit A. Vote resulted:

Commissioner Oritz asked if a problem arises from any
construction done, is the City responsible because of
approval.
Mr. Price stated that the city would not be responsible by
approving this matter.
Mr. Lyons stated that this will be built to plan, therefore
there should not be any problems. If a problem arises the
contractor and owner would be responsible.
C. MODIFICATION 95-04 FOR TENTATIVE PARCEL MAP 23320 - 4341 Rio
Hondo Avenue - Request from Eric Friedman to modify an
approved Tentative Parcel Map by adjusting lot lines and
amending the proposed units to be constructed.
Mr. Lyons stated that there was a discrepancy in the plans
and that staff was recommending that this item be continued
to the December 4, 1995 meeting.

The Planning Commission agreed to continue the public
hearing to December 4, 1995.
5. OTHER BUSINESS
A. EXTENSION OF CONDITIONAL USE PERMIT 88-451 - 8001 E. Garvey
Avenue - Request from Jim DesRoches to continue the
operation of an Auto Auction facility, dba Los Angeles Auto
Auction (cont'd from 10/16/95).
Mr. Lyons gave the staff report and recommended approval for
three (3) years, subject to the conditions in Exhibit A.
(MO) It was moved - by_ Commissioner Lowrey, seconded by
Commissioner Ortiz to approve Conditional Use Permit 88-451
subject to the conditions.in Exhibit A. Vote resulted:

B. EXTENSION OF CONDITIONAL USE PERMIT 78-124 - 9632 E. Valley
Boulevard - Request from David Ruggles & Kay Jones to
continue an on-sale general (type 47) alcohol license in
conjunction with an eating establishment, dba Paul's Steak
House.
Mr. Lyons gave the staff report and recommended to continue
this matter to the December 18, 1995 meeting.
Commissioner Loi asked why the pole wasn't removed back in
1993?
Mr. Lyons stated that this is one of the reasons why staff
recommends continuing this matter to the December 18, 1995
meeting.
Commissioner Lowrey stated that he wants to see the reports
on the individual incidents.
Mr. -Lyons stated that they will be included in the staff
report on December 18th.
The Planning Commission agreed the continue this matter to
the December 18, 1995 Planning Commission meeting.
C EXTENSION OF CONDITIONAL USE PERMIT 81-232 - 3926 Rio Hondo
Avenue - Request from Warren Yamada to continue operation of
a church, dba Tensho-Kotai-Jingu-Kyo.
Mr. Lyons gave the staff report and recommended approval for
five (5) years, subject to the conditions in Exhibit A.
(MO) It was moved by commissioner Breen, seconded by Commissioner
Lowrey to approve Conditional Use Permit 81-232 for a period
of five (5) years, subject to conditions in Exhibit A. Vote
resulted:

Gabriel Boulevard - Request from Issa Farah to continue an
off-sale general. (type 21) alcohol license, dba Casa de
Liquor.
Mr. Troyer gave the staff report and recommended approval
subject to the conditions in Exhibit A.
(MO) It_ was moved by Commissioner Ortiz, seconded by Commissioner
Lowrey to approve Conditional Use Permit 89-462 for a period
of six (6) months, subject to the conditions in Exhibit A.

E. EXTENSION OF CONDITIONAL USE PERMIT 89-477 - 9423 E. Valley
Boulevard - Request from Seo Chung Won to continue an
off-sale beer and wine (type 20) alcohol license, dba Valley
Produce Market.
Mr. Lyons gave the staff report and recommended approval for
three (3) years subject to the conditions in Exhibit A.
Commissioner Loi asked if this was a transfer of ownership?
Mr. Lyons stated no. Has been the same owner since 1989.
Commissioner Ortiz stated that the parking lot striping is
confusing. Lines painted all over the lot. Also stated that
the trash bin is in the alleyway.
Mr. Lyons stated that one of the conditions require
restriping when necessary. Staff will investigate.
Commissioner Ortiz stated that would like this item to be
continue to resolve the striping problem. Also he had
observed drinking on the property.
Chairman Ruiz stated that Commissioner Ortiz'.concerns were
reasonable and polled the Commission as to continuance of
this matter to the December 18th meeting.
The Planning Commission agreed to continue this matter to
the December 18, 1995 Planning Commission meeting.
Mr. Lyons stated that he would talk to the owner regarding
restriping.
F. EXTENSION OF CONDITIONAL USE PERMIT 92-574 - 8817 E. Valley
Boulevard - Request from Mr. Thanh Tran to continue an
off-sale general (type 21) alcohol license, dba Doug's
Liquor.
Mr. Troyer gave the staff report and recommended approval
for two (2) years, subject to the conditions in Exhibit A.
Commissioner Lowrey stated that he had concerns with all the
signage on the windows. Blocking the view inside.
Chairman Ruiz stated that he had the same concern. To much
of the window covered, could cause more crime. No one can
see in or out.

(MO) It was moved by commissioner Loi, seconded by Commissioner
Breen to approve Conditional Use Permit 92-574 for a period
of two (2) years, subject to the conditions in Exhibit A.

G. EXTENSION OF CONDITIONAL USE PERMIT 94-623 - 8150 E. Garvey
Avenue, #)101 - Request from Sin Nga & Sin Hue to continue an
on-sale beer and wine (type 41) alcohol license in
conjunction with a eating establishment, dba Full Kee BBQ
Seafood Restaurant.
Mr. Troyer gave the staff report and recommend approval for
two (2) years, subject to the conditions in Exhibit A.
Commissioner Ortiz asked what the seating capacity was?
Mr. Troyer stated 75.
Commissioner Ortiz stated that he was in the restaurant and
counted 84 chairs.
The applicant stated that on weekends the restaurant gets
very busy, so more chairs are added.
Commissioner Ortiz wanted to know if the seating capacity
could be added to the conditions.
The applicant stated that he will remove the chairs.
Commissioner Ortiz also stated that the restrooms need to be
cleared out and the doorway is blocked. Because of this, he
can not vote on this tonight.
Mr. Troyer stated that staff and the building inspector will
check out these concerns.
(MO) It was moved by Chairman Ruiz, seconded by Commissioner Loi
to approve the extension of Conditional Use Permit 94-623,
subject to the conditions in Exhibit A. Vote resulted:

Commissioner Breen stated that he wanted the extension for
one (1) year not two (2) years.
H. EXTENSION OF CONDITIONAL USE PERMIT 94-624 - 8412 E. Garvey
Avenue - Request from Hamid & Farhad Sayari to continue an
off-sale general (type 21) alcohol license, dba Roy's
Liquor.
Mr.. Lyons gave the staff report and recommended approval for
two (2) years, subject to the conditions in Exhibit A.
Commissioner Ortiz stated that he had seen x-rated films and
magazines out in the open.

Mr. Lyons. stated that he would have the Code Enforcement
officer out.
Mr. Sayari, owner, stated' that when he took over the
business two years ago there was two racks there, has
removed one rack already and will remove the other if
requested.
Chairman Ruiz stated that the videos will need to be covered
up and an inspection will be done.
Commissioner Ortiz stated that the magazines needs to be
covered also.
(MO) It was moved by commissioner Lowrey, seconded by Chairman
Ruiz to approve the extension of Conditional Use Permit
94-624, subject to the conditions in Exhibit A. Vote

8. MATTERS FROM CITY OFFICIALS AND STAFF
Mr. Lyons stated that Josie was out of the hospital, but
going back everyday for her bone marrow treatment. Doesn't
know when she will be able to come back to work.
Mr. Lyons also stated that James Troyer will be leaving the
City. He has accepted a position with the City of E1
Monte. James' last day will be December 7, 1995.
Mr. Troyer stated that he has enjoyed working with the
Commissioners and staff.
Commissioner Loi stated that a time limit on conditions
should be more regulated.
Commissioner Lowrey wished James good luck and also thanked
the City for the proclamation for his 50th wedding
anniversary.
Chairman Ruiz also wished James good luck.
There being no other business to come before the commission, the
meeting was adjourned at 8:10 p.m. The next Planning Commission
meeting will take place on December 4, 1995 at 7:00 p.m.
