PC - Minutes 09-05-950 CITY OF ROSEMEAD 8838 E. VALLEY BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING SEPTEMBER 5, 1995 MINUTES CALL TO ORDER - The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Ruiz at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 E. Valley Boulevard. Pledge of Allegiance was led by Commissioner Lowrey. Invocation was delivered by Commissioner Breen. ROLL CALL - Present: Ex Officio: 1 2 3 4 Commissioners Loi, Lowrey, Breen Ortiz and Chairman Ruiz Wagner, Price, Lyons, Troyer, Bernica, Saavedra APPROVAL OF MINUTES - Regular meeting of August 21, 1995. (MO) It was moved by Commissioner Ortiz, seconded by commissioner Breen to approve the minutes of August 21, 1995. YES: LOI, LOWREY, BREEN, ORTIZ,. RUIZ EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City Attorney Stanton Price explained the public hearing process and the right to appeal decisions of the Planning Commission to the City Council. ADMINISTRATION OF OATH - The Commission Secretary administered the oath to members of the audience wishing to speak. PUBLIC HEARINGS A. TENTATIVE TRACT MAP 52002 - 7503-27 Hellman Avenue - Request from Chi-An Wang to subdivide five (5) parcels into eleven (11) single family residential lots. Mr. Lyons gave the staff report with the recommendation to approve subject to the conditions in Exhibit A. The chairman opened the public hearing. There being no one wishing to address the Commission on the subject, the public hearing was closed. (MO) It was moved by Commissioner Loi, seconded by Commissioner Lowrey to approve Tentative Tract Map 52002. Valley Boulevard - Request from David Ruggles to add a facade to an existing building in an M-1 Design Overlay Zone, dba Paul's Steak House. Mr. Troyer gave the staff report with the recommendation to approve the Categorical Exemption for Design Review 95-65 and approve Design Review 95-65, subject to the conditions listed in Exhibit A. The Chairman opened the public hearing. There being no one wishing to address the subject. The Chairman then asked the Commissioners if they had any questions or concerns. Commissioner Breen asked if the facade would effect the driveway? Mr. Troyer responded no, just the front of the building. Commissioner Ortiz inquired if any part would be on the City walkway? Chairman Ruiz asked the applicant if he would like to address that question? Mr. Troyer stated that he was not sworn in. The Commission Secretary sworn in the witness and asked him to state his name and address for the record. Mr. Butch Mackey, 2604 Mayflower Avenue, Arcadia, contractor for the project. Commissioner Ortiz stated that the front parking lot was blacked top and the curbing was blacked top and is that going to be concrete? Mr. Mackey stated that everything will be as it is currently. The project does not encroach or hinder any portion of the immediate area. All that is happening is that the building is being expanded by 6 1/2 inches only. Commissioner Ortiz inquired if this project will affect the business adjacent property? Lloyds? Mr. Mackey stated not at all. That property is 22-23 feet away from the actual location of the facade. Commissioner Ortiz also stated that he observed a couple of beer bottles in the parking lot area. Mr. Mackey stated that he was only the contractor, but he will address this concern with the owner. Commissioner Ruiz then closed the public hearing. Commissioner Breen stated that Paul's has a high volume and quantity of business and that he feels they do a good job of keeping order and seldom have anyone get out of hand and that the facade will enhance the building. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE C. MODIFICATION 95-01 (PLANNED DEVELOPMENT 94-07) - 8445-8463 Mission Drive - Request from Ms. Dolly Leong to modify the approved Planned Development Review 94-07. Mr. Lyons gave the staff report with the recommendation to approve Modification 95-01 (Planned Development 94-07) subject to the conditions listed in Exhibit A. Chairman Ruiz asked the Commissioner if they had any questions for staff regarding this project. Commissioner Loi asked if these trees could be transfered to any City property? Mr. Wagner stated that these trees were very expensive to move. Mr. Lyons stated that Ms. Leong was looking for someone to give them to. Chairman Ruiz asked if anyone would like to speak on behalf of this project. Ms. Dolly Leong, 9554 E. Ralph, Rosemead, came forward and addressed the Commission. She thanked the Commissioners and staff. She also stated that the project was in the final stage and that the trees had a negative impact on the appearance of the homes, do to the small yard areas. She also stated that she is willing to donate the trees to any church, to the City or business. Chairman Ruiz asked if anyone would like to speak against this project. There being no one wishing to address the Commission, the public hearing was closed. Chairman Ruiz asked if any Commissioner's had anything to say on this project. (MO) It was moved by Commissioner Lowrey, seconded by Commissioner Breen to approve Modification 95-01 (Planned Development 94-07). EXTENSION OF CONDITIONAL USE PERMIT 72-46 - Request from George Pelonis to continue an on-sale beer and wine (Type 20) license for the property located at 7637 E. Garvey Avenue, dba Chris' & Pitt's Restaurant. Mr. Troyer presented the staff memorandum with the recommendation to approve the extension request for three (3) years, subject to the conditions in Exhibit A. (MO) It was moved by Commissioner Ortiz, seconded by Chairman Ruiz to approve the extension of Conditional Use Permit 72-46, subject to the conditions in Exhibit A. EXTENSION OF CONDITIONAL USE PERMIT 87-371 - Request from Chung Mei Sun to continue the sale of beer for the property located at 7968 E. Garvey Avenue, dba Daiyu Market. Mr. Troyer presented the staff memorandum with the recommendation to approve the extension request for three (3) years, subject to the conditions in Exhibit A. (MO) It was moved by Commissioner Loi, seconded by Commissioner Ortiz to approve the extension of Conditional Use Permit 87-371, subject to the conditions in Exhibit A. Mr. Troyer presented the staff memorandum with the recommendation to approve the extension request for three (3) years, subject to the conditions in Exhibit A. Mr. Troyer presented the staff memorandum with the recommendation to approve the extension request for two (2) years, subject to the conditions in Exhibit A. (MO) It was moved by Commissioner Breen, seconded by Commissioner Loi to approve the extension of Conditional Use Permit 93-596, subject to the conditions in Exhibit A. PC RESOLUTION 95-31 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA DENYING ZONE VARIANCE 95-273, REQUESTING FOR A REDUCED SECOND STORY SIDE YARD SETBACK, LOCATED AT 9346 PITKIN STREET (APN: 8592-014-029). PC RESOLUTION 95-32 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA RECOMMENDING CITY COUNCIL APPROVAL OF ZONE CHANGE 95-200, CHANGING ZONING DESIGNATIONS FROM PLANNED DEVELOPMENT (PD) TO R-2; LIGHT MULTIPLE RESIDENTIAL LOCATED AT 7629, 7637 GRAVES AVENUE (APN: 5285-026-052, 5285-026-024 AND 5285-026-014) Mr. Price presented the resolutions by title only. MATTERS FROM CITY OFFICIALS AND STAFF r] A. Mr. Lyons explained that Josie was back in the hospital at City of Hope in Duarte. It was his understanding the she will be in for three weeks undergoing bone marrow surgery. Chairman Ruiz then closed the meeting in Josie's honor. There being no other business to come before the Commission, the meeting was adjourned at 7:45 p.m. The next meeting will take place on September 18, 1995, at 7:00 p.m. ,P
