VALLEY BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING AUGUST 7, 1995 REGULAR MEETING 46 CALL TO ORDER- The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Ruiz at 7:00 p.m., in the Council Chambers of the Rosemead City Hall, 8838 E. Valley Boulevard, Rosemead. PLEDGE OF ALLEGIANCE - Chairman Ruiz INVOCATION - Chairman Ruiz ROLL CALL - Present: Commissioners Breen, Loi, Lowrey, Ortiz (Late), and Chairman Ruiz Ex Officio: Wagner, Price, Lyons, Troyer, Valderrama, Saavedra 1. APPROVAL OF MINUTES - Regular meeting of July 17, 1995 (MO) It was moved by Commissioner Lowrey, seconded by Commissioner Breen to approve the minutes of July 17, 1995. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN NO: NONE ABSENT: ORTIZ ABSTAIN: NONE 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City Attorney, Stanton Price explained the public bearing process and the right to appeal decisions of the Planning commission to the City Council. 3. ADMINISTRATION OF OATH - The Commission Secretary administered the oath to members of the audience wishing to speak. 4. PUBLIC HEARINGS A. CONDITIONAL USE PERMIT 95-639 - 8526 E. Valley Boulevard - Request from Michael C. Tse to transfer an existing on-sale general liquor (Type 47) license, in conjunction with an existing restaurant and nightclub, dba T 6 J Restaurant. . Mr. Troyer presented the staff memorandum and recommended approval for one year subject to conditions 1 through 11. The Chairman opened the public hearing. There being no one wishing to address the Commission, the public hearing was closed. Commissioner Ortiz arrives at 7:07 p.m. r-'- • • PC MINUTES AUGUST 7, 1995 PAGE 2. (MO) It was moved by Commissioner Breen, seconded by Commissioner Lowrey that Conditional Use Permit 95-639 be issued for a period of one year, subject to the conditions of approval in Exhibit A. YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE Commissioner Lowrey inquired about the weeds on the west side of the building near the wash. Mr. Lyons stated that the area adjacent to the wash is another property, not T 6 Jas. Staff will get in contact with either the other property owner or a Los Angeles County Public Works maintenance crew to clean up the weeds. B. CONDITIONAL USE PERMIT 95-643 - 9033 Whitmore Street - Request from Nguyen Hon Tran to construct an addition to an existing single family residence creating floor area over 2,500 square feet. Mr. Troyer presented the staff report and recommended approval of the request subject to conditions of approval 1 through 10. The Chairman opened the public hearing. John Rauth , 4528 Bartlett. Asked if there was any zone variance involved with this project. Mr. Lyons stated no. Mr. Rauth , what is FAR? Mr. Lyons, FAR stands for Floor Area Ratio. There being no one else wishing to address the Commission, the public hearing was closed. (MO) It was moved by Commissioner Breen, seconded by Commissioner Ortiz that Conditional Use Permit 95-643 be approved, subjected to the conditions in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE C. CONDITIONAL USE PERMIT 95-647 - 3600 Rosemead Boulevard - Request from Christiansen Amusements to stage a four (4) day carnival. Mr. Lyons presented the staff memorandum and recommended approval subjected to conditions of approval 1 through S. Chairman Ruiz asked if this was a private venture? f/ • • PC MINUTES AUGUST 7, 1995 PAGE 3. Mr. Lyons, stated yes that is was. Commissioner Loi asked if there was any insurance required? The Chairman opened the public hearing. Bill Jacob, 3136 Bervardo Lane, Escondido, applicant. Mr. Jacob explained that they are insured with Montgomery Wards, but can always put the City as additional insured. Chairman Ruiz inquired about clean up after the event. Mr. Jacob explained that clean up of the property was normal procedure, part of their policy. They have been putting on carnivals for years. Commissioner Ortiz inquired about the Rey Shop being closed. Mr. Jacobs stated that the Rey Shop will be opened and no parking spaces will be affected. He also stated that not everyone comes at once and that he anticipates no problems with traffic flow. Commissioner Ortiz inquired if any type of sleeping quarters/vehicles that will be on the premises? Mr. Jacobs stated that personnel will be staying at quarters in Fontana, not at the carnival site. No personnel will be on the premises but security. Chairman Ruiz asked if anyone else would like to speak on behalf of this project? Is there anyone who would like to speak against this project? Mr. Juan Nunez, 2702 Del Mar. Stated that he feels the City should be covered on the insurance. Mr. Lyons stated he would have the City put on the insurance policy. Mr. Price stated that by approving this CUP, the City is not liable. Chairman Ruiz then closed the public hearing. Commissioner Lowrey stated that what if the ferris wheel goes down. The City is still involved and liable. Mr. Price suggested that condition #9 could be added listing the City as an additional insured. Mr. Lyons stated he will work with the applicant about insurance. Commissioner Breen is pleased that they are hiring two additional Sheriff's for security and for traffic flow. (MO) It was moved by Commissioner Breen, seconded by Chairman Ruiz that conditional use permit 95-647 be approved, subjected to the conditions in Exhibit A. Maintenance on rides, $5 million does not buy a life. Chairman Ruiz stated that the City has had carnivals before. People can get hurt at home. He feels the City cannot deprive the children by denying the event. Mr. Lyons stated that all rides are inspected by the Building Department. Mr. Wagner states that the carnival will attract more people to the square, possibly more sales tax for the City. Commissioner Lowrey was still not comfortable with the insurance issue. 5. OTHER BUSINESS A. EXTENSION OF CONDITIONAL USE PERMIT 91-526 - Request from Pho Thang Vi to continue the operation of a garment manufacturing business at 8942 E. Garvey Avenue, dba Center Fashion (cont'd from 6-19-95 meeting). Mr. Troyer presented the staff report and recommended a six month extension. Mr. Troyer also stated that condition #7 regarding the gates being opened between the hours of 8:00 a.m. to 6:00 p.m. He has spoken to the Fire Department and determined that if a Knox Box was installed the gates could remain closed. Commissioner Ortiz inquired about the two metal containers. Will then remain on property? Also about the structure in the southeast corner. Do they have permits? Mr. Troyer stated that he will have the Building Department investigate and inspect for any construction without permits. Chairman Ruiz stated that he feels comfortable with the six month extension. (MO) It was moved by Commissioner Loi, seconded by Commissioner Lowrey to approve the extension of Conditional Use Permit 91-526 for six (6) months subject to the conditions in Exhibit A. EXTENSION OF CONDITIONAL USE PERMIT 93-597 - Request from Henry Wong to continue an on-sale beer and wine (Type 41) license in conjunction with a restaurant located at 8450 Valley Boulevard, #121, dba 888 Restaurant (cont'd from 7-17-95). Mr. Lyons presented the staff report and recommended approval of the extension request for two (2) years subject to the conditions in Exhibit A. Commissioner Lowrey suggested that possibly the security guard could have a check in/check out procedure. Commissioner Loi was pleased with the measures and conditions to help reduce the theft at the center. (MO) It was moved by Commissioner Loi, seconded by Commissioner Breen to approve the extension of Conditional Use Permit 93-597 for two (2) years subject to the condition in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE C. MODIFICATION OF TENTATIVE PARCEL MAP 23157 - Request from Toys R Us, Inc. to modify a vested parcel map for a 2-lot subdivision, located at 3535 Rosemead Boulevard. Mr. Lyons presented the staff report and recommended approval of the re-subdividing eight (8) lots into two (2), subject to the conditions listed in Exhibit A. Commissioner Lowrey inquired why this procedure was not done earlier? Mr. Lyons stated that they were trying to clean up the map prior to exterior remodeling. Sacramento Land approves of the consolidation. Chairman Ruiz stated that staff has taken appropriate steps. (MO) It was moved by Commissioner Ortiz, seconded by Commissioner Breen to approve the modification to Tentative Parcel Map 23157. D. EXTENSION OF CONDITIONAL USE PERMIT 87-398 - Request from Douglas Emslie to continue the operation of an emergency vehicle dispatch located at 9739 Abilene Avenue, dba Lifeline Medical Transportation, Inc. Mr. Troyer presented the staff report and recommended approval of the extension request for three (3) years subject to the conditions in Exhibit A. EXTENSION OF CONDITIONAL USE PERMIT 91-519 - Request from Luis and Alice Lau to continue an off-sale general liquor (Type 21) license located at 9119 E. Garvey Avenue, dba Garvey Liquor. Mr. Troyer presented the staff report and recommended approval of the extension request for three (3) years subject to the conditions in Exhibit A. (MO) It was moved by Commissioner Loi, seconded by Commissioner Lowrey to approve the extension of Conditional Use Permit 91-519 for three (3) years subject to the conditions in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE F. EXTENSION OF CONDITIONAL USE PERMIT 92-568 - Request from Joyce Chen to continue an on-sale general liquor (Type 47) license in conjunction with a restaurant/bar located at 8772 E. Valley Boulevard, dba Rose Room. Mr. Troyer presented the staff report and recommended approval of the extension request for two (2) years subject to the conditions of Exhibit A. (MO) It was moved by Commissioner Lowrey, seconded by Commissioner Loi to approve the extension of Conditional Use Permit 92-568 for two (2) years subject to the conditions in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE G. EXTENSION OF CONDITIONAL USE PERMIT 93-600 - Request from Newton Tran to continue an on-sale beer and wine (Type 41) license in conjunction with a restaurant located at 8450 Valley Boulevard, #111 & #112, dba Pho 54 Restaurant. Mr. Lyons presented the staff report and recommended approval of the extension request for two (2) year subject to the conditions of Exhibit A. • PC MINUTES AUGUST 7, 1995 PAGE 7. Commissioner Lowrey wants to know if the crime has come down? Mr. Lyons stated that serious crimes have come down. Commissioner Ortiz inquired about four helium containers at the location. Commissioner Loi spoke in Vietnamese to the applicant, Ha .Mach, 10186 Stilbite Avenue, Fountain Valley, regarding the helium containers. Applicant stated that they were use for balloons for customers. Commissioner Loi asked if the containers were there permanently or temporary. Applicant stated that they will stop after the summer. Commissioner Ortiz inquired if they helium containers needed Fire Department approval? Mr. Lyons stated that the City will have the inspector go out and inspect the business. (MO) It was moved by Commissioner Loi, seconded by Commissioner Lowrey to approve the extension of Conditional Use Permit 93-600 for two (2) years subject to the conditions of Exhibit A. 6. CONSENT CALENDAR A. PC RESOLUTION 95-22 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, RECOMMENDING CITY COUNCIL APPROVAL OF MUNICIPAL CODE AMENDMENT 95-02, AMENDING ROSEMEADIS MUNICIPAL CODE TO REQUIRE AUTOMOTIVE RELATED USES TO SECURE A CONDITIONAL USE PERMIT IN THE C-3 AND M-1 ZONES. B. PC RESOLUTION 95-23 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, RECOMMENDING CITY COUNCIL APPROVAL OF GENERAL PLAN AMENDMENT 95-01, AMENDING THE LAND USE MAP OF THE GENERAL PLAN TO CHANGE THE DESIGNATION FROM 11OFFICE/LIGHT INDUSTRIAL' TO "MIXED USE, RESIDENTIAL/COMMERCIAL11 FOR PROPERTIES LOCATED AT 7503-7527 HELLMAN AVENUE (APN#s:5286-008-008 & 020, PLUS 5286-009-024, 027 & 028). GARVEY AVENUE, SUITE C-4 AND C-5 (APN 5289-011-019). Mr. Price presented the resolutions. (MO) It was moved by Commissioner Lowrey, seconded by Commissioner Loi to adopt the above Resolutions. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE 7. ORAL COMMUNICATION FROM THE AUDIENCE S. MATTERS FROM CITY OFFICIALS AND STAFF Mr. Lyons gave the status of Josephine's condition. She is doing good and may come home this week. Mr. Rauth stated he could not hear. He had a question about the consent calendar. Mr. Price explained that the public hearing had been held on these consent calendar items and tonight they are only reaffirming the decision made on July 17th. Then the item goes to the City Council for approval. Commissioner Lowrey was glad to see Jan. Commissioner Ortiz inquired about the containers at the business just east of Valley Boulevard and Rosemead Boulevard. Mr. Lyons stated that they will go out and inspect. Commissioner Breen expressed his condolences to the family of Traffic Commissioner Eldon Beezley. Chairman Ruiz welcomed Jan and inquired about the property at walnut Grove Avenue and Valley Boulevard. Property needs to be cleaned up. Can see wrecked vehicles from street. Chairman Ruiz then adjourned the meeting in honor of Eldon Beezley at 8:30 p.m. The next regularly scheduled meeting will be held on August 21, 1995, at 7:00 p.m.
