CALL TO ORDER - The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Lowrey at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 E. Valley Boulevard, Rosemead. The Pledge of Allegiance was led by Commissioner Breen. The Invocation was delivered by Commissioner Ortiz. 2. ROLL CALL - Present: Loi, Lowrey, Breen, Ortiz Absent (Excused): Ruiz Ex Officio: Wagner, Price, Lyons, Holm, Pickett 3. APPROVAL OF MINUTES - Regular meeting March 20, 1995. (MO) It was moved by Commissioner Breen, seconded by Commissioner Ortiz to approve the minutes of March 20, 1995. Vote resulted: YES: LOI, LOWREY, BREEN, ORTIZ NO: NONE ABSENT (Excused): RUIZ ABSTAIN: NONE 4. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City Attorney Stanton Price explained the public hearing process and the right to appeal decisions of the Planning Commission to the City Council. 5. ADMINISTRATION OF OATH - The Commission Secretary administered the oath to members of the audience wishing to speak. PUBLIC HEARINGS 6. CONDITIONAL USE PERMIT 95-636 - 8823 E. Garvey Avenue, #B3 & #B4 - Request from Tac Venh Le to establish a garment manufacturing business dba Long Fat Fashion. Mr. Holm presented the staff report with the recommendation to approve. It was ascertained that the applicant was in the audience. e The Chairman opened the public hearing. Addressing the Commission in favor of the request was: D. P. Nhan, real estate representative of Mr. Tran, the applicant, stated that he was requesting the Commission's approval as the applicant intends to start his own business PC Minutes 4-3-95 Page 2 of 4. in the City. Commissioner Loi inquired as to which space the applicant would be occupying. Mr. Holm responded that the applicant would be occupying two tenant spaces in building B. Commissioner Ortiz wanted to verify and confirm from the applicant that he was agreeable to the condition regarding the maximum number of persons and sewing stations inside the unit not to exceed ten (10) employees/stations. He clarified that this limit on employees includes management. The applicant stated that he was agreeable to all of the conditions. There being no one else wishing to address the Commission, the public hearing was closed. Discussion by the Commission: (MO) It was moved by Commissioner Breen, seconded by Commissioner Ortiz to approve Conditional Use Permit 95-636, subject to the conditions of approval. Vote resulted: YES: LOI, LOWREY, BREEN, ORTIZ NO: - NONE ABSENT (Excused): RUIZ ABSTAIN: NONE 7. MUNICIPAL CODE AMENDMENT 95-01 (IMPERVIOUS SURFACES) - Municipal Code Amendment (MCA) that would set standards to restrict the paving of front and side yard areas in the R-1 and R-2 zones citywide. Mr. Lyons presented the staff report recommending approval of Municipal Code amendment 95-01 of the Rosemead Municipal Code pertaining to impervious surfaces. Chairman Lowrey inquired about storage of RV vehicles, boats and the like. Mr. Lyons responded that all property owners need to adhere to this ordinance. This ordinance does not address back yard parking, it only deals with front and side yard areas. Commissioner Ortiz wanted to know if the concrete walls between houses would be calculated as part of the setbacks on both sides of the dwelling. Mr. Lyons responded that the setback between the property line and the house has to be five (5') feet. If the blockwall becomes like an extension of the yard area, then it would need to be addressed. Commissioner Loi wanted to know about calculations for forty foot lots. Mr. Lyons responded that the same standards apply to all lots regardless of width. Commisisioner Ortiz expressed concern with the existing unsightly dwellings. He wanted to know if a permit for improvements would be required or would they be advised to come to the City for compliance. PC Minutes 4-3-95 Page 3 of 4. Mr. Lyons responded that this ordinance is not retroactive and will not affect the existing dwellings. If the property owners would do some improvements or add on to the house, they will be required to comply. Chairman Lowrey commended staff for an excellent draft presented. Commissioner Breen wanted to know if this ordinance applies to flag lots. Mr. Lyons replied that it does apply to all types of flag lots, parcel maps and tract maps. The Chairman opened the public hearing. (Verbatim minutes as requested by Mr. Clanton for City Council Meeting) Chairman Lowrey and Commissioners, most of you people know me here, retired Traffic Commissioner. I'm a political activist who keeps in touch with the people. My name is Glenn Clanton, everybody knows I live at 3244 Leyburn Drive, Rosemead. After going over this, most of this afternoon's studying, I came up the fact that it's a start. Just like any ordinance, we have to amend it as we find if somebody's found a loophole or something of that nature. But I have been here since this was County area, I watch it grow as a City and the people who have approached me over the years say, "Gee, Mr. Clanton can't you, look what they're storing in their front yards. You know, I want to get up looking down my street in the morning and I want to see nice green trees and lawns. I don't want to see a pile of junk or old cars or something. Now this has been going on for me for thirty some years, that I've heard this. And the, obviously you've had some more complaints other than mine. I think that staff did a wonderful job. It's what they had to do with. But there's always an if; if this and if that. But if you clean up the front yards, and if a lot is a corner lot, and tell somebody that they can't park a trailer on the side of the house that faces the street, by calling them in, the Planning Director or staff can assess what they think would conform with the beginning of this law. And then if we find we have too many con.. contestants, contested plans, we can sit down and but we have to start somewhere. Otherwise we're getting a pile of junk around in this neighborhood. And then we get the big trucks all over the place, and then the kids come along and put graffiti on them. Start with the front yards and side yards, please. And I wanna say this is what I had written, we have long needed such an ordinance since for some years, the citizens have asked me what City Hall is doing about cleaning of front yards, of cars and other unsightly things. This law may be a start. Thank you. (End of Verbatim Minutes) There being no one else wishing to address the Commission, the public hearing was closed. Discussion by the Commission: (MO) Commissioner Ortiz commented that this is a good start with regards to the front yards. There had been a lot of complaints in the past about unkept front yards and it had never been addressed. He felt that this ordinance is a good guideline to follow. The amendment had covered all the areas that needed to be addressed and he moved and recommended approval of MCA 95-01 (Impervious Surfaces). Mr. Lyons recommended to remove the side driveway requirements as there are a number of homes that do not have fifteen (15) feet. Commissioner Loi suggested to continue as he needed more time to study the amendment. • 0 PC Minutes 4-3-95 Page 4 of 4. PC RESOLUTION 95-08 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD RECOMMENDING CITY COUNCIL APPROVAL OF MUNICIPAL CODE AMENDMENT NO 94-03 ADDING RULES AND REGULATIONS FOR THE TIME, PLACE, AND MANNER WHICH -ADULT- ORIENTED BUSINESSES MAY OPERATE. 9. PC RESOLUTION 95-09 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING APPROVAL OF CONDITIONAL USE PERMIT 94-268 TO CONSTRUCT A 1,562 SQUARE FOOT RELIGIOUS CHAPEL PLUS A 2,454 SQUARE FOOT KEEPERS UNIT, ON A 25,397 SQUARE FOOT LOT, ZONED R-1, WITH 52 ON-SITE PARKING SPACES. 10. PC RESOLUTION 95-10 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING APPROVAL OF CONDITIONAL USE PERMIT 95-633 TO TRANSFER AN EXISTING ON-SALE BEER AND WINE LICENSE (TYPE 41) IN CONJUNCTION WITH AN EXISTING RESTAURANT, LOCATED AT 8232 E. GARVEY AVENUE, x/101, DBA PHO 79. Mr. Price presented the resolutions by title only. (MO) It was moved by Commissioner Breen, seconded by Commissioner Ortiz, to waive further reading and adopt. Mr. Lyons and Ms. Pickett reminded the Commission about forthcoming activities, the West San Gabriel Planning Commission luncheon meeting at San Marino for April 19th and the Commissioners' workshop on Saturday, April 22nd, at Rosemead Sheraton. The deadline for reservations would be on April 13th. B. Announcement by Mr. Wagner of Mr. & Mrs. Jeff Stewart's healthy 5 lb. 4 oz. j baby boy, Brett Stewart. Both mother and baby are doing well and are home. 13. ADJOURNMENT There being no other business to come before the Commission, the meeting was adjourned at 7:55 p.m. The next meeting will take place on April 17, 1995, at 7:00 p.m.
