PC - Minutes 03-06-95CITY OF ROSEMEAD 8838 VALLEY. BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING March 6, 1995 MINUTES 1. CALL TO ORDER - The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Lowrey at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 E. Valley Boulevard, Rosemead. The Pledge of Allegiance was led by commissioner Ortiz. The Invocation was delivered by Commissioner Ruiz. 2. ROLL CALL - Present: Loi, Ruiz, Lowrey, Breen, Ortiz Ex Officio: Wagner, Price, Lyons, Holm, Pickett 3. APPROVAL OF MINUTES - Regular meeting February 21, 1995. (MO) It was moved by Commissioner Ortiz, seconded by Commission Ruiz to approve the minutes of February 21, 1995. Vote resulted: YES: Loi, Ruiz, Lowrey, Breen, Ortiz NO: None ABSTAIN: None ABSENT: None 4. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City Attorney Stanton Price explained the public hearing process and the right to appeal decisions of the Planning Commission to the City Council. 5. ADMINISTRATION OF OATH - The Commission Secretary administered the oath to members of the audience wishing to speak. PUBLIC HEARINGS 6. ZONE VARIANCE 94-269 - 2438 Bartlett Avenue - Request from Tong Tran to construct a 462 square foot addition without providing an additional parking space (cont'd. from 1-16-95 and 2-21-95). Mr. Holm presented the staff memorandum with the recommendation to deny. It was ascertained that the applicant was in the audience. The Chairman opened the public hearing. Addressing the Commission in favor of the request was: Mr. Tong Tran, 8745 Hovey Street Rosemead. Mr. Tran, the applicant, stated that he had resubmitted another set of plan as instructed by the Commission for a reduced floor area of the family room, and that he was hoping for a favorable decision from the Commission. There being no one else wishing to address the Commission, the public hearing was closed. Discussion by the commission: PC Minutes 3-6-95 Page 2 of 4. Commissioner Loi stated that based on the applicant's cooperation with staff, he felt that an approval should be granted. (MO) It was moved by commissioner Loi, seconded by Commissioner Breen to approve Zone Variance 94-269, subject to the conditions of approval. Vote resulted: YES: Loi, Breen, Ortiz NO: Ruiz, Lowrey ABSTAIN: None ABSENT: None Commissioner Ortiz reiterated his concern on the garage being utilized as a dwelling unit. Mr. Lyons responded that condition #10 was added to ensure enforcement and compliance of the garage use. Chairman Lowrey inquired if the conditions of approval were acceptable and if the applicant understood them. The applicant replied that they were acceptable and that he was agreeable to all of them. Chairman Lowrey and Commissioner Ruiz' stated their no votes were based on staff's analysis and findings that the proposed addition does not meet the requirements for granting a variance. 7. MODIFICATION OF CONDITIONAL USE PERMIT 90-506 - 8515 E. Garvey Avenue, #E - Request from Ta Ting Ka to modify an existing Conditional Use Permit for the purpose of adding 318 square feet of floor area to an existing tenant space. Mr. Lyons presented the staff memorandum with the recommendation to approve for one (1) year, subject to the amended conditions of approval. It was ascertained that the applicant and the son of the owner of the property were in the audience. The Chairman opened the public hearing. Addressing the Commission in favor of the request were: Laura Luong, 8515 E. Garvey Avenue, #E, Rosemead. Ms. Luong stated that all the conditions of approval were acceptable to her. Peter Kan, 727 E. Bendow Street, Covina. Mr. Kan, son of the property owner and speaking on behalf of his father, Mr. Ta Ting Ka, stated that the total square footage of the addition was within the planning department's requirement. And with regards to the added condition #8, that refers to obtaining all building permits, they are already in the process of obtaining these building permits. If the Commission had some questions or concerns, he would be more than happy to respond to them. There being no one else wishing to address the Commission, the public hearing was closed. Discussion by the Commission: Commissioner Ortiz expressed his concern with the size of the mezzanine being too small for a storage area. He felt that this would be detrimental to the safety and well being of the employees. Also, that this facility may be converted to uses other than a mezzanine, and the impact this addition would cause on the parking ratio. PC Minutes 3-6-95 Page 3 of 5. Mr. Price suggested addition of a condition to ensure compliance of the usage. Mr. Lyons added that staff would be able to monitor the business and bring it back to the Commission for another review in six (6) months. Commissioner Ortiz stated that the building was not designed for this type of construction, therefore, the applicant needs to meet the seizmic requirement for wood or metal building. Mr. Lyons responded that all uniform building code requirements should be met or the mezzanine will be torn down. With Building and Engineering Departments' review, if a seizmic requirement is needed, then the applicant would be required to comply. In response to Commissioner Ortiz' concern regarding the parking issue, Mr. Holm stated that condition #3 was added limiting the number of employees to eight (8) which took into account the addition of the mezzanine. Commissioner Ortiz felt that approving this item will be setting a precedent for all other businesses in the City. Approval will create a parking problem due to an increased floor area ratio with the safety and well being of the employees being at risk. \ And for these reasons, he was against approving the item. Commissioner Loi felt that inspections on a periodic basis should be part of the condition to ensure that the mezzanine is used solely for storage purposes only. (MO) It was moved by Commissioner Ruiz, seconded by commissioner Loi to approve Modification of Conditional Use Permit 90-506, subject to the amended conditions of approval. Vote resulted: YES: Loi, Ruiz, Lowrey, Breen NO: Ortiz ABSTAIN: None ABSENT: None 8. MODIFICATION OF CONDITIONAL USE PERMIT 93-589 - 3027 N. Del Mar Avenue - Request from Martin Lin to modify an existing Conditional Use Permit for the purpose of amending the circulation, parking and reducing the size of the existing structure (dba Buddhist Ortho-Creed Association). Mr. Holm presented the staff memorandum with the recommendation to approve, subject to the conditions of approval. The Chairman opened the public hearing. Addressing the Commission in favor of the request was: Martin Lin,. 1944 Avenida Del Canada, Rowland Heights, applicant for this project. Mr. Lin stated that there were some problems requiring revision of the parking and circulation from the last approval. With the help from staff, this issue had been resolved. Mr. Lin showed a model of the new plan to the Commission. Using the model, he showed a porch leading to the back area making the connection between the Temple and the surrounding area. He was very pleased with this revision and he hopes for a favorable approval from the Commission. Commissioner Loi inquired if the library would be opened to the public in the future, and he also observed there were no assigned handicap parking. PC Minutes 3-6-95 Page 4 of 5. Mr. Lin responded that it is their intent to make the library accessible to the public; it will not be limited or restricted to congregation members only. With regards to handicap parking spaces, they had been reassigned but there will be handicap parking. Using the model, Mr. Holm showed the Commission the new patio covering area; one space on each side of the ramp area would be assigned for the handicap. Two handicap spaces would be required. There being no one else wishing to address the Commission, the public hearing was closed. Discussion by the Commission: (MO) Commissioner Ruiz commended the project and moved to approve Modification of Conditional Use Permit 93-589, seconded by Chairman Lowrey, subject to the conditions of approval. Vote resulted: YES: Loi, Ruiz, Lowrey, Breen, Ortiz NO: None ABSTAIN: None ABSENT: None OTHER BUSINESS 9. EXTENSION OF CONDITIONAL USE PERMIT 87-392 - A request from Hari Alipuria for a conditional use permit extension for the on-site sale of beer and wine dba Chameli Restaurant, for property located at 8752 E. Valley Boulevard (cont'd. from 2-21-95). Mr. Lyons presented the staff memorandum with the recommendation to approve. However, it was ascertained that the applicant was not in attendance even though he received both verbal and written reminders. Commissioner Ortiz stated that he has some concern with this item and suggested to continue for the next meeting in order to allow time for the applicant to be in attendance to respond to them. There was no objection and the item was continued to the regular meeting of March 20, 1995'. 10. PC RESOLUTION 95-04 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING APPROVAL OF MOFIFICATION OF CONDITIONAL USE PERMIT 79-163 TO MODIFY CONDITIONS TO LEASE EXISTING SERVICE BAYS FOR LIGHT AUTO REPAIR IN THE C-3 ZONE FOR PROPERTY LOCATED AT 3302 N. DEL MAR, ROSEMEAD. Mr. Price presented the resolutions by title only. (MO) It was moved by Commissioner Ortiz, seconded by Commisioner Ruiz, to waive further reading and adopt. Vote resulted: YES: Loi, Ruiz, Lowrey, Breen, Ortiz NO: None ABSTAIN: None ABSENT: None 11. ORAL COMMUNICATION FROM THE AUDIENCE - On any matter - None PC Minutes 3-6-95 Page 5 of 5. 12. MATTERS FROM CITY OFFICIALS AND STAFF A. Mr. Lyons mentioned that on the March 20th meeting, the Planning commission will discuss the Adult-Oriented Business ordinance. He also informed the Commission that James Troyer took the week off in preparation for his master's degree examination. B. Mr. Wagner encouraged the Commission to attend the California Contract Cities Association's Commissioner's Workshop to be held at the Rosemead Sheraton Hotel on Saturday, April 22, 1995. C. Commissioner Ortiz had some concern with regards to three (3) vehicles parked on the fire lane zones at 8515 Garvey Avenue. He observed the automotive repair business doing some repair works specially during Saturday evenings with cars being parked on the fire lanes as there are no postings indicating as fire lanes. Automotive repair shops on Walnut Grove Avenue are in the same condition. Mr. Lyons responded that staff will go and investigate the area for safety purposes and will address this problem. 13. ADJOURNMENT There being no other business to come before the Commission, the meeting was adjourned at 7:55 p.m. The next meeting will take place on March 20, 1995, at 7:00 p.m.
