January 16, 1995
MINUTES
1. CALL TO ORDER - The regular meeting of the Planning Commission
of the City of Rosemead was called to order by Chairman Lowrey
at 7:00 p.m. in the Council Chambers of the Rosemead City Hall,
8838 E. Valley Boulevard, Rosemead.
The Pledge of Allegiance was led by Commissioner Ortiz.

3. APPROVAL OF MINUTES - Regular meeting January 3, 1995.
(MO) It was moved by Commissioner Ortiz, seconded by Commissioner
Loi, to approve the minutes of the regular meeting of January 3,
1995. Vote resulted:
YES: Loi, Ruiz, Lowrey, Breen, Ortiz
NO: None
4. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City
Attorney Stanton Price explained the public hearing process and
the right to appeal decisions of the Planning Commission to the
City Council.
5. ADMINISTRATION OF OATH - The Commission Secretary administered
the oath to members of the audience wishing to speak.
PUBLIC HEARINGS
6. TENTATIVE PARCEL MAP 24136 - 3450 Bartlett Avenue - Request from
Sophia Wong for a tentative parcel map to subdivide an existing
parcel into three (3) lots for the construction of three (3)
single-family dwellings.
Mr. Troyer presented the staff report with the recommendation to
approve.
Commissioner Breen inquired if there's any practical way that
the ground could be leveled in order to avoid the use of the
sump pump.
Mr. Troyer responded that it would be impractical, as per City
Engineer's recommendation, the best and most practical way would
be the use of a sump pump.
The Chairman opened the public hearing.
Addressing the Commission in favor of the proposal was:
Dennis Wong, 1388 W. Colorado Boulevard, Pasadena. Mr. Wong,
the brother of applicant Sophia Wong and prospective buyer of
the property wanted clarification as to who mandates the use of
the sump pump for this project; whether it was his engineer or
the City. Based upon his past experience as a developer for
other cities, he had not encountered this type of a requirement.
Also, he wanted to know if this was a common practice in the
City.

In response, Mr. Lyons explained that the City tries to refrain
from recommending the use of sump pumps, but unfortunately, with
in fill projects such as this with restrictions on grading and
with relatively narrow lot, it is difficult to drain naturally
out in the street, and, the best way to drain this property
would be through the use of a sump pump. Another option for the
applicant would be to acquire an approved drainage easement, a
drainage over another neighboring property owner. Mr. Lyons
also stated that there was an agreement between the developer's
engineer and the City Engineer prior to the Planning Commission
meeting, but unfortunately, there was no communication between
the developer and his engineer.
Commissioner Ortiz suggested to incorporate as part of the
condition the size of the diameter of the sump pump.
Scott Reiz, representing Century 21 Realty, 77 W. Las Tunas
Drive, Arcadia. Mr. Reiz stated that he represents both the
buyer and the seller of this property and that he is familiar
with the good standing and job performance of the developer.
There being no one wishing to address the Commission, the public
hearing was closed.
Discussion by the Commission:
(MO) Without further discussion, it was moved by Commissioner Ruiz,
seconded by Commissioner Breen, to approve Tentative Parcel Map
24136 subject to the amended conditions of approval. Vote
resulted:
YES: Loi, Ruiz, Lowrey, Breen, Ortiz
NO: None
7. CONDITIONAL USE PERMIT 94-631 - 8819 E. Garvey Avenue, #A4 -
Request from Jie Mei Yan to establish a sewing factory in an M-1
zone dba Soon Luck Company.
Mr. Lyons presented the staff report and recommended approval.
It was ascertained that the applicant was in the audience.
The Chairman opened the public hearing.
There being no one wishing to address the Commission, the public
hearing was closed.
Discussion by the Commission:
(MO) Without further discussion, it was moved by Commissioner Loi,
seconded by Commissioner Ruiz, to approve Conditional Use Permit
94-631 subject to the conditions listed in Exhibit A. Vote
resulted:
YES: Loi, Ruiz, Lowrey, Breen, Ortiz

OTHER BUSINESS
8. PROGRESS REPORT ON TENTATIVE TRACT MAP 51299 - 3122-3134
Bartlett Avenue - Explanation of the status of the six (6) lot
single family subdivision (Oak View Court).
Mr. Lyons presented the staff memorandum simply to inform the
Commission on the status of the project on Bartlett, known as
Oak View Court. This is the project where the oak tree is being
preserved in the center of the property. As the Commission may

recall, the zone change was approved by City Council on July 27,
1993. The project had been sold including all entitlements to
Mr. Tom Lee. Mr. Lyons also stated that the architect of the
project was in the audience to answer any questions the
Commission may have.
Commissioner Loi expressed concern about the existing homes to
be barricaded and fenced and that this condition be brought to
the developer's attention.
Mr. Lyons replied that these existing homes which are run down
will be demolished as per state requirements and will be fenced
during the entire construction process as required by City code.
Commissioner Ortiz was concerned about the maintenance of the
oak tree.
Mr. Lyons replied that condition #14 and the City's oak tree
ordinance prevents trimming of limbs with a diameter more than
9" without an arborist certifying that it will not endanger the
oak tree. And in addition, when the drip line is disturbed,
which is below the base of the tree, an arborist will also need
to certify that this disturbance will not affect the tree.
9. EXTENSION OF CONDITIONAL USE PERMIT 93-604 - Request from Peter
Hieng to continue the on-site sale of alcoholic beverages in
conjunction with a liquor store dba G. W. Liquor, for property
located at 8606 E. Garvey Avenue.

Commissioner Ortiz expressed some concerns with regards to the
land uses; to the newly constructed walls, whether or not they
were permitted; and also regarding the passage and rear
patio/storage area where some construction was done. He,
therefore, preferred continuance of the item to allow more time
to deal with existing problems.
Mr. Lyons recommended that staff together with the Commissioner
and the Building inspector go to the site for inspection.
There being no objection, the Chairman continued the item to
February 6, 1995 Planning Commission meeting.
10. EXTENSION OF CONDITIONAL USE PERMIT 92-568 - Request from Joyce
Chen to continue the on-site sale of alcoholic beverages in
conjunction with a restaurant/bar dba Rose Room, located at 8772
E. valley Boulevard.
Mr. Troyer presented staff memorandum with the recommendation to
continue the item to February 6, 1995 meeting until condition #7
is adhered to which refers to recording of the covenant and also
compliance to condition #9 with regards to security guards.
Commissioner Breen concurred with staff's recommendation to
continue the item.
Chairman Lowrey suggested addition of condition #12 that lights
at the parking area be on from sunset till dawn.

Mr. Lyons agreed that a properly lighted parking area will deter
and reduce some of the existing problems.
There being no objection, the Chairman continued the item to
February 6, 1995 Planning Commission meeting.
11. PC RESOLUTION 94-38 - A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROSEMEAD GRANTING APPROVAL OF ZONE VARIANCE 94-268
TO ALLOW THE CONSTRUCTION OF A SECOND STORY STORAGE AREA IN AN
EXISTING WAREHOUSE WITH A PARKING DEFICIENCY OF THREE (3)
PARKING SPACES DBA ESPINOZA'S LEATHER GOODS, LOCATED AT 8730 E.
GARVEY AVENUE, ROSEMEAD.
(MO) It was moved by Commissioner Breen, seconded by Commisioner
Ruiz, to waive further reading and adopt. Vote resulted:
YES: Loi, Ruiz, Lowrey, Breen, Ortiz

12. ORAL COMMUNICATION FROM THE AUDIENCE - On any matter

A. Chairman Lowrey inquired about the San Gabriel Valley
Planning Commission meetings.' Mr. Lyons stated that there
was a break due to holiday season but the Commission will be
informed of their forthcoming events.
B. Commissioner Ortiz reported to the Commission on the huge
success of the Legg Lake Fishing Derby for the children. He
also thanked the help of different organizations and
agencies that made the event a very enjoyable one.
