PC - Minutes 08-17-81 (2)j CITY OF ROSEMEAD _ 8838 VALLEY BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING AUGUST 17, 1981 MTNIITR.S 1. CALL TO ORDER - The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Lowrey.at 7:30 p.m. in, the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. The Pledge of Allegiance was led by Commissioner Ritchie. The Invocation was delivered by Chairman Lowrey. 2. ROLL CALL - Present: DeCocker, Schymos, Lowrey, Ritchie, Mattern Absent: None ExOfficio: Carmona, Christianson, de Zara, Kress 3. APPROVAL OF MINUTES - Regular Meeting, July 6, 1981 Regular Meeting, July 20, 1981 Regular Meeting, August 3, 1981 It-was moved by Commissioner:-De Cocker;-seconded by Commissioner'Ritchie to approve the Minutes of July 6, 1981, as printed. ROLL CALL VOTE: Ayes: DeCocker, Schymos, Lowrey, Ritchie, Mattern It was moved by Commissioner Schymos, seconded by Commissioner Mattern to approve the minutes of July 20, 1981, as amended. ROLL CALL VOTE - Ayes: DeCocker, Schomos, Lowrey, Mattern Abstain: Ritchie Commissioner Mattern requested that Page 3, Paragraph 6 of the minutes of July 20, 1981 be amended to reflect that the opponents to Zone Change 81-125 had been interrupted, instead of the proponents as stated. Commissioner Ritchie requested that the record show that he abstained from the vote because he was not present at the July 20, 1981 meeting. Commissioner Mattern-requested that the minutes of August 3, 1981 be amended on Page 3, 1st paragraph to reflect that the height of the fence should be determined by viewing from the adjacent properties. Commissioner Mattern also requested that Commissioner Schymos' name be capitalized in Paragraph 6 of the same page. It was moved by Commissioner Mattern, seconded by Commissioner Schymos to approve the minutes of August 3, 1981, as amended. ROLL CALL VOTE: Ayes: Schymos, Lowrey, Ritchie, Mattern Abstain: DeCocker Commissioner DeCocker abstained from voting because he was not present at the August 3, 1981 meeting. 4. - ORAL COMMUNICATIONS FROM THE AUDIENCE - On items not on the Agenda Chairman Lowrey asked if anyone present wished to address the Commission. No one came forward. PUBLIC HEARINGS . 5. RELOCATION 81-D 6 ZONE VARIANCE 81-96 - Request by Edward J. Lopez for the relocation of a duplex, and a zone variance to Section 9105:5, Rear Yard Setback, in an R-2 zone , for property located at 3227 Eckhart,Ave. The Staff Report dated August 17, 1981 was presented by Ms. Christianson, and the recommendation for conditional approval was made. Chairman Lowrey opened the Public Hearing at 7:40 p.m. He also inquired if the applicant was present. Mr. Lopez stated that he was present. PC Cceting - Augus 17, 1581 agc 2 The witnesses were administered the oath by the secretary. Mr. Lopez then addressed the Commission with regard to his proposal, and the changes that had been made in order to make this project more desirable to the City. Mr. Lyle Keller 3214 Eckhart Avenue Rosemead, California 91770 Mr. Keller stated that he was present to find out what type of variance had been requested. However, he stated that since the variance was for rear yard setback, he was not opposed to the project. Chairman Lowrey closed the public hearing at 7:45 p.m. Commissioner Schymos then stated that many of the lots on Eckhart Avenue had been reduced in size because of the widening of,/the street. Further, he stated that he felt that the dwellings proposed for relocation would blend well with the surrounding neighborhood and be an asset to the area. He also recommended approval of this project. There was then a discussion by the Commission with regard to the project. Among the matters considered was the possibility of saving all, or as many, of the trees along the Alhambra Wash. In addition, the installation of walkways between the dwellings was considered. Further, the placement of the garage to allow for a 23' driveway rather than a 20' driveway was considered. During the discussion, the following conditions were added by the Commission to address their specific concerns with the items discussed. 9. Save all the trees along the west property line and the large tree, if possible. 10. Walkways shall be installed between the garage apron and between the two-bedroom section and three-bedroom section of the structure. All walkways shall be cement. 11. Garage shall be set back five (5) feet from the west property line. It was moved by Commissioner Schymos, seconded by Commissioner Ritchie, to approve Relocation 81-D and Zone Variance 81-96, subject to the conditions 1 through 11 and the findings. ROLL CALL VOTE - Ayes: De Cocker, Schymos, Lowrey, Ritchie, Mattern OTHER BUSINESS 6. MODIFICATION TO SECTION 8110: Request by Waymon 0. Wilkes for a waiver of the sidewalk requirement for property located at 3802 Earle Avenue, Rosemead Californa. The memorandum dated September 1, 1981 was presented by Ms. Christianson, and the recommendation- for denial was made. There was a lengthy discussion regarding this request. Commissioner Schymos expressed his disagreement with staff that this request should be denied, since he did not believe that there were a substantial amount of sidewalks installed in the area. He further expressed his concern that the difference in grade between the sidewalk and the adjacent property not having sidewalk would cause a hazard to pedestrians by causing them to stumble and fall. In this regard, the City's liability in this matter was discussed, and the ramping of the sidewalk was considered. Mr. Wayman Wilkes addressed the Commission regarding this request. He stated that he did not feel that the installation of sidewalks should be required, since other properties in the area did not have sidewalks installed. It was moved by Commissioner De Cocker, seconded by Commissioner Schymos, to grant a waiver of Section 8110 to property located at 3802 Earle Avenue. There was then further discussion regarding this request, during which, Commissioner Ritchie, Mattern, and Chairman Lowrey expressed their disagreement with Commissioners Schymos and De Cocker. Commissioner Ritchie then stated that he would make a substitute motion. PC Meeting - August 17, 1981 Page 3 it was moved by Commissioner Ritchie, seconded by Commissioner Mattern, to continue the discussion regarding the request by Wayman O..Wilkes for a waiver of Section 8110, to September 21, 1981. ROLL CALL VOTE - Ayes: De Cocker, Schymos, Lowrey, Ritchie, Mattern Chairman Lowrey called a recess at 8:45 p.m. The meeting reconvened at 8:55 p.m. 7. EXTENSION REQUEST - PARCEL MAP 12877: Request by Ralph M. Dartt for an extension of approval for a ptoject located at 3213 Burton Avenue, Rosemead, -California. The memorandum dated August 17, 1981 was presented by Ms. Christianson, and the recommendation for a one-year extension of approval was made. There was a discussion by the Commission with regard to the fire flow capacity and thee, reason for the extension request. Ms. Christianson informed the Commission that the developers hoped to have the fire flow problem solved as soon as possible; however, they needed additional time to resolve this matter. Mr. Carmona added that he felt that the developer should be given every opportunity to solve the problem. It was moved by Commissioner Ritchie, seconded by Commissioner Schymos, to grant the request for a one-year extension of approval for Parcel Map 12877, located at 3213 Burton Avenue. PC RESOLUTION 81-27 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, DENYING CONDITIONAL USE PERMIT 81-229 FOR THE SALE OF ALCOHOLIC BEVERAGES ON PROPERTY LOCATED AT 9766 VALLEY BOULEVARD, ROSEMEAD, CALIFORNIA. Mr. Kress read the Resolution by title only. It.was moved by Commissioner Schymos, seconded by Commissioner Ritchie, to waive further reading and adopt PC Resolution 81-27. ROLL CALL VOTE - Ayes: Schymos, Lowrey, Ri tchi 6, _'Ma t tern Noes: None Abstain: De Cocker 9. PC RESOLUTION 81-28 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF ZONE VARIANCE 81-95, FOR A PROPOSED PROJECT LOCATED AT 3229 EVELYN AVENUE, ROSEMEAD, CALIFORNIA. Mr. Kress read the Resolution by title only. it was moved by Commissioner Ritchie, seconded by Commissioner Mattern, to waive further reading and adopt PC Resolution 81-28. Commissioner Mattern then requested that Condition No. 5 in Section 4 of this Resolution be amended to read as follows: "5. Installa solid wood or.masonry fence on the north, south, and west property lines, to the satisfaction of the Planning Director. If a wooden fence is installed, it shall have steel supports set in concrete. Fence shall be a maximum of six (6) feet in height, and four (4) feet in height in the front yard, as viewed from adjacent properties, as set forth in Section 9121.17 of the Rosemead Municipal Code." Commissioner Mattern requested that this be amended in PC Resolution 81-29, as well. ROLL CALL VOTE - Ayes: Schymos, Lowrey, Ritchie, Mattern Abstain: De Cocker 10. PC RESOLUTION 81-29 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF PARCEL MAP 14373. (A ONE-LOT SUB.-- DIVISION TO ACCOMMODATE ONE ADDITIONAL SINGLE FAMILY HOME) Mr. Kress read the Resolution by title only. It wasmoved by Commissioner Mattern, seconded by Commissioner Ritchie, to waive further reading and adopt PC Resolution 81-29, subject to the amendment to Condition No. 5, Section 4. requested by Commissioner Mattern. ORAL COMMUNICATIONS FROM THE AUDIENCE - On any matter Chairman Lowrey asked if anyone present wished to address the Commission. No one came forward. 12. MATTERS FROM CITY OFFICIALS AND STAFF A. Mr. Carmona informed the Commission that they should contact staff regarding their attendance at the California Contract Cities Annual Barbeque on August 31, 1981. B. Commissioner Schymos inquired regarding the Commission's opinion in deleting Section 8110 of the Rosemead Municipal Code. He was informed that this matter had been discussed prior to his appointment to the Planning Commission, however, the City Council had chosen to retain this section of the Ordinance. C. De Cocker asked what.the point of measure is from the front yard and asked Staff how it is determined. Ms. Christianson stated that it is studied on each individual case. D. Commissioner De Cocker stated that due to his work schedule, it would be difficult for him to be a member of the Relocation Committee. He then suggested Commissioner Ritchie be appointed to take his place. There being no objection by the Commission, Commissioner Ritchie agreed to sit on the Relocation Committee. E. Chairman Lowrey suggested that perhaps the Commission would be aided in their decisions regarding waivers to Section 8110 if they were provided with in- formation and maps that would indicate if an area was being considered for formation of an assessment district to provide street improvements. Mr. Carmona agreed to provide the Commission with this type of information. F. Mr. Kress stated that he would like to call an executive session to inform the Commission of the litigation pending before the courts in,)which the City of Rosemead is named. Chairman Lowrey agreed to this on behalf of the Commission. G. Commissioner Ritchie requested that a study session be scheduled to consider the draft Zoning Ordinance submitted by the City Attorney's office. After a discussion regarding the most convenient date, a study session was schedule for September 15, 1981 at 6:30 p.m. It was also decided that Commissioner Ritchie would deliver his copy of the draft Zoning Ordinance so that it could be copied- by staff for distribution to the members of the Commission that did not have a copy. 1. Commissioner Mattern made comment on the conduct of the Planning Commission at the public meetings.' 13. ADJOURNMENT There being no further business to come before the Commission, Chairman Lowrey adjourned the meeting at 9:50 p.m. to the Study Session on the Parking Ordinance
