PC - Minutes 02-02-81~ I i I i CITY OF ROSEMEAD 8838 VALLEY BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING FEBRUARY 2, 1981 MINUTES 1 CALL TO ORDER - The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Cleveland at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. The Pledge of Allegiance was led by Commissioner Mattern. The Invocaction was delivered by Commissioner Ritchie. 2. ROLL CALL - Present: De Cocker, Lowrey, Cleveland, Ritchie, Mattern Absent: None Ex Officio: Kress, Dickey, Carmona, Christianson, Fernandez 3. APPROVAL OF MINUTES - Study Session, January 5, 1981 Study Session, January 7, 1981 Regular Meeting, January 19, 1981 It was moved by Commissioner Lowrey, seconded by Commissioner Mattern, to approve the minutes of the Study Session, January 5, 1981, as printed. ROLL CALL VOTE - Ayes: De Cocker, Lowrey, Cleveland, Ritchie, Mattern Noes: None it was moved by Commissioner De Cocker, seconded by Commissioner Ritchie, to approve the Minutes of the Study Session, January 7, 1981, as printed. ROLL CALL VOTE - Ayes: De Cocker, Lowrey, Cleveland, Ritchie, Mattern Noes: None It was moved-by Commissioner Ritchie, seconded by Commissioner Mattern, to approve the Minutes of the Regular Meeting, January 19, 1981, as amended. ROLL CALL VOTE - Ayes: De Cocker, Lowrey, Cleveland, Ritchie, Mattern 4. ORAL COMMUNICATIONS FROM THE AUDIENCE On items not on the Agenda. Chairman Cleveland asked if anyone present wished to address the Commission. No one came forward. PUBLIC HEARINGS 5. EXTENSION REQUEST - PARCEL MAP NO. 12743: Request by Loren Phillips and Associates for an extension of approval for Parcel Map 12743, on property located at 9300 Valley Boulevard. The memorandum was presented by Mr. Carmona, and the recommendation for approval was made. Chairman Cleveland opened the Public Hearing at 7:35 p.m. The witness was administered the oath by'the secretary. PROPONENT: Mr. Lawrence R. Cazares 1740 East Huntington Drive Duarte, California Mr. Cazares addressed the Commission regarding the reasons for the extension request and offered to answer any questions by the Commission. Commissioner Ritchie asked Mr. Cazares if six months was adequate for final recordation of the map. Mr. Cazares stated that six months would be Planning Commission Minutes Regular Meeting - February 2, 1981 Page Two adequate, since all that was necessary was clearance from various departments. Chairman Cleveland closed the Public Hearing at 7:40 p.m. It was moved by Commissioner Ritchie, seconded by Commissioner Mattern, to grant a six-month extension to Parcel map 12743. ROLL CALL VOTE - Ayes: De Cocker, Lowrey, Cleveland, Ritchie, Mattern Noes: None 6. CONDITIONAL USE PERMIT 81-208: Request by Leopoldo De La Rosa and Ricardo Gomez for the sale of alcoholic beverages for off-site consumption in conjunction with a market located at 3247 San Gabriel Boulevard. The Staff Report dated February 2, 1981 was presented by Mr. Carmona, and the recommendation for denial was made. During his presentation, Mr. Carmona stated that the area was over saturated., and that there were several liquor licenses in effect in the vicinity of this project. Chairman Cleveland opened the Public Hearing at 7:42 p.m. The witness was administered the oath by the secretary. PROPONENT: Mr. Leopoldo De La Rosa 3247 San Gabriel Boulevard Rosemead, California Mr. De La Rosa stated that he was one of the applicants for the conditional use permit. He also stated that he would answer any questions by the Commission. In addition, he informed the Commission that this site had been granted a conditional use permit in the past, when it was a restaurant. Commissioner Lowrey asked Mr. De La Rosa what this hours of operation would be. Mr. De La Rosa stated that the market would be open from 7:00 a.m. to 7:00 p.m. In addition, Mr. De La Rosa stated that these hours of operation were intended to attract the neighborhood trade. Chairman Cleveland closed the Public Hearing at 7:45 p.m. There was a short discussion by the Commission with regard to the recom- mendation of staff and over-saturation of the area. Commissioner Lowrey stated that he did not agree that this project would have a detrimental effect on the neighborhood, since there were several other businesses in the immediate vicinity that sell alcoholic beverages. It was moved by Commissioner Lowrey to.grant:Conditional Use Permit 81-208. The motion died for lack of a second. it was moved by Commissioner Mattern, seconded by Commissioner De Cocker, to deny Conditional Use Permit 81-208, due to lack of support for the necessary findings. ROLL CALL VOTE - Ayes: De Cocker, Cleveland, Ritchie, Mattern Noes: Lowrey 7. CONDITIONAL USE PERMIT 81-209: Request by Sun and Duk Chang for the sale of alcoholic beverages for off-site consumption in conjunction with the Altadena Dairy, located at 3254. Del Mar Avenue. The Staff Report dated February 2, 1981 was presented by Mr. Carmona, and the recommendation for denial was made. He cited over saturation of the area as the basis for the recommendation. Chairman Cleveland opened the Public Hearing at 7:50 p.m. Seeing no one wishing to address the Commission, the Public Hearing was closed accordingly. Planning Commission Minutes Regular Meeting - February 2, 1981 Page Three Commissioner Ritchie stated his concern with over saturation of the area, and the adequate checking of customer identification, since this operation is of the drive-through nature. He also stated that he concurred with staff's recommendation for denial. It was moved by Commissioner Ritchie, seconded by Commissioner De Cocker, to deny Conditional Use Permit 81-209, due to lack of support for the necessary findings. ROLL CALL VOTE - Ayes: De Cocker, Cleveland,_Ritchie, Mattern Noes: Lowrey 8.. PARCEL MAP 13988: Request by Anthony Canastro to subdivide an existing lot into three parcels (one commercial lot and two residential lots) on property located at 8714 Valley Boulevard. The memorandum dated February 2, 1981 was presented by Mr. Carmona, and the recommendation for denial without prejudice was made. There was a short discussion by the Commission with regard to the payment of fees, and what the proposal was. It was moved by Commissioner Mattern, seconded by Commissioner Ritchie, to deny Parcel Map 13988 without prejudice. OTHER BUSINESS 9. MODIFICATION TO SECTION 8110: Request by Yatoku Yoshida for a waiver of the sidewalk requirement for property located at 8743 Scott Street. The memorandum dated February 2, 1981 was presented by Ms. Christianson.. Mr. Yoshida addressed the Commission with regard to the improvements taking place at his home, and his reasons for requesting the waiver. Commissioner Ritchie stated that he had investigated this matter and found that there we're very few sidewalks in the vicinity. It was moved by Commissioner Ritchie, seconded by Commissioner De Cocker, to grant the request for modification to Section 8110, and waive the side- walk requirement for property located at 8743 Scott Street. ROLL CALL VOTE - Ayes: De Cocker, Lowrey, Cleveland, Ritchie, Mattern i Noes: None 10. ORAL COMMUNICATIONS FROM THE AUDIENCE - On any matter. Chairman Cleveland asked if anyone present wished to address the Commission. No one came forward. 11. MATTERS FROM CITY OFFICIALS AND STAFF A. Commissioner Mattern requested that a Study Session be scheduled to review the first draft of the Condominium Ordinance. After a discussion, a Study Session was scheduled for Thursday, February 19, 1981 at 6:00 p.m. B. Commissioner Ritchie inquired as to the status of the application by Stor-MOr Warehouse. Mr. Carmona stated that as of this date, staff had not received an application for expansion of the conditional use permit. He also stated that if the application was not filed, this matter would be referred to Zoning Enforcement. There was then a discussion regarding the necessity of a conditional use permit to allow band rehearsals, since this was located in a C-3 zone. Mr. Kress stated that he did not agree with the applicants statement that it was not necessary. He also stated that Mr. Carmona Planning Commission Minutes Regular Meeting - February 2, 1981 Page Four was correct in referring this matter to Zoning Enforcement. C. Commissioner Lowrey made favorable comment on the relocation in progress on Glendon Way. Commissioner Ritchie concurred with Commissioner Lowrey's comments. D. Reorganization of the Planning Commission Chairman Cleveland stated that in accordance with Planning Commission Policy, he would turn the gavel over to Mr. Dickey. Mr. Dickey opened the nominations for Planning Commission Chairman. Commissioner Mattern nominated Commissioner Lowrey for the office of Chairman. Mr. Dickey called for further nominations.. Hearing none, Mr. Dickey closed the nominations for the office of Chairman. Commissioner Lowrey was then elected Chairman by a unanimous vote. Chairman Lowrey then opened the nominations for the office of Planning Commission Vice Chairman. Commissioner Mattern then nominated Commissioner Ritchie for Vice Chairman. Chairman Lowrey called for further nominations. Hearing none, the nominations for Vice Chairman were closed. Commissioner Ritchie was elected Vice Chairman by a unanimous vote. Both Chairman Lowrey and Vice Chairman Ritchie expressed their feelings of pride and accomplishment in the work done by the Planning Commission. 12. ADJOURNMENT There being no further business to come before the Commission, Chairman Lowrey adjourned the meeting at 8:15 p.m.
