STUDY SESSION
OCTOBER 6, 1982
MINUTES
1. CALL TO ORDER - The study session was called to order by Chairman Ritchie at
6:00 p.m., in the Conference Room of Rosemead City Hall, 8838 Valley Boulevard,
Rosemead, California.
2. ROLL CALL - Present: De Cocker, Schymos, Ritchie, Lowrey
Absent: Mattern
Ex Officio: Kress, Dickey, Carmona, Christianson, de Zara
3. MATTERS DISCUSSED - Arcade Ordinance
The discussion began with Mr. Carmona submitting a letter to the Commission from
Lisa Specht, attorney for Farrell's Ice Cream Parlor. In Ms. Specht's letter,
dated October 6, 1982, she stated that she had reviewed the proposed ordinance
with her clients and made certain recommendations for incorporation into the
ordinance. These comments were reviewed and.considered by the Commission throughout
the study session.
There was lengthy consideration.of various aspects of regulating-,game arcades.
Among the matters considered were the possible exclusion of non-video games from
the ordinance, prohibiting the use of tokens, possible installation of such
machines in existing restaurants and their compatibility with the other uses,
limitation of square footage required per machine, limitation of the maximum
number of machines allowed, possible fire department requirements for aisle widths
in this type of use, and methods utilized for approval of security personnel by
the Sheriff's Department.
During this discussion, the following changes were made to the draft ordinance.
Amended,Section 9185. Definitions _(b) Arcade Devices. All devices commonly known .
as "pinball machines", all "video games", games of skill of whatever kind or nature,
whether electronically activated or not. As used herein, arcade device shall not
include the following:
1. Coin-operated billiard tables for which a permit is required.
2. Vending machines which dispense a product.'
3. Player pianos.
Amended Section 9185.2 Mandatory Conditions (a);(2) to read:
The maximum number of machines in any arcade shall not exceed one (1) machine for
every 25 square feet of gross floor area allotted to the arcade operations.
Added Section 9185.2 (f) as follows:
Interior noise conditions shall. not apply to mixed uses within a single. building
occupancy.
Section 9185.3 Permit Duration to read:
No conditional use permit for a game arcade shall be granted for a period longer
than two (2) years, and may be extended for additional periods of two (2) years
with approval of the Planning Commission, without a hearing.
Added Section 9185.5 which reads:
The Planning Commission and/or City Council may impose any additional conditions
upon the granting of any such conditional use permit, which it determines are
necessary or desirable to effectuate the purposes set forth in this Section.
4. ADJOURNMENT - There being no further business to come before the Commission,
Chairman Ritchie adjourned the study session at 9:10 p.m.
