PC - Minutes 04-19-82U ' CITY OF ROSEMEAD ' 8838 VALLEY BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING APRIL 19, 1982 MINUTES 1. CALL TO ORDER - The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Ritchie at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. The Pledge of Allegiance was led by Commissioner Mattern. The Invocation was delivered by Commissioner De Cocker. 2. ROLL CALL - Present: De Cocker, Schymos, Ritchie, Lowrey, Mattern Absent: None Ex Officio: Kress, Dickey, Carmona, de Zara 3. APPROVAL OF MINUTES - Regular Meeting, April 5, 1982 Chairman Ritchie stated that the Minutes of April 5, 1982 were not completed in time for.consideration at this meeting. He further stated that action on the subject minutes would be deferred until the next regular meeting, May 3. 4. ORAL COMMUNICATIONS FROM THE AUDIENCE - On items not on the Agenda Chairman Ritchie asked if anyone present wished to address the Commission. No one came forward. PUBLIC HEARINGS Chairman Ritchie requested that anyone wishing to address the Commission regarding any of the matters scheduled for public hearing, rise and be adminis- tered the oath. The witnesses were administered the oath by the secretary. 5. ZONE AMENDMENT TO ROSEMEAD SUBDIVISIONS 1 )DE - ARTICLE IX, CHAPTER I - ONE-LOT The memorandum dated April 13, 1982 was presented by Mr. Carmona and the recommendation for approval was made. Chairman Ritchie opened the public hearing at 7:35 p.m. OPPONENT: Harry Higley 2044 Kinneloa Canyon Drive Pasadena, California Mr. Higley.stated that he owns property in the City of Rosemead and wished to address the Commission as a potential developer. He then stated his concern with Section 9106.28, Parking Requirements, and explained that it is his belief that the liveable.open.space will be drastically reduced by the parking requirements. There was a discussion by the Commission regarding the basis for the parking requirements. Chairman Ritchie stated that the parking requirements were the result of a survey of existing condominium project in which the majority of the residents indicated that there was a need for additional parking in condo- minium projects. Further, Chairman Ritchie stated that the Commission had given careful consideration to the problem of the excessive number of cars parking on residential streets in Rosemead, and the larger size of today's compact cars. Mr. Higley repeated his request for further consideration of the size of parking stalls required and the number of spaces required. Planning Commission Minutes Regular Meeting - April 19, 1982 Page Two Chairman Ritchie closed the public hearing at 7:42 p.m. There was a discussion by the Commission regarding Mr. Higley's request for a reduction in the size and number of parking spaces proposed in the ordinance. It was the consensus of the Commission that the parking requirements adequately addressed the needs of the citizens of Rosemead. Also discussed was Section 9106.36, Roofing Materials. It was the consensus of the Commission that this section be amended to read, "Roofing materials shall comply with the Rosemead Building Code", in order to avoid conflict with the Uniform Building Code. Commissioner Mattern stated that due to the<< potential fire hazards wooden roofing materials presented, he strongly opposed the use of such materials. He further stated that he would support the prohibition of wooden roofing materials in the City of Rosemead. Chairman Ritchie requested an explanation from the City Attorney as to why prohibiting wooden roofing materials was riot possible at this time. Mr. Kress then stated that the prohibition of wooden roofing materials would be in conflict with the Uniform Building Code, which was adopted by the City of Rosemead as their building code. He further stated that the Uniform Building Code is a state law, and as such, cannot be amended by a City ordinance. He further informed the Commission that in order to amend the Uniform Building Code, the Council would have to make certain topographical, climatic,.or- . A!_ geographic findings and then make a statement explaining why these findings make the City of Rosemead different from other areas in the state. This statement would be subject to the review and approval of various state agencies. There was then further discussion regarding the roofing materials, and con- sideration was-given to?adding a statement encouraging the use of roofing materials other than wooden shakes or shingles. It was the consensus of the Commission that'a statement be added to,,Section 9106.20,-Intent and Purpose, encouraging the use of other types of roofing materials. Another matter discussed by the Commission was the placement of mailboxes within the condominium projects. Chairman Ritchie expressed his desire to require that the location of mailboxes be included on the precise plan, and that the location be approved by the United States Postal Service, in writing. He stated that this would help prevent problems with parking on the street, vehicular traffic circulation within the project, and possible problems with mail delivery and pick-up. After a discussion regarding this suggestion, it was the consensus of the Commission to amend Section 9106.39, (1) (h), as follows: "Mail box locations that have been approved in writing by the United States Postal Service and encourage good pedestrian and vehicular traffic flow." It was moved by Commissioner Mattern, seconded by Commissioner Lowrey to approve the filing of a.Negative Declaration in this matter with the findings that: (A) The Negative Declaration was prepared in accordance with the State and local guidelines; and, (B) The project could not have a significant adverse effect on the environment. ROLL CALL VOTE Ayes: De Cocker, Schymos, Ritchie, Lowrey, Mattern Noes: None It was moved by Commissioner Lowrey, seconded by Commissioner Mattern, to recommend approval of the draft Condominium Ordinance to the City Council with recognition of the following findings: (A) That the proposed ordinance is in accordance with the existing General Plan and it's specific elements; and, (B) That the proposed ordinance is a responsive and a responsible document offered to satisfy expressed community needs and long-term concerns. ROLL CALL VOTE - Ayes: De Cocker, Schymos, Ritchie, Lowrey, Mattern Noes: None Chairman Ritchie advised Mr. Higley that another public hearing before the City Council will be scheduled prior to the adoption of the ordinance. He advised Mr. Higley that he could appear at that time and address the Council with his concerns. Chairman Ritchie called a recess at 8:25 p.m. Planning Commission Minutes Regular Meeting - April 19, 1982. Page Three The meeting reconvened at 8:38 p.m. 6. ZONE AMENDMENT TO ROSEMEAD MUNICIPAL CODE - PART XXII, AUTOMOBILE PARKING REQUIREMENTS The memorandum dated April 13, 1982 was presented by Mr. Carmona and the recommendation for approval was made. Chairman Ritchie opened the public hearing at 8:40 p.m. OPPONENT: Keith Anderson 9616 Valley Boulevard Rosemead, California Mr. Anderson stated that he owned a business in the City of Rosemead and was presently in the process of plan approval for the expansion of his building. He stated that, at present, his proposed parking plan complied with the code requirements; however, if the new ordinance is adopted, he might not be able to comply with the new parking requirements. There was then a lengthy dis- cussion regarding what'-effect the new ordinance will have on plans currently being reviewed in building.plan check. Chairman Ritchie referred the matter to the City Attorney. Mr. Kress then suggested that a zone variance application could be considered by the Planning Commission. Chairman Ritchie closed the public hearing at 8:45 p.m. There was a lengthy discussion by the Commission regarding how best to address projects currently in building plan check that will be effected by the new parking ordinance. Mr. Kress suggested that perhaps the Planning Department could provide a list to the City Council and recommend that these projects be exempt from the provisions of the new ordinance. There was also discussion regarding the number of projects that may be effected, and the permit process involved. Mr. Elroy Kiepke, Deputy City Engineer, addressed the Commission regarding the building plan check process, and the issuance of building permits, stating that permits are not issued untill all reviewing agencies have approved the plans. Mr. Kiepke also stated that this process may take 3 to 6 weeks. After consideration of the various projects, and the possible effect of a blanket exemption for projects under review by the Building Department, it was the consensus of the Commission that each of the projects should file a zone variance application so that the Planning Commission could consider each pro- ject individually. It was moved by Commissioner De Cocker, seconded by Commissioner Lowrey, to approve the filing of a Negative Declaration in this matter with the findings that: (A) The Negative Declaration was prepared in accordance with the state and local guidelines for preparation of environmental documents; and, (B) The project could not have a significant adverse effect on the environment. ROLL CALL VOTE - Ayes: De Cocker, Schymos, Ritchie, Lowrey, Mattern Noes: None It was moved by Commissioner Lowrey, seconded by Commissioner Mattern, to recommend approval of the Parking Ordinance to the City Council with recognition of the following findings: (A) That the proposed ordinance is in accordance with the existing General Plan and it's elements; and, (B) That the proposed ordinance is a responsive and a responsible document offered to satisfy expressed community needs and long-term concerns. PC RESOLUTION 82-12 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A ZONE VARIANCE FOR A PROPOSED DIVISION OF LAND FOR THE PROPERTY LOCATED AT 9415 DE ADELENA AND 3802 RIO HONDO AVENUE. (ZONE VARIANCE 82-100) Mr. Kress read the resolution by title only. It was moved by Commissioner Lowrey, seconded by Commissioner De Cocker, to waive further reading and adopt PC Resolution 82-12. Chairman Ritchie stated that there appeared to be some information regarding the demolition of the existing garage and the construction of the new garage omitted from the resolution. He requested that this be added. Mr. Kress then recommended that this resolution be deferred until such time as the minutes for the meeting of April 5, 1982 were available. Commissioners Lowrey and Commissioner De Cocker withdrew their motion for approval of PC Resolution 82-12. 8. PC RESOLUTION 82-13 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 81-240 FOR THE ESTABLISHMENT OF A CHURCH IN THE C-3 AND R-1 ZONES. Mr. Kress read the resolution by title only. It was moved by Commissioner De Cocker, seconded by Commissioner Mattern, to waive further reading and adopt PC Resolution 82-13. Commissioner Mattern requested a correction to Condition No. 16, to read: "All wooden fences shall have steele supports set in concrete." There being no objection by the Commission, the correction was so ordered. ROLL CALL VOTE - Ayes: De Cocker, Schymos, Ritchie, Lowrey, Mattern Noes: None 9. PC RESOLUTION 82-14 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 82-243, FOR THE ESTABLISHMENT OF A PRE-SCHOOL AT 3220 DEL MAR AVENUE. Mr. Kress read the resolution by title only. It was moved by Commissioner Lowrey, seconded by Commissioner De Cocker, to waive further reading and adopt PC Resolution 82-14. ROLL CALL VOTE - Ayes: De Cocker, Schymos, Ritchie, Lowrey, Mattern Noes: None 10. ORAL COMMUNICATIONS FROM THE AUDIENCE - On any matter Chairman Ritchie asked if anyone present wished to address the Commission. No one came forward. 11. MATTERS FROM CITY OFFICIALS AND STAFF A. Commissioner Schymos inquired if it would be possible to refer the projects effected by the new parking ordinance to the Modification Committee. Mr. Kress stated that he would have to review the Municipal Code prior to rendering an opinion. There was then discussion regarding this matter. Mr. Kress stated that it would depend upon how minor the variance was, and cautioned the Commission that matters of this nature might require a public hearing. B. Mr. Carmona informed the Commission that the illegal room addition at 7602 Newmark was referred to the District Attorney's office. In addition, he stated that the room is being demolished. Planning Commission Minutes Regular Meeting - April 19, 1982 Page Five Mr. Carmona also stated that the unsightly condition of a property on Pitkin Avenue, which was reported previously, has been improved and the construction equipment removed from the premises. Mr. Carmona informed the Commission that-Southern'California'Edison.is proposing the relocation of their air conditioning equipment. However, their application has not been formally submitted. C. Commissioner Mattern thanked staff for resolving the matter at 7602 Newmark. He also reported that the rear..of the Alpha Beta Market on Garvey Avenue is still in an unsightly condition. Commissioner Mattern also reported receiving a request from residents living near 3257-62 Jackson Avenue that city staff investigate prayer meetings being conducted at that address. He stated that the residents had reported loud noise during these meetings. There was a discussion regarding this matter, and staff was directed to inform the persons conducting the prayer meetings of the city regulations regarding this type of assembly. Commissioner Mattern then requested that staff forward any information regarding this matter to him. D. Commissioner De Cocker recommended to staff that draft documents, such as, the Condominium and Parking Ordinances, be dated and marked "DRAFT". Staff was directed to follow the recommendation. E. Commissioner Schymos suggested to Commissioner Mattern that perhaps the residents who reported the neighborhood disturbance would receive immediate results if they would report the disturbance to the police at the time it is occuring. F. Commissioner Mattern stated that he agreed with Commissioner De Cocker's recommendation for draft documents. G. Chairman Ritchie requested that the addresses listed in the weekly reports as being investigated by the Code Enforcement officer, contain a brief description of the violation. H. Chairman Ritchie requested that the Commission schedule a study session to continue the review of the Land Use Element for the General Plan update. He further requested that a representative from Urban Futures be present at that study session. Mr. Dickey stated that he would have to review the contract with Urban Futures to determine if it is still valid. The scheduling of the study session was postponed to another date:`. I. Commissioner Schymos made an-,inquiry--regarding the Planning Commission's compensation payments. Mr. Dickey stated that this matter is set forth by the City of Rosemead Municipal Code, and as such will have to be reviewed and amended by the Rosemead City Council. He further suggested that this matter be presented to the City Council. 12. ADJOURNMENT There being no further business to come before the Commission, Chairman Ritchie adjourned the meeting at 9:40 p.m.
