CALL TO ORDER - The regular.meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Cleveland at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. i The Pledge of Allegiance was led by Commissioner Lowrey. The Invocation was delivered-by Commissioner Mattern. Ms.:,-Christianson administered the oath of office to Mr. Marvin Lowrey, Incumbent, and Mr.;Robert De Cocker, newly appointed Planning Commissioner. :then congratulated the Commissioners on behalf of the Chairman Cleveland Planning Commission. 2. ROLL CALL - Present: De Cocker, Lowrey, Cleveland, Ritchie, Mattern Absent: None Ex Officio: Kress, Dickey, Christianson, Fernandez 1 3. APPROVAL OF MINUTES - Regular Meeting, November 3, 1980 Commissioner Mattern requested a change in item No. 5. He stated that the design overlay zone was imposed by the Commission during the public hearing. Commissioner Ritchie also stated that item No. 9 had a discussion regarding the driveway standards, and mention of the discussion had been omitted. He requested that the discussion be incorporated into the Minutes. it was moved by Commissioner Ritchie, seconded by Commissioner Mattern, to approve the minutes of November 3, 1980, subject to the amendments requested byuthe Commission., ROLL CALL VOTE - Ayes: Lowrey, Cleveland, Ritchie, Mattern Noes: None Abstain: De Cocker 4. ORAL COMMUNICATIONS.FROM THE AUDIENCE - On items not on the Agenda. Chairman Cleveland asked if anyone present wished to address the Commission. No oneccame forward. PUBLIC HEARINGS 5. GENERAL PLAN AMENDMENT 80-1: Request by Good Earth Development Company for a General Plan Amendment from Low-Density to High-Density, for property located at 4106 Walnut Grove Avenue,! The Staff Report dated November 3, 1980, was presented by Ms. Christianson, and the recommendation for continuance was made, due to the fact that there are six properties in the area that are not consistent with the General Plan. There was a discussion by the Commission regarding the request for continuance, and staff was directed to renotify the property owners in the area that the six lots would be included in the consideration of the General Plan Amendment. It was moved by Commissioner Lowrey, seconded by Commissioner Ritchie, to continue the consideration of General Plan Amendment 80-1 at the regular meeting of December 15, 1980. GENERAL PLAN AMENDMENT 80-2: Request.by Harry Higley for a General Plan Amendment from Low-Density-to High-Density, for property located at 8514- .16-18 Valley Boulevard and 3899 walnut Grove Avenue. The Staff Report dated November 17, 1980 was presented by Ms. Christianson and the recommendation_°for approval was made. Chairman Cleveland opened the.Public Hearing at 7:45 p.m. The witnesses were administered the oath by the secretary. PROPONENT: Mr. Harry Higley 2044 Kinneloa Canyon Road Pasadena, California Mr. Higley stated.that he was the applicant andowner of the property. OPPONENTS: Mr. Marvin Jorgenson 8543 Guess Street Rosemead, California Mr. Roy Ladyman 8555 Guess Street Rosemead, California Ms. Marie Connelly 8554 Guess Street Rosemead, California Mrs. Marie Ladyman 8555 Guess Street Rosemead, California The witnesses expressed their concern with.the possible disruption caused by the construction of condominium units. They also.stated their fear of detrimental effects on the neighborhood due to the increase in the density. The witnesses also inquired as to what would happen if the General Plan were not amended to allow the construction of condominiums. They were informed that since the zoning on the property was presently R-3, the j applicant would be able to construct an apartment building. Chairman Cleveland closed the Public Hearing at 8:04 p.m. There was a discussion. by the Commission regarding the development of the subject property, and more particularly changing the zoning of the property to P-D. It was pointed out that because of the size of the lot the P-D zoning would be more. appropriate. In addition, the P-D zoning would allow for greater control iri the development of the property. Also discussed by the Commission was the Edison right-of-way, and the possibility of limiting access to Walnut Grove. It was moved by Chairman Cleveland, seconded by Commissioner Ritchie, to adopt the Negative Declaration for General Plan Amendment 80-2. ROLL CALL VOTE - Ayes.:. CONDITIONAL USE PERMIT 80-202: Request by American Orthodox Catholic Church to conduct a three-day carnival on property located at 3630 North Rosemead Boulevard. Chairman Cleveland opened the Public Hearing at 8:16 p.m. and the witness was administered the oath by the secretary. PROPONENT: Father Matthew Tetrault 3009 Richwood Avenue E1 Monte, California Father Tetrault stated that he was representing the American Orthodox Chatholic Church in this request.. He explained to the Commission his reasons for selecting the City of Rosemead for this carnival and that the carnival was being conducted to raise funds for the Church. He also informed the Commission of the insurance policies and arrangements made for clean-up of the site at the end of the carnival. Chairman Cleveland closed the Public Hearing at 8:20 p.m. There was a discussion. by the Commission regarding the hours of operation for the carnival. It was recommended that the closing time for the carnival be at 10:00 p.m., rather than 12:00 midnight. It was the consensus of the Commission that Condition No. 4 be amended to read as follows: 4. The carnival and all. other activities shall not. be conducted after 10:00 p.m. on any of the three days. It was moved by Commissioner De Cocker, seconded by Commissioner Lowrey, to grant Conditional Use Permit 80-202, subject to the amendment to Conditions No. 4. ZONE CHANGE 80-120 & TENTATIVE TRACT 40720: Request by Wayman 02 Wilkes for a change of zone,. from R-2, Light Multiple Residential to R-3, Heavy Multiple Residential; and a tentative tract map for the division of an existing parcel of land for the purpose of constructing a ten-unit condominium complex on property located at 3202-3206 Walnut Grove Avenue: The Staff Report dated November 17, 1980 was presented by Ms. Christianson and the recommendation for approval was made. Chairman Cleveland opened the Public Hearing at 8:30 p.m. The witnesses were administered the oath by the secretary. PROPONENTS: Mr. Ron Johnson Mr. Robert Rodine Mr. Engles Shen 716 Monterey Pass Road 5327 North Peck Road 19438 Pine Valley Monterey Park, California E1 Monte, California Northridge, California Mr. Johnson stated.that he was representing the applicant and agreeddto comply with all conditions as set forth. Mr. Rodirie stated that he was represehti,6g the subdivider and also expressed hissclient's willingness to comply with all conditions. Mr. Shen stated that he was the engineer handling the project and was present to answer questions by the Commission. Chairman Cleveland closed the Public Hearing at 8:35 p.m. There was a discussion by the Commission regarding the calculation of the open space, the requirement of the Fire Department for fire access and the turn-around radius, the absence of a grading plan for the project and the garage located on the property line of the adjacent property. The Commission also added Condition No. 12 as set forth below: 12. Grading and/or.drainage plans shall.be.submitted to the Planning Department for their approval. it was moved by Commissioner Ritchie to approve the Negative Declaration for this project. There was then asdiscussion by the Commission regarding bi- furcation of the motion for approval. Commissioner Ritchie was informed that a motion for approval would include approval of the zone change and tentative tract. Commissioner Ritchie.then withdrew his motion for approval of the Negative Declaration. It was moved.by ChairmancCleveland, seconded by Commissioner Lowrey, to approve the Negative Declaration, Zone.Change 80-120, and Tentative Tract 40720, subject to the conditions as set forth in the Staff Report dated November 17, 1980. ROLL CALL VOTE - Ayes: De::Cocker, Lowrey, Cleveland Noes: Ritchie, Mattern C7air1ga _ C10 ***Commissioner Ritchie requested.that the following statement be included in the Minutes,as an explanation of his reasons for voting "no" on this project: Commissioner Ritchie stated thetreason for his "no" vote.was because there was no grading/drainage plan submitted and there did not seem to be enough open space. The applicant appeared to have complied only with the letter of the ordinance in.that any and all short cuts.were used to get the;.maximum number of units at the least possible cost. Commissioner Ritchie also said that in his opinion, this project was one of the primary reasons for the moratorium. 9. EXTENSION REQUEST - PARCEL MAP 12390:. Request by H.M. Scott and Associates for an extension of approval for a project located at 8801 East Garvey Avenue which wasi,previously approved by the Planning Commission on November 5, 1979. (Continued from November 3, 1980) The memorandum dated November 17, 1980 was presented by Ms. Christianson and the recommendation for approval was made. Chairman Cleveland asked if anyone present wished to address the commission with regard to this matter; however, no one came forward. It was moved by Commissioner Lowrey, seconded by Commissioner De Cocker, to grant a six-month extension to Parcel Map 12390. ROLL CALL VOTE - Ayes: DecCocker, Lowrey, Cleveland, Ritchie, Mattern Noes: None OTHER BUSINESS 10. PC RESOLUTION 80-40 - A.RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 80-201. The Resolution was read by title only. It was moved by Commissioner Ritchie, seconded.by Commissioner Mattern, to waive further reading and adopt PC Resolution 80-40. PC RESOLUTION 80-41 - A RESOLUTION.OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD, A CHANGE OF ZONE, FROM A-1, LIGHT-AGRICULTURAL TO C-3D, MEDIUM COMMERCIAL, DESIGN OVERLAY, FOR PROPERTY GENERALLY BOUNDED BY THE POMONA FREEWAY ON THE NORTH, ARROYO DRIVE ON THE SOUTH, AND WEST OF SAN GABRIEL BOULEVARD, IN THE CITY OF ROSEMEAD, CALIFORNIA. (ZONE CHANGE 80-121) The Resolution was read by title only. It was moved by Commissioner Lowrey, seconded by Commissioner Ritchie, to waive further reading and adopt PC Resolution 80-41. ROLL CALL VOTE - Ayes: De Cocker, Lowrey, Cleveland, Ritchie, Mattern Noes: None - 12. ORAL COMMUNICATIONS FROM THE AUDIENCE---On any matter. Chairman Cleveland asked if anyone present wished to address the Commission. No one came forward. 13. MATTERS FROM CITY OFFICIALS AND STAFF A. Commissioner Ritchie requested that staff deliver the Planning Commission agenda packets.on Thursdays instead.of Fridays to allow.the Commission more time to conduct their field investigations. y. There being no objections, staff was directed to deliver the agendas no later than Thursday before the meeting. B. Commissioner De, Cocker queried staff on General Plan Amendment 80-1 for his information. C. Commissioner.Mattern.requested the scheduling of a study session to review the Condominium Ordinance. A study session was then scheduled for 6:00 p.m., December 1, 1980. He further stated that study sessions should also be scheduled to consider the new legislation allowing mobilehomes in residential zones. 14. ADJOURNMENT There being no further business to come before the.Commission, Chairman Cleveland adjourned the meeting at 9:15 p.m. ' **Commissioner t.4attern stated that he concurred with Commissioner Ritchie's statement regarding his "no" vote on Tentative Tract 40720 and Zone Change.80-120. He also stated that the package submitted to the Planning Commission was incomplete in that it did.not define the wall adequately, and there was no drainage plan for this project, (Correction requested by Commissioner Mattern on December 1, 1980.)
