PC - Minutes 02-19-80J CITY OF ROSEMEAD 8838 VALLEY BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING FEBRUARY 19, 1980 MINUTES 1. CALL TO ORDER - The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Cleveland at 7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. The Pledge of Allegiance was led by Commissioner Lowrey. The invocation was delivered by Commissioner Ritchie. 2. ROLL CALL - Present: Lowrey, Cleveland, Ritchie, De Tora Absent: Handy (excused) Ex Officio: Dickey, Sullivan, Fernandez 3. APPROVAL OF MINUTES - Regular meeting, February 4, 1980. It was brought to the attention of the Commission that the minutes had been revised prior to the meeting. Mr. Dickey outlined the changes and gave a brief explanation of the reasons why the original Minutes had been revised. Commissioner Ritchie stated that he was opposed to staff changing the Minutes. He felt that this should be done by the Commission at the time of the vote for approval of Minutes. Commissioner Lowrey stated that the revised minutes accurately reflected the meeting. It was moved by Commissioner Lowrey, seconded by Chairman Cleveland, to approve the Minutes of February 4, 1980, as revised. ROLL CALL VOTE - Ayes: Lowrey, Cleveland, De Tora Noes: Ritchie Absent: Handy (excused) Commissioner Ritchie stated that the reason for his "NO" vote was that he did not feel that the Minutes should be changed by staff. 4. ORAL COMMUNICATIONS FROM THE AUDIENCE - On items not on the Agenda. Chairman Cleveland asked if anyone present wished to address the Commission. No one came forward. PUBLIC HEARINGS 5. PARCEL MAP 12993: Request by Alexander Tepper for the subdivision of an existing lot for the purpose of constructing one (1) additional single- family home on property located at 3112 Rosemead Place. The Staff Report was presented by Mr. Sullivan. Chairman Cleveland opened the Public Hearing,at 7:50 p.m. Seeing no one wishing to address the Commission on this matter, the Public Hearing was closed accordingly. Commissioner De Tora asked if the applicant was aware of all the conditions of approval. He was informed by staff that the applicant had been made aware of the conditions. It was moved by Commissioner De Tore, seconded by Commissioner Ritchie, to approve Parcel Map 12993, the Findings, and the Negative Declaration. PARCEL MAP 13042: Request by Peter Doerken for the subdivision of an existing lot for the purpose of constructing an office building on property located at 7556 Garvey Avenue. The Staff Report was presented by Mr. Sullivan. He requested that the Commission add a condition" stating that compliance with all conditions must be met before final recordation of the map can take place. Chairman Cleveland opened the Public Hearing at 7:55 p.m. The witness was administered the oath by the secretary. Proponent: Mr. Michael Mueting 408 South Rosemead Boulevard Pasadena, California Mr. Mueting stated that he was representing the applicant. He also stated that the applicant understood and accepted all of the conditions as set forth in the Staff Report. The Commission asked Mr. Mueting if the applicant would agree to comply with all conditions prior to final recordation of the map. Mr.. Mueting stated that this would be acceptable. Chairman Cleveland closed the Public Hearing at 8:00 p.m. There was a discussion by the Commission regarding the proposed. landscaping and irrigation system, and the addition of a condition requiring compliance with all conditions prior to final recordation. It was moved by Commissioner Ritchie, seconded by Commissioner Be Tora, to add the following condition: "All conditions herein shall be fulfilled prior to final recordation of this parcel map." ROLL CALL VOTE - Ayes: Lowrey, Cleveland,' Ritchie, Be Tora Noes: None Absent: Handy (excused) It was moved by Commissioner Lowrey, seconded by Chairman Cleveland, to add the following condition: "Landscaping and sprinkler system shall be installed to the satisfaction of the Planning Director." ROLL CALL VOTE - Ayes: Lowrey, Cleveland, Ritchie, Be Tora Noes: None Absent: Handy (excused) Staff was directed to rearrange the added conditions so that the condition adopted by Commissioner Ritchie's motion would be last. It was moved by Commissioner Ritchie, seconded by Commissioner Lowrey, to approve Parcel Map 13042, the Negative Declaration and the Findings, subject to the additional two conditions. CONDITIONAL USE PERMIT 79-140: Request by Hong Ill Kim for an extension for the continued sale of alcoholic beverages in conjunction with a conveniance market, known as "7-11", and located at 8807 Mission Drive. He requested that the Commission add Condition No. 7, which reads as follows: "Within ten (10) days of approval of this conditional use permit, the applicant shall submit to the Planning Department, a signed, notarized Affidavit of Agreement to all conditions set'forth herein; and shall agree to implement all conditions within ninety (90) days after approval of this conditional use permit." Proponent: Ms. Carol Morgan 562 Rancho Lindo Covina, California Ms. Morgan stated that she was representing the applicant. She inquired regarding the addition of Condition No. 7 and the Affidavit of Agreement. There was a discussion by the Commission. During this discussion, Condition No. 7 was added, Condition No. 1 was amended to grant approval of this conditional use permit for a period of three (3) years, and Condition No. 4 had the word "approved" added to it so that it reads as follows: "The trash receptacle on the west wall of 'the store shall be provided with an approved trash enclosure on all three sides. At present there is no gate screening it from the street." It was moved by Commissioner De Tora, seconded by Commissioner Ritchie, to grant an extension to Conditional Use Permit 79-140 for a period of three years, subject to the addition of Condition No. 7, and the amendments to Conditions 1 and 4. ROLL CALL VOTE - Ayes: Lowrey, Cleveland, Ritchie, De Tora Noes: None Absent: Handy (excused) 8. CONDITIONAL USE PERMIT 76: Request by Don Bosco Technical Institute for a one-day extension. The memorandum was presented by Mr. Sullivan. There was a short discussion by the Commission regarding the waiver of the fee for the beer license.- It was explained to the Commission that the Department of Alcoholic,Beverage Control would have to grant this request since the City did not have authority to grant liquor licenses. It was further explained that the City waived the filing fee for the conditional use permit. A letter was given to the Commission from Don Bosco Institute, indicating that the City would be named as an additional insured on their insurance policy to indemnify the City and hold harmless from liability arising out of the event. It was moved by Commissioner Lowrey, seconded by Commissioner De Tora, to grant a one-day extension to Conditional Use Permit 76. PC RESOLUTION 80-5: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 79-175. Mr. Dickey read the Resolution by title only. PC RESOLUTION 80-6: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 79-173. Mr. Dickey read the Resolution by title only. It was moved by Commissioner Ritchie, seconded by Commissioner Lowrey, to waive further reading and adopt Resolution 80-6. Cleveland asked if anyone present wished to address the commission. No one came forward. 12. MATTERS FROM CITY OFFICIALS AND STAFF A. The Commission was polled regarding their attendance at the West San Gabriel Valley Board of Realtor.'s Meeting, March 5, 1980. B. Commissioner Lowrey requested that the Commission consider a recommendation to the City Council that they amend the section of the Rosemead Municipal Code which requires installation of sidewalk- on properties that have undergone improvements valued at $2,000 or more. He stated his belief that $2,000 was too low a figure and would discourage property owners from improving their homes and property. After a short discussion regarding the manner~in which this recommendation should be made, it was decided by the Commission to postpone their decision until the City Attorney was present to advise them. Staff was directed to place this item on the next Agenda. C. Commissioner Ritchie made inquiry regarding Conditional Use Permit 80-179, Punchy's Bar, which was continued from the February 4, 1980 meeting. He was informed that the applicant had not submitted his application for a Variance. Commissioner Ritchie then requested that this item appear on the next Agenda, and that staff contact Mr. Ferrales and inform him that this matter is still pending. 13. ADJOURNMENT - There being no further business to come before the Commission, Chairman Cleveland adjourned the meeting at 8:30 p.m.
