CC - 09-27-88APPROVED MINUTES OF THE REGULAR MEETING CITY OF ROSEMEAD ROSEMEAD CITY COUNCIL DATE IZ_:.d'ef SEPTEMBER 27, 1988 BY The Regular Meeting of the Rosemead city council was called to order by Mayor Bruesch at 8:09 p.m. in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Councilman DeCocker. The Invocation was delivered by Pastor Garth Hyde of the Church of the Nazarene. ROLL CALL OF OFFICERS: Present: Councilmen DeCocker, Taylor, Mayor Pro Tem McDonald, and Mayor Bruesch Absent: Councilman Imperial (Recovering from the effects of a recent accident.) APPROVAL OF MINUTES: SEPTEMBER 13, 1988 - REGULAR MEETING Mayor Bruesch asked that "The Mayor directed staff to obtain information on various forms of senior housing, including rent subsidies for trailer owners, for presentation at a future study session." be added to Page #2, after the 8th paragraph. There being no objection, this was so ordered. MOTION BY MAYOR PRO TEM McDONALD, SECONDED BY COUNCILMAN TAYLOR that the Minutes of the Regular Meeting of September 13, 1988, be approved as amended. PRESENTATIONS A Proclamation naming the week of October 2, 1988 through October 8, 1988, as NATIONAL EMPLOY THE HANDICAPPED WEEK" was presented to Dr. Tucker, representing the West San Gabriel Valley Mayors' Committee for Employment of the Handicapped. Dr. Tucker expressed appreciation for the Council's support of this organization and its efforts on behalf of-handicapped citizens. A Proclamation was mailed naming September 29, 1988, as "HIRE THE OLDER WORKER DAY." A Resolution was presented to John Steelesmith, Area Manager for Southern California Edison Company, honoring his service to the City of Rosemead. Mr. Steelesmith thanked the Council and expressed his gratitude for this honor. I. ORAL COMMUNICATIONS FROM THE AUDIENCE A. Marie Hill, 3721 Rosemead Blvd., thanked the Council for the prompt service by the emergency services in the City. Mayor Bruesch read from a letter from the Safe Care class, thanking the Council for the free-swim program recently implemented. II. PUBLIC HEARINGS None CC 9-27-88 Page #1 III.LEGISLATIVE A. RESOLUTION NO. 88-47 - CLAIMS & DEMANDS The following resolution was presented to the council for adoption: RESOLUTION NO. 88-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $374,772.23 NUMBERED 01121-01143 AND 22636 THROUGH 22745 MOTION BY MAYOR PRO TEM McDONALD, SECONDED BY COUNCILMAN TAYLOR that Resolution No. 88-47 be adopted. RESOLUTION NO. 88-48 - APPLICATION FOR PEDESTRIAN FUNDS UNDER SB 821 The following resolution was presented to the Council for adoption: RESOLUTION NO. 88-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING THE APPLICATION FOR PEDESTRIAN FUNDS UNDER SB 821 AND APPROVING THE ADOPTION OF ITS PEDESTRIAN PLAN MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN DeCOCKER that Resolution no. 88-48 be adopted. ORDINANCE NO. 632 - ADOPTION OF LOS ANGELES COUNTY ANIMAL CARE AND CONTROL REGULATIONS RELATING TO DANGEROUS DOGS - INTRODUCE The following ordinance was presented to the council for introduction: ORDINANCE NO. 632 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ADOPTING LOS ANGELES COUNTY ANIMAL CONTROL AND CARE REGULATIONS RELATING TO DANGEROUS DOGS MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN DeCOCKER that ordinance No. 632 be introduced by title only, and reading in full be waived. It was explained that nuisances are already covered in the Rosemead Municipal Code. IV. CONSENT CALENDAR CC-A SPEED CONTROLS ON RAMONA BOULEVARD CC-B CLAIM AGAINST THE CITY - J.E.G. CONSTRUCTION COMPANY Recommendation: Rejection CC-C PARKING RESTRICTIONS ON DELTA AVENUE AT GARVEY AVENUE CC-D AUTHORIZATION TO ATTEND ANNUAL ROSEMEAD CHAMBER OF COMMERCE PLANNING CONFERENCE IN PALM SPRINGS - NOVEMBER 17-19, 1988 CC-E CLAIM AGAINST THE CITY - CECILO ORNELAS Recommendation: Rejection CC-F ENGINEERING PROPOSAL - 1988 CITY WIDE SPEED ZONE SURVEY CC-G APPROVAL OF PARCEL MAP 19584 - 7540 GARVEY AVENUE CC-H ACCEPT BIDS AND AWARD CONTRACT - STEVENS AVENUE (EMERSON PLACE/HELLMAN AVENUE) AND ARTSON STREET (LAFAYETTE STREET/ECKHART AVENUE) TO FECIT STRATA CONSTRUCTION IN THE AMOUNT OF $225,309.50 CC-I PROPOSED POOL FEES Councilman Taylor requested a memo on item CC-B, the claim by J.E.G. Construction, regarding the contract the City had with the construction company with respect to the hold-harmless agreement and explaining just where the liability lies. MOTION BY COUNCILMAN TAYLOR, SECONDED BY MAYOR PRO TEM MCDONALD that the foregoing items on the Consent Calendar be approved. DISCUSSION OF NEWSLETTER Robert Kress, City Attorney, reiterated the position that a newsletter could conform to the requirements of Proposition 73 if no names or pictures of elected officials are contained in the body. The names may be used only as part of a letterhead or in a return address type of situation. Councilman DeCocker expressed the opinion that the Council needs to decide if it wishes to continue with a newsletter that excludes names and pictures of its members. Mr. DeCocker suggested such a newsletter could be done in-house by members of staff rather than using a public relations firm. Councilman McDonald stated that the City of E1 Monte is continuing to publish its newsletter under the new guidelines established by the passage of Proposition 73 regarding regulations of mass mailings by public entities and added it appears to be successful as a source for community information. CC 9-27-88 Page #3 • • After further discussion it was MOVED BY MAYOR PRO TEM MCDONALD, SECONDED BY COUNCILMAN TAYLOR that the city continue with the newsletter currently contracted for until the budget year expires on June 30, 1989, at which time the Council may reconsider its position on the future of the newsletter. Mayor Bruesch asked about the development of the public access channel provided by the cable television company. Councilman Taylor requested that this subject be a.future agenda item including the figures on the number of homes with cable and the percentage of those homes that would be watching the access channel. Frank G. Tripepi, City Manager, stated that anyone wishing to use the channel merely needs to meet with Choice Television; arrange for use of the channel; and they do not need the Council's approval. Mayor Bruesch stated that he had been contacted by a group wishing to use the channel and staff was directed to inform this group of the procedures to acquire access to the community channel. B. JOINT MEETING/GARVEY SCHOOL BOARD AND ROSEMEAD CITY COUNCIL After some discussion, it was recommended that this meeting be postponed to a future date and staff was directed to arrange a "get-acquainted" meeting with the Council and the Garvey and Rosemead School District Boardmembers and both superintendents. VII. MATTERS FROM OFFICIALS A. MAYOR PRO TEM MCDONALD 1. Reported that the cities of studying a proposal that would a locate a Azusa and the 605 Freeway. If this comes increased usage of Rosemead Boulevard by from that facility. Mr. McDonald stated informed of the developments. B. Asked for a report on the next agenda of the properties that are being considered for the Chamber of Commerce building. C. MAYOR BRUESCH 1. Requested a study session to consider the consequences of possible increases in trash collection fees and the City's subsidy thereof. VIII.ORAL COMMUNICATIONS A. Leroy and Cleo Young, 7533 E. Garvey Avenue, asked for an explanation of the ownership and status of an alley and/or storm drain easement adjacent to their property. Councilman Taylor requested staff to research this situation and prepare a report in explanation of the problem. Mayor Bruesch asked to have this presented as a future agenda item. CC 9-27-88 Page #4 B. Bonnie Culbertson, representing the Rosemead Chamber of Commerce, reported that the Chamber Business Directory has been mailed to all the residents. Ms. Culbertson also stated that the Chamber is working with the Rosemead Independent to encourage increased advertising by the Rosemead merchants. Mayor Bruesch noted that Ms. Fabela is the newest member of the Garvey School District Board. C. Toni Fabela, 3055 N. Prospect Avenue, expressed her appreciation to the council for the quality of the improvements that were made to Prospect Avenue. Ms. Fabela also reported a problem with a large moving van parking on Prospect Avenue. D. Margaret Clark, 3109 N. Prospect Avenue, concurred with Ms. Fabela on the improvements made to Prospect Avenue. E. Juan Nunez, 2702 Del Mar Avenue, reported a slow response time by the Temple Station deputies when he called to report a noise violation. Mr. Nunez also reported that cans full of grease or oil were in back of 7808 Garvey Avenue. Frank G. Tripepi, City Manager, introduced Sergeant Gordon Carn, the new Team Leader with the Temple Station Sheriff's Department, who is replacing Sergeant Jim Whitten. Mr. Tripepi also announced that Katie Pitcher, Administrative Aide, will be leaving the City of Rosemead to accept a position with the City of Rancho Palos Verdes.
