THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission. of the City of Rosemead does hereby find and determine that an application was duly filed by Tomei Shogi.Company. Ltd requesting the establishment of a dog kennel on property located at: 9739 Abilene Street, Rosemead, California; and that a public hearing was duly scheduled for.NOVember 3, 1980,.at 7:30 p.m., in the Council Chambers of Rosemead City.Hall, 8838 Valley.. Boulevard, Rosemead, California; and that.notice of the time, date, place,. and purpose of the aforesaid hearing was duly given according to law; and that a'public hearing was duly con- ducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180, at. seq.., of the Ordinances of the City of Rosemead, justifyingthe granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with.the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class Nine Categorical Exemption under the provisions of CEQA. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Planning Commission hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. There shall be no operation of the kennel business until final recordation of Parcel Map 13319. 2. Applicants shall secure building permits for all construction work on the property. 3. Prior to opening of the business, the applicants are to obtain an approved Occupancy Permit from the City of Rosemead Building and Safety Department. 4. Due to the removal of the rear wall of the garage, the applicants shall either secure a building permit to establish its soundness or demolish it completely so as not to.interfere with any vehicle access to the kennel. 5. Applicants shall comply with all requirements of the Los Angeles County Animal Control Department relevent to obtaining licenses. 6. Property shall comply with Section 5401-5415 of the Rosemead Municipal Code which deals with the storage, collection, and disposal of. rubbish, trash, and debris. 7. Applicants shall construct a 6-foot block wall along the southerly and.easterly property lines, wherever the boundaries are contiguous with neighboring properties. 8. This conditional.use permit shall be a personal permit issued to Watanabe/TOmei Shogi Company, Ltd., and shall not be transferable and shall terminate upon assignment or cessation of the business by the Watanabes at the location described herein. 1 T PC Resolution 80-40 Page Two 9. Applicants shall sign a notarized Affidavit of Agreement to the above conditions within ten days of. approval of this conditional use permit and submit it to the Planning Department. Section 5. Thisaction shall become final and effective ten (10) days after this decision by-the Planning Commission unless.within such time a written appeal is filed with the City Clerk for..consideration by the Rosemead City Council as provided in the Zoning Ordinance. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that as application was duly filed by Fred Bonamici requesting a commercial conversion to create two-hundred (200) separate-fee freeholds of air space, (one-lot sub- division of property), located at 8635 East Valley Boulevard, Rosemead, California; or more specifically known as: Parcel 1, Parcel Map No. 10770, P.M.B. 102-80; and that a Public Hearing was duly set for December 15, 1980, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place and purpose of the aforesaid," hearing was duly given:according to law; and that a public hearing was duly con- . ducted at the aforementioned time and place. Section 2, The Planning Commission further finds that this subdivision request is in conformance with the Land Use Element of the General Plan, and; 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the proposed subdivision and improvements are con- sistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type.of development. 4. The site is suited for the proposed density of the development, 5. The design of the subdivision will not conflict with public ease- ments. 6. The design and proposed improvements of the subdivision will have no adversese_nvironmental effects on fish, wildlife or their habitat, or cause any public health problems. A Negative Declaration has been prepared in compliance with Rosemead Resolution 75-28, CEQA, and the Guidelines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in violation of existing requirements as prescribed by the California Regional Water Board. Section 3: NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Rosemead does approve the request for subdivision of that parcel of land described in Section 1, subject to the following conditions: 1, That the twenty-eight (28) conditions contained within Conditional Use Permit 77-121 be incorporated into the C,C, & R's. 2. That the "policy" statement of use (stamp-dated December 9, 1980) be included within the C,C,& R's. 3. That the following language shall be added to the C,C, & R's as conditions of the Parcel Map approval: (a) That the self-storage facility shall be limited in use to the expressed request of the property owner and conditions of approval as contained within the City of-Rosemead file Conditional Use Permit 77-121 or to such use that may be approved in the future by the City of Rosemead under provisions of authority at that time. Dickey, 0 6 PC RESOLUTION 80-49 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD, AN AMENDMENT TO THE LAND USE ELEMENT OF THE ROSEMEAD GENERAL PLAN FOR THAT AREA LOCATED AT 4020-4106 WALNUT GROVE AVENUE, ROSEMEAD, CALIFORNIA. (GENERAL PLAN AMENDMENT 80-1) THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS Section 1. All signs shall be in accordance with Section 9900-9913 of the Rosemead Municipal Code. 4. Stripe the parking area to the east of the market. 5. This conditional use permit is approved for a period of two years, at which time it may be reviewed for an extension without benefit of a public hearing. 6. -The=applicants shall sign a..notarized Affidavit of Agreement to the above conditions within ten (10) days of approval of this permit. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance.
