A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
GRANTING CONDITIONAL USE PERMIT 80-204 FOR THE SALE OF ALCOHOLIC
BEVERAGES IN CONJUNCTION WITH "HAPPY MARKET", LOCATED AT 8203
HELLMAN AVENUE, ROSEMEAD, CALIFORNIA,
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section.l. The Planning Commission does hereby find and determine that
an application was duly filed by Sin Chung Chu and Kim Wong requesting the sale
of alcoholic beverages for off-site consumption in conjunction with 'Happy Mar-
ket", located at:.
8203 Hellman Avenue, Rosemead, California;
and that a public hearing was duly scheduled for December 1, 1980, at 7:30 p.m.,
in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead,
California; and that notice of the time, date, place and purpose of the aforesaid
hearing was duly given; and that a public hearing was duly conducted at the afore-
mentioned time and place.
Section 2, The Planning Commission further finds and determines that
facts do exist as required by Section 9180, et. seq „ of the Ordinances of the
City of Rosemead, justifying the granting of a conditional use permit,
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan,
2. The project will not be detrimental to the surrounding properties,
3. The project is desirable to the public convenience.
4. On the basis of evaluation, this project has been determined to be
a Class Nine Categorical Exemption under the provisions ofCCEQA.
A Notice of Exemption was filed with the County Clerk,
Section 4. Based on the aforementioned findings, the Commission hereby
grants a conditional use permit with respect to the property described4.in Section 1
of this Resolution, subject to the following conditions:
1. Applicants shall apply for appropriate City of Rosemead Business
License and Occupancy Permit and satisfy all requirements therein.
2. The commercial trash bin shall be either enclosed per City:standards
or located so as not to be visible from the parking lot,
3. All trash shall be stored, and property maintained in accordance
with, Section 5401-5415 of the Rosemead Municipal Code,
,:4, All signs shall be in accordance with Section 9900-9913 of the
Rosemead Municipal Code.
5. Remove weeds along south side of building facing Hellman Avenue,
surrounding trash receptacles and wherever else needed.
6. This conditional use permit is approved for a period of two years,
at which time it may be reviewed for an extension without benefit
of a public hearing,
7. The applicants shall sign a notarized Affidavit of Agreement to the
above conditions within ten (10) days of approval of this permit.
8. The parking lot shall be clean and free of debris, in particular
around the telephone booth and fencing bordering property on the
north and west, and an effort should be made to clean the debris
on both sides of the fence, where possible.

Section 5, This action shall become final and effective ten (10) days
after this decision by the Planning Commission unless within such time a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council,
as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of the Resolution
and shall transmit copies of same to the applicant and the Rosemead City Clerk.
