PC - 1980-43 - Granting Conditional Use Permit 80-203 "Alba's Market", Located At 3200 Del Mar AvenuePC RESOLUTION 80-43 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 80-203 FOR THE SALE OF ALCOHOLIC BEVERAGES IN CONJUNCTION WITH "ALBA'S MARKET", LOCATED AT 3200 DEL MAR AVENUE, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1, The Planning Commission does hereby find and determine that an application was duly filed by Angel and Lavinia Betancourt, requesting the sale of alcoholic beverages for off-site consumption in conjunction with "Alba's Market", located at: 3200 Del Mar Avenue, Rosemead, California; and that a public hearing was duly scheduled for December 1, 1980, at 7:30 p.m. in the Council Chambers of Rosemead,City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was duly given; and that a public hearing was duly conducted at the afore- mentioned time and place. Section 2.I The Planning Commission further finds and determines that facts do exist as required by Section 9180, et. seq., of the ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class Nine Categorical Exemption under the provisions of CEQA. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Applicants shall apply for a City of Rosemead Business License and Occupancy Permit and satisfy all requirements therein. 2. All trash shall be stored, and property maintained in accordance with sections 5401-5415 of the Rosemead Municipal Code. 3. All signs shall be in accordance with Section 9900-9913 of the Rosemead Municipal Code, 4. Storage area to the rear shall be cleared of any debris and main- tained in an orderly fashion at all times. 5. This conditional use permit is approved for a period of two years, at which`_time it may be reviewed for an extension without benefit of a public hearing. 6. The applicants shall sign a notarized Affidavit of Agreement to the above conditions within ten (10) days of approval of this permit. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the zoning Ordinance. Section 6. The secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. ! 0 5 PC Resolution 80-43 Page Two ADOPTED this 15th day of December , 1980, G.H.
