PC RESOLUTION 80-39
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
GRANTING CONDITIONAL USE PERMIT 80-200.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was filed by Mars Oil Company to request
compliance with Section 9134 of the Rosemead Municipal Code, Standards for Auto-
mobile Service Stations, for an existing service station located at:
3366 San Gabriel Boulevard, Rosemead, California;
and that a Public Hearing was duly set for October 20, 1980 at 7:30 p.m., in the
Council Chambers of RosemeadCity Hall, 8838 Valley Boulevard, Rosemead, California;
and that notice of the date, time,..place and purpose was given according to law;
and that a public hearing was duly conducted at the aforementioned time and place.
Section 2. The Planning Commission further finds and determines that
facts do.exist as required by Section 9180, et. seq., of the Ordinances of the
City of Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable for the public convenience.
4. On the basis of.evaluation, -this project. has been determined to be
a Class. Nine Categorical Exemption under the provisions of CEQA. A
Notice of Exemption was filed with the County Clerk.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a conditional use permit with respect to the property described in Section 1
of this Resolution, subject to the following conditions:
1. The-paved area adjacent to both pump islands, and the paved area
around the underground storage tanks shall be repaired subsequent
to completion of the vapor recovery system, within ninety (90) days
of approval of this conditional use permit.
2. All on-site signsshall`be i_n`accordance with Section 9902-99m,'of
:the Rosemead-Municipal-Code. _
3.• A trash enclosure shall be provided for the trash bin in accordance
with City specifications.
4. All grass areas to the east shall be cleared of rubbish and debris,
irrigated and landscaped accordingly. A landscape plan shall be
submitted to the Planning Department for review and approval.
5. Remove all graffiti from the service station office, restrooms, and
all associated structures.
6. The applicant shall provide on-site paving and resurfacing of
existing paving to match the reconstruction.of the driveway approach
along Hellman Avenue, and is to provide a plan for review and
approval by the Director of Planning within 30 days of the conditional
use permit approval.
7. The entire property shall be maintained in accordance with Sections
5104-5415 of the Rosemead Municipal Code.
8. The applicants shall sign a notarized Affidavit of Agreement to the
above.:conditions within ten days'from the date of approval,of this
conditional use permit.

Section 5. This action shall become final and. effective ten (10) days
after this decisionby the Planning Commission unless within such time a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council
as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of the Resolution
and shall transmit copies of same to the applicant and the Rosemead City Clerk.
