A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD,
RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CONDITIONAL
APPROVAL OF TENTATIVE TRACT 39996. (A FOURTEEN-UNIT, ONE-LOT SUB-
DIVISION),
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The-Planning Commission does hereby find and determine that
an application was duly filed by Nina Kuo requesting a fourteen-unit, one-lot sub-
division of property located at 8902-8910 Marshall Street, Rosemead, California;
or more specifically known as:
Portion. of Lot 1, Tract No. 2277, Map Book 31, Page 56
and that a Public Hearing was duly set for October 20, 1980, at 7:30 p.m., in the
Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California,
and that notice of the time, date, place and purpose of the aforesaid hearing was
given according-"to law; and that a public hearing was duly conducted at the afore-
mentioned time and place.
Section 2. The Planning Commission further finds that this subdivision
request is in conformance with the.Land Use Element of the General Plan, and;
1. The proposed map is consistent with the applicable General Plan of
the City of Rosemead.. There is no specific plan.
2. The design of the proposed subdivision and improvements are con-
sistent with the applicable General Plan. There is no specific
plan.
3. The site is physically suitable for the type of development.
4. The site is suited for the proposed density of the development.
5. The design of the subdivision will not conflict with public easements.
6. The design and proposed improvements of the subdivision will have no
adverse environmental effects on fish, wildlife or their habitat, or
cause any public health problems.. A Negative Declaration has been
prepared in compliance with Rosemead Resolution 75-28, CEQA, and the
Guidelines for the implementation of CEQA.
7. Discharge of wastes from the proposed subdivision will not result in
violation of existing requirements as prescribed by the California
Regional Water Board.
Section 3. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission
of the City of Rosemead recommends that the City Council approve, the request for
subdivision of that parcel of land described hereinabove, subject to the following
conditions:
1. Developers shall comply with all conditions as set forth by the Sub-
division Committee Department of Regional Planning in their report
dated April 30, 1980, prior to recordation of the tract map, with
the exception of:
1(a). No. 5, 6, 8, 11, and 12 under Planning which,.if necessary,
conducted at the City planning "level "at the time of building
plan check.
1(b). That all conditions under City Engineer - Environmental
Development Divisions - Sewers shall be applicable, with the
added requirement that,
"Existing sewer capacities shall be determined prior to con-
sideration by the City Council, and that any sewer improvements
deemed necessary to support the project development shall be .
installed or bonded for prior to recordation of the final map
or as may be determined by the Planning Department in concur=- crance with the City Engineer".

1(c). That all conditions under.City Engineer - Water Ordinance
unit shall be applicable, with.the added condition that,
"The developer shall provide a statement from the water pur-
veyor to the Planning Department that adequate fire flow
exist to support the project prior to consideration by the
City Council."
2. A copy of the Conditions, Covenants and Restrictions, (C,C, & R's)
shall be submitted to the city staff, and City Attorney for their
review,.recommendation, and approval to insure the continuous main-
tenance and enforcebility of the C,C, & R's.
.3. Parking controls shall be included in the C,C,& R's for.this develop-
ment according to Section 21107 of the California Vehicle Code.
C,C, & R'S-shall also prohibit the parking of recreational vehicles
within the development, except for loading and unloading.
4. Development of the subject property shall be in compliance with the
approved site plan.
5. Interior private streets shall be constructed with a minimum of 4"
AC over 6" base,. or 6" of concrete.- - -
6. Trash containers shall be constructed according to the standards set
forth by the Planning Department.
7. Any excessive driveways on Marshall Street shall be removed and re-
placed with full-size curbs and gutters.
8. Driveway entrance to this project shall be per Rosemead City standards.
9. All guest parking shall be striped and designated as such.
10. Developers shall provide street trees along Marshall Street in
accordance with the standards of the Rosemead Parks Department.
11. That some form of visual relief, (stamped concrete, textured or
colored material),,be provided at various locations along the central
driveway--to meet the approval of the Planning Department.
12. All utilities shall. be placed underground as per Rosemead City
standards.
13. Tha* a professionally prepared landscape plan and tree preservation
plan, (registered landscape architect), shall be provided for review
and approval by the Planning Department, said plan shall incorporate
a mature landscape theme along the street frontage and central drive-
way corridor.
Section 4. The secretary shall certify to the adoption of the Resolution
and transmit copies thereof to the City Clerk of the City of Rosemead.
