A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
GRANTING CONDITIONAL USE PERMIT 80-198.
THE PLANNING COMMISSION.OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
.Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was filed by Carlos E. Rodriguez to request
the sale of alcoholic beverages for off-site consumption in conjunction with an
existing market/delicatessen, known as "Mary's Market", and located at:
2428 San Gabriel Boulevard, Rosemead, California;
and that a public hearing was duly set for October 20, 1980 at 7:30 p.m., in the
Council Chambers of Rosemead City Hall, 8838 Valley Boulevard,.Rosemead, California;
and that notice of the time, date, place, and purpose of the aforesaid hearing was
duly given; and that a public hearing was duly conducted at the aforementioned time
and place.
Section 2.:. The Planning Commission further finds and determines that
facts do exist as required by, Section 9180, et. seq., of the Ordinances of the City
of Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable for the public convenience.
4. On the basis of evaluation, this project has been determined to be
a Class 9 Categorical Exemption under the provisions of CEQA. A
Notice of Exemption was filed with the County Clerk.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a Conditional Use Permit with respect to the property described in Section 1
of this Resolution, subject to the following conditions:
1. Applicant shall apply for appropriate City of Rosemead Business
License and Occupancy Permit.
2. Maintain the property in.a clean and litter free state in accordance
with Section 5404-5415 of the Rosemead Municipal Code.
3. This conditional use permit shall be approved for a period of two
years at which time it may be reviewed for renewal by the Planning
Commission without a public hearing.
4... This permit is not transferable to future purchasers or occupants.
5. Within ten (10) days of approval, the applicant shall submit a
notarized Affidavit of Agreement to the above conditions.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission unless within such time a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council,
as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of the Resolution
and shall transmit copies of same to the applicant and the Rosemead City Clerk.
