A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
GRANTING CONDITIONAL-USE PERMIT 80-197.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was filed by Carl D. Lyse to request the
sale of alcoholic beverages for on-site consumption in conjunction with an existing
bar, known as "Patrick's",'and located at:
7813 East Garvey Avenue, Rosemead, California;
and that a public hearing was duly set for October 20, 1980 at 7:30 p.m., in the
Council Chambers of.ROSemead_City Hall, 8838 Valley Boulevard, Rosemead, California;
and that notice of the time, date, place, and-purpose, of the aforesaid hearing was
,,duly .given;. and that a public hearing was duly conducted at the aforementioned time
and place.
Section 2. The Planning Commission. further finds and determines that
facts do exist as required by Section 9180, et. seq., of the Ordinances.of.the City
of Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan. '
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable for the public convenience.
4. On the basis of evaluation, this project has been determined to be
a Class 9 Categorical Exemption under the provisions of CEQA. A
Notice of Exemption was filed with the County Clerk.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a Conditional Use Permit with respect to the property described in Section 1
of this Resolution, subject to the following conditions:
1. Secure all appropriate City licenses and occupancy Permits.
2. Maintain the property in accordance with Sections 5404-5415 of the
Rosemead Municipal Code relative to trash, litter and debris.
3. This permit shall be approved for a period of two years at which
time it may be reviewed for renewal without a public hearing.
4. This permit is not transferable to future owners or occupants.
5. Applicant shall sign a notarized Affidavit of Agreement, agreeing
to the above conditions within ten days of approval.
6. The applicant shall install an automatic door closing device.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission unless within such time a written
appeal is.filed with-the City Clerk for consideration by the Rosemead City Council,
as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of the Resolution
and shall transmit copies of same to the applicant and the Rosemead City Clerk.
