F/ PC RESOLUTION 80-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CONDITIONAL APPROVAL OF TENTATIVE TRACT NO. 41087. (A SIX-UNIT, ONE-LOT SUB- DIVISION.) THE PLANNING COMMISSION OF THE CITY OF. ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: .,,:Section 1. The Planning Commission does hereby find and determine that an application was duly filed by J.H. Hedrick and Company requesting a six-unit, one-lot subdivision of property located at 3300-3316 Muscatel Avenue, Rosemead, California; or more specifically known as: Lot 117, Tract No. 3706, in the City of Rosemead, as per map recorded in Book 40, Page 39 of Maps, in the Office of the Recorder of Los Angeles County; and that a Public Hearing was duly set for October 6, 1980, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place and purpose of the aforesaid hearing was given according to law; and that a public hearing was duly conducted at the afore- mentioned time and place. Section 2. The Planning Commission further finds that this subdivision request is in conformance with the Land Use Element of the General Plan, and; 1. The proposed map in consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the proposed subdivision and improvements are con- sistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type of development. 4. The site is suited for the proposed density of the development. 5. The design of the subdivision will not conflict with public easements. 6. The design and proposed improvements of the subdivision will have no adverse environmental effects on fish, wildlife or their habitat, or cause any public-health problems. A Negative Declaration has been prepared in compliance with Rosemead Resolution 75-28, CEQA, and the Guidelines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in violation of existing requirements as prescribed by the California Regional Water Board. Section..3. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Rosemead recommends that the City Council approve the request for subdivision of that parcel of land described hereinabove, subject to the following conditions: 1. That the applicant shall comply with all the conditions as set forth in the County Engineer's Report (dated July 29, 1980) and to include the requirements as set forth by the Fire Department. 2. That the private street shall be constructed,to Los Angeles County Road Department standards- and shall include curb and gutter. 3. That a covenent shall be prepared by the applicant for review and approval of the City Attorney, assuring that the private street shall be continually maintained and that cost associated with such main- tenance shall be equally shared by all future property owners within the division, and to include the following provisions: a. .The-City_shall have the right to cause such repair to be accomp- lished, and to place liens on the involved properties, if in the estimation of the City Engineer, the subject street has reached a state of disrepair which renders it a hazard, unsightly, or PC Resolution 80-34 Page Two a public nuisance; and that the property owners involved have failed to act within a reasonable period, (thirty days), after notification. 4. All utilities shall. be place underground as per Rosemead City standards. Section 4. The secretary shall certify to the adoption of the Resolution and transmit copies thereof to the City Clerk:of the City of Rosemead. ADOPTED this 20th day of October , 1980. ZaML Z' G.H.
