PC - 1980-30 - Granting Conditional Use Permit 80-194Ca~nc~c~- • • j PC RESOLUTION 80-30 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 80-194. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was filed by Carlos E. Martinez for the sale of alcoholic beverages for on-site consumption; in conjunction with aii existing- bar,-known. as "Vickie's", and located at: 8715 Garvey Avenue, Rosemead, California; and that a public hearing was duly set for Septebmer 2, 1980, at 7:30 p.m, in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California and notice of the time, date, place and purpose of the aforesaid hearing was duly given, and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180, et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class 9 Categorical Exemption under the provisions of CEQA. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. This conditional use permit is approved for a period of two years, at which time it may be reviewed by the Commission for an extension without benefit of a public hearing. 2. Applicants shall apply for a City of Rosemead Business License and Occupancy Permit. 3. The property shall be maintained in a clean and orderly fashion at all times. 4. This permit is not transferable to future purchasers or occupants. 5. The existing sign shall not be made to flash or blink per Section 9902. B,3 of the Rosemead Municipal Code. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by+the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 15th day of_ September , 1980. G.H.
