PC - 1980-27 - Conditional Approval Of Tentative Tract No. 40288PC RESOLUTION 80-27 0 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSMEAD, CONDITIONAL APPROVAL OF TENTATIVE TRACT NO. 40288 (A 16-UNIT ONE-LOT SUBDIVISION). .THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD,DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly. filed by Robert Otis requesting a 16-unit, one-lot sub- division of property located at 8815 Mission Drive,.Rosemead, California; or more specifically known as: The Southerly 120 feet of Lot 41,of Tract No: 3706, in the City of Rosemead, as per map recorded in Book 40, Page 39 of Maps in the office of the Recorder of said County; and that a public. hearing was duly set for August 18, 1980, at 7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place, and purpose of the aforesaid hearing was given according to law; and that a public hearing was duly conducted at the afore- mentioned time and place. Section 2. The Planning Commission further finds that this subdivision request is in conformance with the Land Use Element of the General Plan, and;.:.:.. 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There-'.is no specific plan. 2. The design of the proposed subdivision and improvements are con- .sistent with the applicable General Plan.. There is no specific plan. 3. The site is physically suitable for the type of development. 4. The site is suited for the proposed density of the development. 5. The design of the subdivision will not conflict with public easements. 6. The design and proposed improvements of the subdivision will have no adverse environmental effects on fish, wildlife or their habitat, or cause any public health problems. A Negative Declaration has been prepared in compliance with Rosemead Resolution 75-28, CEQA, and the Guidelines for the implementation of CEQA. 7. Discharge of wastes from the propsed subdivision will not result in violation of existing requirements as prescribed by the California Regional Water Board. Section 3. NOW THEREFORE BE IT RESOLVED, that the Planning Commission of the City of Rosemead recommends that the City Council approve the request for sub- division of that parcel of land described hereinabove, subject to the following conditions: 1. Those thirteen (13) conditions as set forth within.the Planning Staff Report dated August 18, 1980, subject to the following amendments: a. That Condition 12 be amended to include the provisions for a tree preservation plan; and, b. That,a Condition No. 14 be added requiring all utilities to be underground. Section 4. The secretary shall certify to the adoption of the Resolution and transmit copies thereof to the City Clerk of the City of Rosemead. ADOPTED this 2nd day of September 1980, G.
