PC - 1980-26 - Zone Change 80-1198815 Mission Drivee • PC RESOLUTION 80-26 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD, A CHANGE OF ZONE FROM C-1, NEIGHBORHOOD COMMERCIAL TO R-3, MULTIPLE RESIDENTIAL, FOR PROPERTY LOCATED AT 8815 MISSION DRIVE, ROSEMEAD, CALIFORNIA. .(ZONE CHANGE 80-119) THE PLANNING COMMISSION OF THE CITY OF.ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Robert Otis.requesting.a change of zone, from C-1, Neighborhood Commercial to R-3, Multiple Residential for property located at 8815 Mission Drive, Rosemead, California; or more specifically known as: The Southerly 120 feet of Lot 41 of Tract No. 3706, in the City of Rosemead, as per map recorded in Book 40, Page 39 of Maps in the office of the Recorder of said County; and that a public hearing was duly set for August 18, 1980, at 7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard,. Rosemead, California, and that notice of time, date, place, and purpose of the aforesaid hearing was given according to law; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds that this zone change is in conformance with the Land Use Element of the General Plan. Section 3.. NOW THEREFORE BE IT RESOLVED,. that the Planning Commission of the City of Rosemead recommends that the City Council change the zone of that parcel described hereinabove. Section 4. The secretary shall certify to the adoption of the Resolution and transmit copies thereof to the City Clerk of the City of Rosemead. ADOPTED this 2nd day of September , 1980. G.H. Dick ecretary t 0 PC RESOLUTION 80-25 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DENYING A VARIANCE.F.OR PROPERTY LOCATED AT 8220 AND 8216 DOROTHY STREET IN THE CITY OF ROSEMEAD. (ZONE VARIANCE CASE NO. 80-91) THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an..application..wasfiled_by David Crawford to request a Zone Variance to Section~9105.6, Minimum Lot Size Requirements for R-2 Zones for property located at: 8220 and 8216 Dorothy Street, Rosemead, California; and that a public hearing was duly set for July 7,.1980, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place and purpose of the afore- said hearing was duly given; and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission furtherfinds=that the facts do not exist as required by Section 9171, et. seq., of the Rosemead Zoning Code-.justifying the granting of a zone variance. Section 3. The Planning Commission further finds: 1. That the granting of the application for variance would constitute a granting of a special privilege inconsistent with the limitations upon other properties in. the vicinity and zone in which the property is situated. 2. That the granting of such variance will be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which.the property is located. _ 3. There are no special circumstances applicable to subject property including size, shape, topography, location or surroundings which would justify a variance from the strict application of the zoning ordinance. 4. That the granting of such application would adversely effect the comprehensive General Plan. Section 3. Based on the aforementioned findings., the Planning Commission hereby denies the zone variance with respect to the property described in Section 1. . Section 4 This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for. consideration by the City Council as set forth in the Zoning Ordinance.
