A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
GRANTING CONDITIONAL USE PERMIT 80-184 AND ZONE VARIANCE 80-88.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The Planning Commission of the City of Rosemead does
hereby find and determine that applications were filed by Atlantic' Richfield
Company to request compliance with Section 9184, et.-seq., of the Rosemead
Municipal Code, standards for automobile service stations; and a zone variance
to the minimum lot size requirements and setback requirements for a service
station located at:
8204 Garvey Avenue, Rosemead, California;
and that a public hearing for both requests was duly set for July 7. 1980, at
7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard,
Rosemead, California, and that notice of the time, place and purpose of the
aforesaid hearing was duly given, and that a hearing was duly conducted at the
aforementioned time and place.
Section 2. The Planning Commission further finds and determines that
facts do exist as required by Section 9180. et. seg.. of the ordinances of the
City of Rosemead justifying the granting of a conditional use permit and a zone
variance.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not.be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
4. Approval of the variancey as submitted, will not constitute the
granting of a special privilege being consistent with the
limitations on the other properties in the vicinity.
5. Approval of the variance will not prove detrimental to the
adjacent properties of the surrounding neighborhood.
6. There are exceptional circumstances applicable to the property
that do not generally apply to other properties in the C-3 zone.
7. Approval of this variance will not be contrary to the objectives
of the General Plan.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a conditional use permit and a zone variance with respect to the property
described in Section 1 of this Resolution, subject to the following conditions:
1. Trash container shall.be screened by.,a..minimum six-foot high
masonary alled enclosure with adequate access.
5 2. All automobile repair shall be conducted within the enclosed
service bays.
3. Remove graffiti from the southerly and easterly walls of the
structure. An attempt shall be made to keep the side free of
graffiti at all times.
4. Outside entrances to restrooms shall be screened by decorative
screening, minimum six feet high, with bottom of screen opened
12 to 18 inches.
5. All raised planters and planting areas shall be furnished with
landscaping and maintained at all times.
6. The available parking shall be striped.

7. No portable A-frame signs shall be permitted for advertising
or gas price listing.
8.- within ten (10) days of approval of the Conditional Use Permit,
the applicant shall submit a notarized Affidavit of Agreement
to all conditions. The applicant shall agree to implement all
conditions within 90 days. Failure to do so may result in the
revocation of the conditional use permit,nnd variance.
9. This conditional use permit is approved for a.- period of three (3)
years or until transfer should take place, at which time the new
owner would be required to renew this permit.
Section 5. This action shall become final and effective ten (10) days
afterthis decision by the Planning Commission unless within such time a written
appeal is filed with the City Clerk for consideration by the Rosemead City
Council, as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of the
Resolution and shall transmit copies of same to the applicant and the Rosemead
City Clerk. '
