PC - 1980-23 - Granting Conditional Use Permit 80-190• • PC RESOLUTION 80-23 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 80-190. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was filed by Danny and Tonya Duplechan to request the storage of paper in conjunction with a recycling business, known as ."Danny's Paper Palace", and located at: 9010 East Garvey Avenue, Rosemead, California; and that a public hearing was duly set for July 7, 1980 at 7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place and purpose of the aforesaid hearing was duly given, and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180, et. seq., of the ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be-detrimental to the surrounding properties. 3. The project is desirable for the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class 9 Categorical Exemption under the provisions of CEQA. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. All storage of recycleable products shall be within some form of screened enclosure that meets the approval of the Director of Planning and the Los Angeles County Fire Department. At no time shall recycleable products be stored outside of the enclosure. 2. All recycleable products shall be stored in accordance with the County of Los Angeles Fire Department regulations. 3. Applicant shall apply for and meet all requirements of a.City of Rosemead Occupancy Permit. 4. The property shall be maintained in a neat and orderly fashion, and at all times remain free of litter and debris. 5. This conditional use permit is approved for a period of one (1) year, at which time it-may be reviewed by the Planning Commission without a public hearing. This conditional use permit is not trans- ferable to future owners and/or occupants. 6. Within ten (10) days of approval of this conditional use permit, the applicant shall submit to the Planning Department a notarized Affidavit of Agreement to all conditions. Failure to comply with all conditions may result in the revocation of this conditional use permit. 7. The applicant shall appear before the Planning Commission prior to any change in the operation of the business or the type of materials being stored on the premises. 8. Failure to comply with County of Los Angeles Fire Department regulations as related to the storage of materials will result in `th"e'""revocation of this conditional use permit. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of the Resolution and shall':trensmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 21stday of July , 1980. .
