PC - 1980-22 - Granting Conditional Use Permit 80-186PC RESOLUTION-80-22 S A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 80-186. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was filed by Arcadio B.'Hernandez to request the sale of alcoholic beverages for on-site consumption in con- junction with an existing bar, known as the "Wagon Wheel", and located at: 3300 San Gabriel Boulevard, Rosemead, California; and that a public hearing was duly set for June 16, 1980, at 7:30 p.m, in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard,..Rosemead, California, and that notice of the time,.place, date, and purpose of the aforesaid hearing was duly given, and that a hearing.was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180, et. seq., of the Ordinances of the City of Rosmead, justifying the granting of a conditional use.permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and:cbjectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class 9 Categorical Exemption under the provisions of CEQA. A Notice of Exemption.was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Parking areas on. site and off site shall be maintained in a clean and litter-free state on a regular basis. 2. The applicant. shall apply for all appropriate City business licenses and Occupancy permits. 3. The doors are to remain closed during hours of operation. 4. This permit is approved for a period of six (6) months at which time the applicant may apply for renewal by the Planning Commission with a.public:hearing. This permit is not transferable to future owners or occupants. 5. within ten days after approval,. the applicant shall submit a notarized Affidavit of Agreement with these conditions with the Planning Department. 6. The parking lot to the rear of the property shall be restriped. 7. The existing light system shall be made operable. 8. The front door shall be repaired to the satisfaction of the Planning Director. Section 5. This action shall become.final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the zoning ordinance.'
