PC - 1980-21 - Granting Conditional Use Permit 80-188PC RESOLUTION 80-21 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 80-188. THE PLANNING COMMISSION OF THE CITY. OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was filed by Kyong Sock Ham to request the sale of alcoholic beverages for off-site consumption in conjunction with an existing liquor store, known an "Doug's Liquor", and located at: 8817 Valley Boulevard, Rosemead, California; and that a publichearing was duly set for June 2, 1980, at 7:30 p.m.,in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, place, date, and purpose of the afore- said hearing was duly given, and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further findsand determines that facts do exist as required by Section. 9180, et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. 4. On the basis of evaluation, this'project has been determined to be a Class 9 Categorical Exemption under the provisions of CEQA. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional-use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Apply for City of Rosemead Business License and Occuparx:g Permit. 2. Comply with the requirements of the Building/Fire Departments. 3. Supply trash containers and maintain the property in a clean and litter-free state. 4. This conditional use permit is approved for a two-year period, at which time it may be reviewed for renewal by the Planning Commission without a public hearing. This.permit is. not transferable to future purchasers or occupants. 5. within ten (10) days after approval, the applicant shall submit a notarized Affidavit of Agreement to these conditions with the Planning Department. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal. is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk.
