PC - 1980-20 - Granting Conditonal Use Permit 80-186PC RESOLUTION 80-20 .A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 80-186. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was filed by Alicia Alvarez to request the sale of beer with meals for on-site consumption, in conjunction with an existing restaurant, known as "Casa Carlos", and located at: 9544 Valley Boulevard, Rosemead, California; and that a public hearing was duly set for may 5, 1980, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, place, date, and purpose of the aforesaid hearing was duly given, and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180, et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class 9 Categorical E-emption under the provisions of CEQA. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. This Conditional Use Permit is approved for a period of two (2) years or until such time as a transfer of ownership should take place; or there is a change in the use of the business. It may be reviewed by the Planning Commission for renewal without a public hearing. 2. Maintain the property and parking area in a clean and litter-free state at all times. 3. Within the (10) days after approval of this conditional use permit, the applicant shall submit to the Planning Department a signed; notarized Affidavit of Agreement to all conditions. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zpning Ordinance. Section 6. The secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. ADOPTED this 19th day of Mau 1980. G.H.
