PC - 1980-18 - Granting Conditional Use Permit 79-178PC RESOLUTION 80-18 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 79-178. , THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was filed by Texaco, Inc. to request compliance with Section 9184, et. seq., of the Rosemead Municipal Code, Standards for Automobile Service Stations, for a service station located at: 3606 North Rosemead Boulevard, Rosemead, California; and that a public hearing for both requests was duly set for April 21, 1980, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 valley Boulevard, Rosemead, California, and. that notice of the time, date, place and purposed of the aforesaid hearing was -duly. given according to law; and that a public hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts to exist as required by Section 9180, et. seq., of the Ordinances of the City of Rosemead justifying the granting of a conditional use permit., Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. - 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. Based on the aforementioned findings,, the CommissioH hereby grants a conditional use permit with respect to the property describe in Section 1 of this Resolution, subject to the following conditions: 1. The applicant shall construct a trash bin enclosure in accordance with City specifications and maintain the property in a clean and litter-free state. 2. Remove the graffiti from the station and the block wall at the rear of the property. 3. Move parked cards from the front of the property to the rear of the property. There shall be no storage of inoperable vehicles on the site. 4. Repair the block wall at the rear of the property. 5. Remove the refuse and debris stored behind the station. 6. No portable, A-frame signs shall be permitted on the site. 7. The attendent booth shall be painted. 8. within ten (10) days of approval of this conditional use permit, the applicant shall submit a notarized Affidavit of Agreement to all conditions. The applicant shall agree to implement the conditions within ninety (90) days. Failure to do so may result in the revocation of this conditional use permit. 9. This conditional use permit is not transferable and is approved for a period of three (3) years or until transfer should take .place, at which time the new owner would be required to renew this permit. PC Resolution 80-18 Page Two • Section 5., This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. ADOPTED this 5th day of Maw , 1980. G.H.
