PC - 1980-10 - Granting Conditional Use Permit 79-172 And Zone Variance 80-89PC RESOLUTION 80-10 0 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 79-172 AND ZONE VARIANCE 80-89. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that applications were filed by Shell'Oil.Company to request compliance with Section 9184, et. seq., of the Rosemead Municipal Code, standards for automobile service stations; and a zone variance to the minimum lot size requirement for service stations, for a service station located at: 3603 North Rosemead Boulevard, Rosemead, California; and that a public hearing for both requests was duly set for March 17, 1980, at 7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 valley Boulevard, Rosemead, California, and that notice of the time, place and purpose of the aforesaid hearing was duly given, and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180, et. seq., of the Ordinances of the City of Rosemead justifying the granting of a conditional use permit and a zone variance. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. Approval of the variance, as submitted, will not constitute the granting of a special privilege being consistent with the limitations on the other properties in the vicinity. 5. Approval of the variance will not prove detrimental to the adjacent properties of the surrounding neighborhood. 6. There are exceptional circumstances applicable to the property that do not generally apply to other properties in the C-3 zone. 7. Approval of this variance will not be contrary to the objectives of the General Plan. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit and a zone variance with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Trash container to remain within the trash enclosure and the property shall be maintained in a clean and litter-free state. 2. All automobile repair shall be conducted within the enclosed service bays. 3. Remove graffiti from the block wall.on the west property line. 4. No portable, A-frame signs shall be permitted for advertising or gas price listing. 5. within ten (10) days after approval of. the conditional use permit, the applicant shall submit a notarized Affidavit of Agreement to all conditions. The applicant shall agree to implement all con- ditions within ninety (90) days. Failure to do so may result in the revocation of this conditional use permit. PC Resolution 80-10 Page Two • 6. This conditional use permit is not transferable and is approved for a period of three (3) years or until transfer should take place, at which time the new owner would be required to renew this permit. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. ADOPTED this 7th day of April , 1980. G.H.
