A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
GRANTING CONDITIONAL USE PERMIT 79-177.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was filed by Texaco, Inc. to request com-
pliance with Section 9184, et. seq., of the Rosemead Municipal Code, standards
for automobile service stations, for a service station located at:
4441 North Rosemead Boulevard, Rosemead., California;
and that a public hearing was duly set for March 17, 1980, at 7:30 p.m., in the
Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California,
and that notice of the time, place and purpose of the aforesaid hearing was duly
given, and that a hearing was duly held at the aforementioned time and place.
Section 2. The Planning Commission further finds and determines that
facts do exist as required by Section 9180, et. seq., of the Ordinances of the
City of Rosemead justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a conditional use permit with respect to the property described in Section 1
of this Resolution, subject to the following conditions:
1. Trash enclosures for the two (2) trash bins should be installed.
2. The cluttered area, (consisting of old signs, boxes, etc.), adjacent
to the service garage shall be cleaned up and maintained in an
organized and well-kept manner.
3. The site shall be maintained in a clean and litter-free state.
4. All auto repair is to be conducted within theenclosed service bays.
5. No portable, A-frame signs shall be permitted for advertising or
gas-price.listing.
6. Within ten (10) days of approval of this conditional use permit
the applicant shall submit anotarized Affidavit of Agreement to
all conditions. The applicant shall agree to implement the con-
ditions within ninety (90) days. Failure to do so may result in
the revocation of this conditional use permit.
7. This conditional use permit is not transferable and is approved
for a period of three (3) years or until transfer should take
place, at which time the new owner would be required to renew this
permit.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission unless within such time a written
appeal is filed with the City Clerk for consideration by the Rosemead City
Council, as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of the Resolution
and shall transmit copies of same to the applicant and the Rosemead City Clerk.
