A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING
CONDITIONAL USE PERMIT 81-237 ALLOWING THE SALE OF ALCOHOLIC BEVERAGES
ON PROPERTY LOCATED AT 2428 NORTH SAN GABRIEL BOULEVARD, ROSEMEAD, CALIFORNIA.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was duly filed by Gerardo H. Zamora, requesting
the sale of alcoholic beverages for off-site consumption, in conjunction with an
existing market, known as "Mary's Market", and located at:
2428 North San Gabriel Boulevard, Rosemead, California;
and that a public hearing was duly scheduled for December 7, 1981, at 7:30 p.m., in
the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead,
California; and that notice of the time, date, place and purpose of the aforesaid
hearing was duly given; and that a public hearing was duly conducted at the afore-
mentioned time and place.
Section 2. The Planning Commission further finds and determines that facts
do exist as required by Section 9180., et. seq., of the Ordinances of the City of
Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
4. On the basis of evaluation, this project has been determined to be
a Class 9 Categorical Exemption under the provisions of the California
Environmental Quality Act. A Notice of Exemption was filed with the
County Clerk.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a conditional use permit with respect to the property described in Section 1
subject to the following conditions:
1. Applicant shall apply for appropriate City of Rosemead Business
License and Occupancy Permit.
2. Maintain the property in a clean and litter-free state in accordance
with Section 5404-5415 of the Rosemead Municipal Code.
3. This cond"itional use permit shall-be approved for a period of one (1)
year at which time it may be reviewed for renewal by the Planning
Commission without a public hearing.
4. Comply with the requirements-of the Building, Fire, and Health
Departments. _
5. All signs shall be maintained in good condition and repair and shall
pose no hazard to public safety statues, standards and ordinances, as
mandated in Section 9902 (g) of the Zoning Ordinance.
6. Within ten (10) days of approval, the applicant shall submit a
notarized Affidavit of Agreement to the above conditions.
7. Provide means to monitor the refrigerator per approval of the Director
of Planning.
8. Remove the dining table from the store area.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission, unless within such time, a written
- appeal is filed with the City Clerk for consideration by the Rosemead City Council,.-
as provided in the Zoning Ordinance.

Section 6. The secretary shall certify to the adoption of this Resolution
and shall transmit copies of same to the applicant and Rosemead City Clerk.
