PC - 1981-42 - Granting conditional Use Permit 81-236 At 8150 East Garvey AveFOLLOWS: 0 PC RESOLUTION 81-42 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING CONDITIONAL USE PERMIT 81-236 FOR THE SALE OF ALCOHOLIC BEVERAGES ON PROPERTY LOCATED AT 8150 EAST GARVEY AVENUE, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS Section 1 The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by the K-Mart Corporation, requesting the sale of alcoholic beverages for off-site consumption in conjunction with an existing department store, known as "K-Mart", and located at: 8150 East Garvey Avenue, Rosemead, California; and that a public hearing was duly scheduled for December 7, 1981, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose was duly given; and that a public hearing was duly conducted at the, aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180., et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class Nine Categorical Exemption under the provisions of the California Environmental Quality Act. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1 subject to the following condition: 1. This conditional use permit is granted for a period of one (1) year at which time it may be reviewed for renewal by the Planning Commission without benefit of a public hearing. This condition shall become effective the date of issuance of the state liquor license. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk.
