PC - 1981-41 - Granting Zone Variance 81-98 At 3853 Muscatel AveRESOLUTION 81-4 FOLLOWS: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING ZONE VARIANCE 81-98, FOR A PROPOSED PROJECT LOCATED AT 3853 MUSCATEL AVENUE, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS Section 1. The Planning Commission hereby finds and determines that an application was duly filed by Winifred Saunders, requesting a zone variance to Section 9104., R-1 Zone Setback Requirements, for property located at 3853 Muscatel Avenue; or more specifically known as: Lots 6 and.7, Tract No. 3360, M.B. 37-1, except the northerly 50 feet of the easterly 150 feet of Lot 6 and that a public hearing was duly set for October 19, 1981, November 2, 1981, and November 16, 1981 at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearings were given according to law; and that a public hearing was duly conducted at the aforementioned place and times. Section 2. The Planning Commission further finds that facts do exist as required by Section 9171., et. seq., of the Rosemead Zoning Code, justifying the granting of a zone variance. Section 3. The Planning Commission further finds: 1. That the granting of the application for variance would not constitute the granting of a special priviledge inconsistent with the limitations upon other properties in the vicinity in which the property is situated. 2. That the granting of such variance will not be materially detrimental to the public health or welfare, or injurious to the property or im- provements in such zone or vicinity in which the property is located. 3. There are special circumstances applicable to the subject property including size, shape, topography, location or surroundings which would justify variance from the strict application of the Zoning Ordinance. 4. That the granting of such application will not adversely effect the comprehensive General Plan. Section 4. Based on the aforementioned findings, the Planning Commission hereby grants a zone variance with respect to the property described in Section 1, subject to the following condition: 1. The setbacks.forlthe,development of the subject property shall comply with the provisions set forth in Exhibit "A", (attached). Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 7th day of December 1981. MARVIN H.
