PC RESOLUTION 81-40 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CONDITIONAL APPROVAL OF TENTATIVE TRACT NO. 42312. (A ONE-LOT SUBDIVISION INTO SEVEN PARCELS) THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Winifred Saunders requesting a one-lot subdivision into seven separate parcels on property located at 3853 Muscatel Avenue; or more specifically known as: Lots 6 and 7, Tract No. 3360, M.B. 37-1, execept the northerly 50 feet of the easterly 150 feet of Lot 6. and that a public hearing was scheduled for October 19, 1981, November 2, 1981, and November 16, 1981 at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was given according to law; and that a public hearing was duly conducted at the aforementioned times and place. Section 2. The Planning Commission further finds that this subdivision request is in conformance with the Land Use Element of the General Plan; and, 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the proposed subdivision and improvements are con- sistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type of development. 4. The design of the subdivision will not conflict with public ease- ments. 6. The design and proposed improvements of the subdivision will have no adverse environmental effects of fish, wildlife or their habitat, or cause any public health problems. A Negative Declaration has been prepared in compliance with Rosemead Resolution 75-28, CEQA, and the Guidelines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in violation of existing requirements as prescribed by the California Regional Water Board. Section 3. NOW, THEREFORE BE IT RESOLVED, that the Planning Commission of the City of Rosemead recommends that the City Council approved the request for subdivision of that parcel of land described hereinabove, subject to the following conditions: 1. That the applicant shall comply with all the conditions as set forth in the City Engineer's Report dated September 4, 1981, (Exhibit "A"), and to include the requirements as set forth by the Fire Department. 2. That the street shall be constructed to the Los Angeles County Road Department standards, and shall include curb and gutter, within one (1) year from the final tract approval. 3. That a covenant shall be prepared by the applicant for review and approval of the City Attorney, assuring that the drainage easement shall be continually maintained and that cost associated with such maintenance shall be equally shared by all future property owners within the division so effected, and to include the following provision: a. The City shall have the right to cause such repair to be accomplished and to place liens on the involved properties, if in the estimation of the City Engineer, the subject drainage device has reached a state of disrepair which renders it a hazard, unsightly, or a public nuisance. Said improvements shall occur within one (1) year from final tract map approval. 6. The drainage.of Lots 1, 2, 3, and 4 shall drain to Muscatel by utilization of a drainage device, (i.e., swale constructed as part of block wall footing), and shall be required to be installed per the City Engineer's direction and ultimate approval prior to acceptance of a final tract map. 7. All improvements proposed within the subdivision shall be installed prior to recordation of the final map or estimated improvement cost shall be established by the City Engineer and such improvements bonded for. If bonds are accepted such work shall commence within one (1) year from recordation of the final map: Failure to do so shall cause the City to authorize installation of said im- provements, utilizing the bonds posted by the applicant. 8. The note on the original tract map proposing natural drainage for Lots 1 through 4 shall be erased or permanently removed on the original tract map. These noncomplying conditions shall be corrected or the lot lines relocated prior to the division of the land by sale. The grading plan must be approved prior to filing of a final map. A preliminary soil report is required before grading plan approval. Prior to filing of final map, submit a soil engineer's report on all building sites in the proposed subdivision. The tentative map shows that lot lines will occur on the constructed slopes. For approval of the grading plan, these slopes shall be rearranged so that the lot line is located at or near the top of the slope, along a drainage terrace, or at similar acceptable location. If tentative approval of the map is granted with the condition that a zone change be obtained, the ordinance granting such change in zone must be adopted by the City Council prior to issuance of grading and building permits. TENTATIVE MAP DATE PRIOR TO FILING THE FINAL LAND DIVISION MAP, THE FOLLOWING CONDITIONS MUST BE FULFILLED' A grading plan must be approved by the City Engineer. This grading plan must be based on a detailed engineering geology report and/or soils engineering report and must be specifically approved by the geologist and/or soils engineer and show all recommendations submitted by them. It must also agree with the tentative map and conditions as approved by the City of La Habra Heights. All buttresses over 25 feet high must be accompanied by calculations. _ A detailed engineering geologic report (and soils engineering report) must be approved by the City Engineer. All geologic hazards associated with this proposed development must'be eliminated. or delineate a restricted use area approved by the consultant geologist to the satisfaction of the City Engineer and dedicate to the City the right to prohibit the erection of buildings or other structures within the restricted use areas. Specific recommendations will be required from the consultant(s) regarding the suitability for development of all lots designed essentially as ungraded site lots. A report will be filed with the State Real Estate Commissioner indicating that additional geologic and/or soils engineering studies may be required for ungraded site lots by the City Engineer. INFORMATION APPLICABLE TO THIS DIVISION OF LAND: The subdivider is advised that approval of this division of land is contingent upon the installation and use of a sewer system. The Health Department is advised that there is no assurance at this time that geologic and soil conditions will allow the sustained use of private sewage disposal on each lot.'
