A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING CONDITIONAL USE PERMIT 81-235 FOR THE SALE OF ALCOHOLIC BEVERAGES ON PROPERTY LOCATED AT 9424 VALLEY BOULEVARD, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Virg and Betty Carter, requesting the continued sale of alcoholic beverages for on-site consumption, in conjunction with an existing bar, known as "Betty's Sidewinder Saloon", and located at: 9424 Valley Boulevard, Rosemead, California; and that a public hearing was duly scheduled for November 16, 1981, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section.9180., et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class 9 Categorical Exemption under the provisions of the California Environmental Quality Act. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1, subject to the following conditions: 1. Apply for a City of Rosemead Business License and Occupancy Permit. All conditions must be complied with before issuance of said permits. 2. Comply with the requirements of the Building/Fire Departments. 3. Supply trash containers and maintain the property in a clean and litter free state. 4. This conditional use permit is approved for a two-year period, at which time it may be reviewed for renewal by the Planning Commission without a public hearing. 5. Property to the east shall be secured by lease or covenant to provide five (5) parking spaces for the patrons of "Betty's Sidewinder Saloon" 6. Within ten (10) days, the applicant and property owner shall submit a notarized Affidavit of Agreement to these conditions, with the Planning Department. 8. Install a "Parking in Rear" sign on the front of the building. 9. Doors to remain closed during business hours Section 5. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 7th day of December 1981. MARVIN H.
