A RESOLUTION OF THE PLANNING C014MISSION OF THE CITY OF ROSEMEAD GRANTING
CONDITIONAL USE PERMIT 81-231 FOR THE SALE OF ALCOHOLIC BEVERAGES ON.
PROPERTY LOCATED AT 8405 EAST GARVEY AVENUE, ROSEMEAD, CALIFORNIA.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The Planning Commission of the City of Rosemead does hereby find
and determine that an application was duly filed by Chung Ji Up, requesting the sale
of alcoholic beverages for off-site consumption in conjunction with an existing
drive-through dairy, known as "Altadena Dairy", and located at:
8405 East Garvey Avenue, Rosemead, California;
and that a public hearing was duly scheduled for September 21, 1981, at 7:30 p.m.,
in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead,
California; and that notice of the time, date, place, and purpose of the aforesaid
hearing was duly given; and that a public hearing was duly conducted at the afore-
mentioned time and place.
Section 2. The Planning Commission further finds and determines that facts
do exist as required by Section 9180., et. seq., of the Ordinances of the City of
Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
-4. On the basis of evaluation, this project has been determined to be
a Class 9 Categorical Exemption under the provisions of the California
Environmental Quality Act. A Notice of Exemption was filed with the
County Clerk.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a conditional. use permit with respect to the property described in Section 1,
subject to the following conditions:
1. Applicant to apply for a,City of Rosemead Business License and Occupancy
Permit. All herein must be complied with before said permits are issued.
2. Comply with the:requirements of the Building, Fire, and Health Depart-
ments.
3. The storage area located to the rear of the lot shall be cleaned and
maintained free of trash, litter, and debris.
4. Comply with Section 5401-5415 of the Rosemead Municipal Code, which
deals with the storage, accumulation, collection, and disposal of
garbage, rubbish, trash and debris.
5. This conditional use permit is approved for a period of two (2) years
at which time it may be renewed by the Planning Commission without a
public hearing.
6. Within ten days after approval, the applicant shall submit a notarized
Affidavit of Agreement to all conditions.
7. Install a trash container enclosure per Rosemead City standards.
8. Conditions 3, 7 and 9 shall be complied with within 60 days of signing
the notarized Affidavit of Agreement.
9. Paint the ice box located on the southeast corner of the property.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission, unless within such time, a written

appeal is filed with the City Clerk for consideration by the Rosemead City Council,
as provided in the Zoning Ordinance.:
Section 6. The secretary shall certify to the adoption of this Resolution
and shall transmit copies of same to the applicant and Rosemead City Clerk.
