A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING
CONDITIONAL USE PERMIT 81-230 FOR THE SALE OF ALCOHOLIC BEVERAGES,ON
PROPERTY LOCATED AT 7755 EAST GARVEY AVENUE, ROSEMEAD, CALIFORNIA.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application,was duly filed by Miguel Angel Flores,,re-
questing the sale of alcoholic beverages for on-site consumption in conjunction with
pan existing restaurant, known as "El Villa Tepeyac", and located at:
7755 East Garvey Avenue, Rosemead, California;
and that a public hearing was duly scheduled -forSeptember 21, 1981, at 7:30 p.m.,
in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead,
California; and that the notice of the time, date, place, and purpose of the afore-
said hearing was duly given according to law; and that a public hearing was duly
conducted at the aforementioned time and place.
Section 2. The Planning Commission further finds and determines that facts
do exist as required by Section 9180.,,et. seq., of the Ordinances of the City of
Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
4. On the basis of evaluation, this project has been determined to be a
Class 9 Categorical Exemption under the provisions of the California
Environmental Quality Act. A Notice of Exemption has been filed with
the County Clerk.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a conditional use permit with respect to the property described in Section 1,
subject to the following conditions:
1. Apply for a City of Rosemead Business License and Occupancy Permit.
2. Comply with all the requirements of the Building, Fire, and Health
Departments.
3. This conditional use permit is approved for a two-year period, at which
time it may be reviewed by the Planning Commission without a public
hearing.
4. Supply trash container enclosure per Rosemead City Standards.
5. Maintain the property in a clean and litter-free state.
6. Remove materials along the rear property line, (ol doors, plywood,
debris).
7. Repair or replace the chain link fence along rear property line and
provide said fence with view-obstructing striping, interwoven into
chain link, to the satisfaction of the Director of Planning.
8. Within ten (10) days of approval, the applicant shall submit a notarized
Affidavit of Agreement.
9. Conditions 4, 6, and 7 shall be completed within 60 days of signing the
notarized Affidavit of Agreement.

10. Hours of operation shall be from 6:00 a.m. to 10:00 p.m.

Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission, unless within such time, a written
appeal is filed with the,City Clerk for consideration by the Rosemead City Council,
as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of this Resolution
and shall transmit copies of same to the applicant and Rosemead City Clerk.
