PC - 1981-29 - Granting Conditional Approval Of Parcel Map 14373PC RESOLUTION • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING CONDITIONAL APPROVAL OF PARCEL MAP 14373. (A'ONE"LOT SUBDIVISION TO ACCOMMODATE ONE ADDITIONAL SINGLE-FAMILY HOME) THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission hereby finds and determines that an application was duly filed by Peter Wong, requesting the subdivision of an existing parcel of land into two (2) lots, for property located at 3229 Evelyn Avenue, or more specifically known as: The southerly 57.5 feet of Lot 22 and northerly 40 feet of Lot 23 of Tract No. 2078; and that a public hearing was duly set for August 3, 1981, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given according to law; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that this subdivision request is in conformance with the Land Use Element of the General Plan; and, 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the. _ subdivision and improvements are consistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type of development. 4. The site is suited for the proposed density of the development. 5. The design of the subdivision will not conflict with public easements. 6. The design and proposed improvements of the subdivision will have no adverse environmental effects on fish, wildlife or their habitat, or cause any public health problems. A Negative Declaration has been prepared in compliance with Rosemead Resolution 75-28, CEQA, and the Guidelines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in violation of existing requirements as prescribed by the California Regional Water Board. Section 4. Based on the aforementioned findings, the Commission hereby grants the request for subdivision of that parcel of land described in Section l.of this Resolution, subject to the following conditions: 1. The applicant will comply with all of the conditions as set forth in the Engineer's Report, excluding Condition No. 3 under Mapping. (Attachment "A") 2. Applicant shall provide a new driveway approach and driveway for Parcel Two in accordance with City of Rosemead Road Department standards. 3. The existing retaining wall on Parcel Two shall be replaced or repaired to the satisfaction of the Planning Director. 4. All accessory structures not applicable to this division of land shall be removed. 5. Install a solid wood or masonry fence on the north, south, and west property lines, to the satisfaction of the Planning Director. If a wooden fence is installed, it shall have steel supports set in concrete. Fence shall be a maximum of six (6) feet in height in the rear yard, and four (4) feet in height in the front yard, as viewed from adjacent pro- perties,.as set forth in Section 9121.17 of the Rosemead Municipal Code. • PC Resolution 81729 Page Two r j Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 17th day of August , 1981. MARVIN H. There are existing main line sewers a''ailable to serve this land division. 2. The discharge of sewage from the land division into the public sewer system will not violate the requirements of the California Regional Water Quality Control Board pursuant to Division 7 (Com- mencing with Section 13000) of the Water Code. 3. Approved without conditions. Water 1. All parcels shall be served by adequately sized water system faci- lities which shall include fire hydrants of the size and type and location as determined by the Fire Chief. The water mains shall be of sufficient size to accommodate the total domestic and fire flows required for the land division. Domestic flows required are to be determined by the City Engineer. Fire flows required are to be determined by the Fire Chief. 2. At the.time the final land division map is submitted for checking, plans and specifications for the water system facilities shall be submitted -t:oth.e City Engineer for checking and -approval, and shall comply with the City Engineer's standards. Approval for filing of this land division is contingent upon approval of plans and specifi- cations mentioned above. If the water system facilities are not installed prior to the filing of this land division, the subdivider must also submita Labor and Materials Bond in addition to either: a. An Agreement and a Faithful Performance Bond in the amount estimated by the City Engineer guaranteeing the installation of the water system, or b. An Agreement and other evidence satisfactory to the City Engi- neer, indicating that the subdivider has entered into a contract with the serving water utility to construct the water system as required, and has deposited with such water utility security guaranteeing payment for the installation of the water system. 3. There shall also be filed with this Division a statement from the water purveyor indicating that the proposed water mains and any other required facilities will be operated by the purveyor and that under normaloperating conditions the system willmeet the require- ments for the land division. 4. The tentative map submitted appears to meet the requirements of local ordinance and the State Subdivision Map Act except as noted in items 2 and 3 below. 2. The width of ParceL 2 does not meet the minimum requirement of 50 feet per Section 71 of the local subdivision ordinance. Said ordinance requirement must be modified pursuant to Section 6 of the local_ ordinance if this map is to be approved. 3. This map must be a lease project pursuant to Section 15. 6 of the local subdivision ordinance. If this development is not intended to be a lease project, the City must modify the requirements of the subdivision ordinance to permit 2 residential structures on each parcel without filing a map for lease purposes. 4. A final map prepared by, or. under the direction of, a registered civil engineer or licensed land surveyor must be processed through this Department prior to being filed with the County Recorder. 5. Easements shall not.be granted or recorded within areas proposed tobe granted, dedicated, or offered for dedication as easements un`.il after the final map is filed with the County Recorder unless such easements are subordinated to the proposed grant or dedica- tion. If easements are granted after the date of tentative approval, . a subordination must be executed by the easement holder prior to the filing of the final map. 6. The following finding should be made by the Advisory Agency if any dedications are made by certificate on the final map: The Advisory Agency hereby determines that division and de- velopment of the property in the manner set forth on the map of Parcel Map No. 14373 will not unreasonably interfere with the free and complete exercise of the public entity and/or pub- lic utility rights-of-way and/or easements within the parcel map. 7. If signatures of record title interests appear on the final map, submit a preliminary guarantee. A final guarantee will be required at the time of filing of the final map with the County Recorder. If said signatures do not appear on the final snap, a preliminary title report /guarantee is needed that covers the area showing all fee owners and interest holders. Prior to submitting the final map to the City Engineer for his examination pursuant to Section 66450 of the Government Code, obtain clearances from all affected Departments and Divisions includ- ing a clearance from the Subdivision Section of Mapping Division of the County Engineer for the following mapping items: mat'.2e- matical accuracy, survey analysis, and correctness of certificates, signatures, etc. 9. The findings and considerations required by Sections 66473. 5, 66474, and 66474.6 of the Subdivision Map Act should be made by the Advisory Agency. 10.
