A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING
CONDITIONAL APPROVAL OF ZONE VARIANCE 81-95, FOR A PROPOSED PROJECT LOCATED
AT 3229 EVELYN AVENUE, ROSEMEAD, CALIFORNIA.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
Section 1. The Planning Commission hereby finds and determines that an
application was duly filed by Peter Wong to request a zone variance to Section 9105.5,
Rear Yard Minimum, and Section 9105.7, Lot Width Minimum, for property located at
3229 Evelyn Avenue, or more specifically known as:
The southerly 57.5 feet of Lot 22 and northerly 40 feet of Lot 23 of
Tract No. 2078;
and that a public hearing was duly set for August 3, 1981, at 7:30 p.m., in the Council
Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that
notice of the time, date, place, and purpose of the aforesaid hearing was duly given
according to law; and that a public hearing was duly conducted at the aforementioned
time and place.
Section 2. The Planning Commission further finds that facts do•exist as
required by Section 9171., et. seq.,.of the Rosemead Zoning,Code, justifying-the~?granting
of a zone variance- -
Section 3. The Planning Commission further finds:
1. That the granting of the application for variance would not constitute
the granting of a special priviledge inconsistent with the limitations
upon other properties in the vicinity and zone in which the property
is situated.
2. That the granting of such variance will not be materially detrimental
to the public health or welfare, or injurious to the property or im-
provements in such zone or vicinity in which the property is located.
3. There are special circumstances applicable to the subject property in-
cluding size, shape, topography, location or surroundings which would
justify variance from the strict application of the zoning ordinance.
4. That the granting of such application will not adversely effect the
comprehensive General Plan.
Section 4. Based on the aforementioned findings, the Planning Commission
hereby grants a zone variance with respect to the property described in Section 1,
subject to the following conditions:
1. The applicant will comply with all of the conditions as set forth
in the Engineer's Report, excluding Condition No. 3 under Mapping.
(See Attachment "A")
2. Applicant shall provide a new driveway approach and driveway for Parcel
Two in accordance with City. of Rosemead Road Department standards.
3. The existing retaining wall on Parcel Two shall be replaced or'repaired
to the satisfaction of the Planning Director. .
4. All accessory structures not applicable to this division of land shall
be removed.
5. Install a solid wood or masonry fence on the north, south, and west
property lines, to the satisfaction of the Planning Director. If a
wooden fence is installed, it shall have steel supports set in concrete.
Fence shall be a maximum of six (6) feet in height in the rear yard, and•i
four (4) feet in height in the front yard, as viewed from adjacent pro- '
perties, as set forth in Section 9121.17 of the Rosemead Municipal Code.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission, unless within such time, a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council,
as provided in the Zoning Ordinance.

Section 6. The secretary shall certify to the adoption of this Resolution
and shall transmit copies of same to the applicant and Rosemead City Clerk.

be of sufficient size to accommodate the total domestic and fire
flows required for the. land division. Domestic, flows required are

2. At the.time the final 'Land division map is submitted for checkinn,
plans and specifications for the water. system facilities shall be
submitted to the City Engineer for checkino and approval, and shall
comply with the City Engineer's standards. Approval for filing of
this la-ad division is contingent upon approbal of plans and specifi.-
cations mentione.:l above. If the water system facilities arc: not
installed prior to the filing of this land division, the subdivider
must also submita Labor and Materials Bond in addition to either:
a. An Agreement and a Faithful Performance Bond in the amount

1. The tentative map submitted appears to meet the requirements of
local ordinance and. the State Subdivision Map Act except as noted
in items 2 and 3 below.
2. The width of Parc<.L 2 does not rneet the mi'i:num requirement
of 50 feet per. Section 71 of the local. subdivision o:rdiriauce. Said
ordinance requirement must be modified pursuant to. Section 6 of
the local ordinance if this map is to be approved.

This map must be a lease project pursuant to Section 15. 6 of the
local subdivision ordinance. If this development is not intended
to be a lease project, the City must modify the requirements of
the subdivision ordinance to permit '2 residential structures on each
parcel, without filing a map for lease purposes.
A final neap prepared by, or. under the direction of, a registered
civil engineer or licensed land surveyor must be processed through
this Department prior to being filed with the County Recorder.
Easements shall not be granted or recorded within. areas proposed
tobe granted, dedicated, or offered for dedicationi as easements
until after the final map is filed with the County Reco:rder unless
such easements. are subordinated to the proposed grant or dcdica-
ti.on. If easements are granted after the date of tentative approval,
a subordination must be executed by the easement holder prior to
the filing of the final map.
The following finding should be made by the Advisory Agency if
any dedications are made by certificate on the final map:

8. Prior to submitting the final map to the City Engineer for his
examination pursuant to Section 66450 of the Government Code,
obtain clearances from all affected Departments and Divisions includ-
ing a clearance from the Subdivisioti Section of Mappinlg Division
of the County Engineer for the following mapping items: mathe-
matical accuracy, survey analysis, and correctness of certificates,
signatures, etc.
9. The finding's and considerations required by Sections .66473.5, .
664,74, and 66474.6 of the Subdivision Map Act should be ma e
by the Advisory Agency.
10. A tletex'minati.on should be made that this project is in corzzpliance -
with the State Environ:rtental Quality Act.
