A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING
CONDITIONAL USE PERMIT 81-222, FOR THE SALE OF ALCOHOLIC BEVERAGES ON
PROPERTY LOCATED AT 8752 EAST VALLEY BOULEVARD, ROSEMEAD, CALIFORNIA.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was duly filed by Agnes,, Jose, Saturnina,
and Ricardo Noguera, requesting the sale of alcoholic beverages for on-site con-
sumption in conjunction with an existing pizza parlor, known as "Pete's Pizza",
and located at:
8752 East Valley Boulevard, Rosemead, California;
and that a public hearing was duly scheduled for June 1, 1981, at 7:30 p.m., in the
Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California;
and that notice of the time, date, place, and purpose of the aforesaid hearing was
duly given; and that a public hearing was duly conducted at the aforementioned time
and place.
Section 2. The Planning Commission further finds and determines that facts
do exist as required by Section 9180., et. seq., of the Ordinances of the City of
Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
4. On the basis of evaluation, this project has been determined to be a
Class Nine Categorical Exemption under the provisions of the California
Environmental Quality Act. A Notice of Exemption was filed with the
County Clerk.
Section 4. Based on the aforementioned findings, the Planning Commission
hereby grants a conditional use permit with respect to the property described in
Section 1 of this Resolution, subject to the following conditions:
1. The applicants shall secure all appropriate licenses, i.e., Occupancy
Business License, and Alcoholic Beverage Control.
2. The property shall be operated as a bonafide restaurant and the right
to serve alcoholic beverages shall be dependent upon the service of
food on the premises.
3. All landscaped areas shall be fully maintained.
4. The parking area shall be kept lighted after dark for security.
5. All signs shall conform to Section 9900-9906 of the Rosemead Municipal
Code.
6. The property shall be maintained in a clean, litter-free state at
all times.
7. This conditional use permit shall be approved for a period of two (2)
years, at which time the Commission may review for an extension without
public hearing.
8. The applicants shall sign a notarized Affidavit of Agreement to the
above conditions.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission, unless within such time, a written
appeal is filed with the City Clerk for hearing by the Rosemead City Council, as

provided in the Rosemead Zoning Ordinance.
-Section 6. The secretary shall certify to the adoption of this Resolution
and transmit copies of same to the applicant and Rosemead City Clerk.
