PC - 1981-16 - Granting Conditional Use Permit 81-219 At 8225 East Garvey AvePC RESOLUTION 81-16 Is A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 81-219 FOR THE SALE OF ALCOHOLIC BEVERAGES ON PROPERTY LOCATED AT 8225 EAST GARVEY AVENUE, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Sav-On-Drugs, Inc. requesting the sale of alcoholic beverages for off-site consumption in conjunction with- anexisting drug/department store, known as "Sav-On Drug Store", and located at: 8225 East Garvey Avenue, Rosemead, California; and that a public hearing was duly scheduled for April 20, 1981, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was duly given; and that a public hearing was duly conducted at the afore- mentioned time and place. Section 2. The Planning Commission further finds and determines that- facts do exist as required by Section 9180, et. seq., of the'Ordinances of the- City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class Nine Categorical Exemption under the provisions of the California Environmental Quality Act. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Planning Commission, hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Applicant shall apply for City Business License, Occupancy Permit, and applicable license with the Department of Alcoholic Beverage Control. 2. That the monument rotating sign stating "Sav-On Drugs" shall cease from rotating, and shall be placed in one fixed position. 3. The walls of all structures on the subject property are to be re- moved of all graffiti within thirty (30) days of approval, and to be maintained in a graffiti-free state. 4. The subject property shall be maintained in a clean, litter-free state in accordance with Sections 5401-5415 of the Rosemead Municipal Code. This includes the removal of glass and other debris from both parking areas on the property and the abutting sidewalks. 5. This permit is granted for a period of ten (10) years at which time it may be reviewed by the Planning Commission without a public hearing. 6. This permit is not transferable to future owners and/or occupants. 7. Within ten (10) days of approval, the applicant shall submit a notarized Affidavit of Agreement to the above conditions with the Planning Department, and shall within a reasonable period of time, satisfy these conditions with the knowledge that failure to do so may result in the revocation of this conditional use permit. All conditions requiring the action of the applicant shall be accomplished within thirty (30) days of acceptance of conditions through the Affidavit of Agreement, as outlined in Condition No. 9. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal if filed with the City Clerk for hearing by the Rosemead City Council, as provided in the Rosemead Zoning Ordinance. Section 6. The secretary shall certify to the adoption of this Resolution and transmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 4th day of May , 1981. MARVIN H.
