PC - 1981-15 - Graning Conditional Use Permit 81-218 At 2525-29 North San Gabriel Blvd_u PC RESOLUTION 81-15 FOLLOWS: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 81-218 FOR THE SALE OF ALCOHOLIC BEVERAGES ON PROPERTY LOCATED AT 2525-29 NORTH SAN GABRIEL BOULEVARD, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Cheng-Kun Lai requesting the sale of alcoholic beverages for off-site consumption in conjunction with an existing liquor store, known as "Casa De Liquor", and located at: 2525-29 North San Gabriel Boulevard, Rosemead, California; and that a public hearing was scheduled.duly'scheduled for April 20, 1981, in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was given according to law; and that a public hearing was duly conducted at the afore- mentioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180, et. seg., of the ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3: The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class Nine Categorical Exemption under the California Environmental Quality Act. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Planning Commission hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Applicant shall apply for City business license, Occupancy Permit, and applicable license with the Department of Alcoholic Beverage Control. 2. The trash recepticle is to be property enclosed and screened and brought to comply with Section 5401-5415 of the Rosemead Municipal Code, which deals with the storage, accumulation; collection and disposal of garbage, rubbish, trash and debris. 3. The parking area is to be repaved and the spaces striped in compliance with Part XXII, Section 9122 of the Rosemead Municipal Code. 4. The wall of all structures on subject property are to be removed of all graffiti within thirty (30) days of approval, and are to be main- tainedin a graffiti-free state. 5. Comply with all requirements of the Building, Fire, and Health Departments. 6. The subject property shall be maintained in a clean, litter-free state in accordance with Sections 5401-5415 of the Rosemead Municipal Code. This includes the removal of glass and other debris from both parking areas on the property and the abutting sidewalks. 7. This permit is granted for a period of two (2) years at which time it may be renewed by the Planning Commission without a Public Hearing. 8. This permit is not transferable to future owners or occupants. PC Resolution 81-15 Page Two 9. Within ten (10) days after approval, the applicant shall submit a notarized Affidavit of Agreement to the above conditions with the Planning Department, and shall within a reasonable period of time, satisfy these conditions with the knowledge that failure to do so may result in the revocation of this permit. 10. All conditions requiring action of the applicant shall be accomplished within thirty (30) days of approval. 11. The chain link enclosures around the compressors on the south side of the building, and around the storage area on the northwest corner of the lot, shall have slats installed for visual relief. 12. The chain link security gate shall be removed and a more aesthetically pleasing, sliding security gate may be installed, provided that it does not protrude more that four (4) inches from the front of the store. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for hearing by the Rosemead City Council, as provided in.the Rosemead zoning Ordinance. Section 6. The secretary shall certify to the adoption of this Resolution and transmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 4th day of May , 1981. MARVIN H.
