A RESOLUTION OF THE PLANNING COMMISSION OF THE.CITY OF ROSEMEAD
GRANTING CONDITIONAL USE PERMIT 80-207 FOR THE ESTABLISHMENT OF
ALNURSERY/GROWING GROUND ON SOUTHERN CALIFORNIA EDISON PROPERTY
SOUTHWEST OF KLINGERMAN"STREET AND',=LTA AVENUE, ROSEMEAD, _
CALIPORNIA. _
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was duly filed by Rosemead Growers, Incorpor-
ated requesting establishment of a nursery/growing ground on Southern 'California
Edison property and-generally located at:
The west terminus of Klingerman Street, adjacent to the Los Angeles
. County Flood Control Channel:
and that a public hearing was duly scheduled for January 5, 1981, at 7:30 p.m.,
in the Council Chambers of Rosemead City Hall, 8838 East Valley Boulevard, Rosemead,
California; and that notice of the time, place, date and purpose of the aforesaid
hearing was duly given; and that a public hearing was duly conducted at the afore-
mentioned time and place.
Section 2. The Planning Commission further funds and determines that
facts do exist as required by Section 9180, et.seq., of the Ordinances of the
City of Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives::
of the General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
4. on the basis of evaluation, this project has been determined to be
a Class Nine Categorical Exemption under the provisions of CEQA.
A Notice of Exemption was filed with the County Clerk.
Section 4. Based on the aforementioned.findings, the Commission hereby
grants a conditional use permit with respect to the property described in Section 1
of this Resolution, subject to the following conditions:
1. That paving and gravel be placedcon Klingerman Avenue (private street)
as indicated on the plot plan (dated 12131180).
2. That the use of chemicals shall be restricted to those listed on the
environmental assessment, Mitigation measures 1,2,and 3. Spraying
is to be limited to 8:00 a.m. to 12:00 p.m. on Saturday and 10:00 a.m.
to 2:00 p.m. on Sunday.
3. Growing shall be restricted to one gallon size plants, excluding
one row of trees around the perimeter.
4. Hours of operation shall be from 7:30 a.m. to 4:30 p.m.
5. Potting is to be done at the south end of the property.
6. Interior roads of the property shall have gravel placed on them and
shall be maintained to prevent mud or dust.
7. Any storage of herbicides of chemicals shall be approved by the
Department of Agriculture.
8. All access to the property shall be from Klingerman Street.

Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission unless. within such time a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council
as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of the Resolution
and shall transmit copies of same to the applicant and the Rosemead City Clerk.

RECOMMENDED CONDITIONS
PLANNED DEVELOPMENT REVIEW 81-1
1. Double line all open parking spaces.
2. Steel supports set in concrete for 11 wooden fences.
3. Timing devices in conjunction with moisture sensor devices to be
provided within irrigation system.
4. Mark all open parking spaces as.guest parking only.
5. The C.C. & R.'s shall be amended to prohibit the use of privately
owned patio spaces for storage of any kind.
6. Wooden shake. or shingle. roofing materials are prohibited.
7. Grade areas of driveways with a 15% or greater slope shall be brushed
or combed, (i.e., textured for vehicular traction).
8. Speed bumps to be required at strategic locations in the major driveways.
9. Automatic garage door openers shall be provided in all units.
10. The mail boxes shall be located in such a manner as to minimize the
traffic hazard and congestion possible near the entrance to the develop-
ment, but shall be in a location approved.by the United States Postal
Service, and the Modification.Committee.
11. The developer shall provide open space within the. project consistent with
the City's P-D Ordinance. Because of the design features of the project
and amount of open space indicated on the plans, the required open spece
may include private yard and balcony areas.
12. The developer shall meet with adjacent property owners, as requested,
prior to the issuance of building permits in order to resolve, those
citizens' questions and concerns about specific-aspects of the project which
relate to.or affect them, including neighbor privacy.
13. Each unit shall provide. the necessary space to provide for the future
connection of solar hot water heating units.
14. (Deleted)
15. The following conditions recommended by staff in its report for the September
1, 1981 meeting of the Planning Commission:
Landscaping - Sheet L2 of the Plans:
(a) Eastern and southeastern slope to be planted with ground cover and
suitable trees in keeping with balance of project.
(b) Increase planting gallon sizes as identified within the landscape plan,
as modified by staff, (i.e., calls for increase in size from one gallon
to five gallon or 15 gallon).
Landscaping - Sheet L1 of the Plans:
(c) Trees facing Walnut Grove to have three stakes and to be box size;
species is to be Podocarpus Bette, 15 gallon.
(d) C.C.& R:'s - That the attached amendments, (labled Condition No. 2 =
C.C.& R. Inclusion)_ be recorded with the C.C.& R.'s or added as
amendments.

(e) Setback Units A through F, 1050 Walnut Grove Avenue - That a
minimum 18 foot first floor setback, (allows second-story
encroachment), be provided from the edge of the driveway,
(more specifically; identified on the Final Map No. 38455 as a
fire lane). When submitted, the final working drawings for the
identified 6 units must conform to theschematic/concept plan
and may be approved for issuance of building permit by the joint
concurrence of the Building Official and the Director of Planning
after finding that such plan consistency exists.
(f) That the identified concrete driveways be a minimum of six inches
thick.
(g) Guest parking to be identified by marking of spaces.
(h) All utilities to be placed underground, and to be noted on plans.
(i) Asecondary emergency access and crash gate shall be constructed per
Exhibit "C". Further, that turf block (or some functional equivalent,
which must be approved by the Director of Planning and the Modification
Committee of the Planning Commission) shall be provided within the
emergency City easement area located on the northern adjacent
McCarthy project. Minor deviations as to the location of the
emergency driveway may fluctuate by three (3) feet t ,on-either-.side.
16. The definitions/specifications of the sideing materials to be added to
the plans.
17. The parking spaces identified at.6,9,10,11,12,& 28 on Sheet 3 be deleted
and those areas shall be substituted with landscaping.
