A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING
CONDITIONAL APPROVAL OF DESIGN REVIEW 82-8, FOR A PROPOSED NINE-UNIT
APARTMENT BUILDING TO BE CONSTRUCTED AT 8852 MARSHALL STREET, ROSEMEAD,
CALIFORNIA.
FOLLOWS:
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was duly filed by Atlantic Engineering,
requesting approval of the design of a proposed nine-unit apartment complex, to be
located at:
8852 Marshall Street, Rosemead, California;
and that a public hearing was duly scheduled for May 17, 1982 at 7:30 p.m., and
continued to June 21, 1982 at 7:30 p.m., in the Council Chambers of Rosemead City
Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time,
date, place, and purpose of the aforesaid hearing was duly given; and that a public
hearing was duly conducted at the aforementioned time and place.
Section 2. The Planning Commission further finds and determines that
facts do exist as required by Section 9119., et. seq., of the Ordinances of the
City of Rosemead, justifying the granting of approval of the design review application.
Section 3. The Planning Commission further finds:
1. The plans indicate proper consideration for the relationship between
the proposed building and site developments that exist or have been
approved for the general neighborhood.
2. The plan for the proposed builidng and site development indicates that
the manner in which the proposed development and surrounding properties
are protected against noise, vibrations, and other factors which may
have an advefse.effect_ on-the environment, and the manner of screening
mechanical equipment, trash, storage, and loading areas.
3. The proposed building or site development is not, in it's exterior
design and appearance, so at variance with the appearance of other
existing buildings or site developments in the neighborhood as to
cause the nature of the local environment to materially depreciate
in appearance and value.
4. The proposed building or structure is in harmony with the proposed
developments on land in the general area, especially in those instances
where buildings are within or adjacent to land shown on the General
Plan as being part of the Civic Center or in public or educational use,
or are within or immediately adjacent to land included within any
precise plan which indicates building shape, size, or style.
5. The proposed development is in conformity with the standards of this
code and other applicable ordinances in so far as the location and
appearance of the buildings and structure are involved.
6. The site plan and the design of the buildings, parking areas, signs,
landscaping, luminaries, and other site features indicates that proper
consideration has been given to both the functional aspects of the site
development, such as automobile and pedestrian circulation, and the
visual effect of the development from the view of public streets.
7. A Negative Declaration was previously adopted for this project, pursuant
to the provisions of the California Environmental Quality Act.
Section 4. Based on the aforementioned findings, the Commission hereby
approves the design review application, with respect to the property described in
Section 1 of this resolution, subject to the following conditions:
1. That the mansard roof be incorporated for each side or elevation of
Buildings 1 and 2.
2. That the common laundry area be designated in Unit B-5 and that 60
cubic feet of storage space be provided within the garage area.

3. That a yard maintenance service be employed to all landscaped areas on
a weekly basis or to provide an adequate on-site equipment storage area
to allow the opportunity for tenant maintenance arrangements.
4. That all new common property line walls shall be constructed of a
colored slump stone or of a material and color approved by the
Director of Planning.
5. That all driveway paved areas shall be constructed of 4 inches of AC
over 6 inches of base, or 6 inches of concrete.
6. All utilities shall be underground.
7. All on-site lighting shall be directed away from adjacent residential
areas, so as not to create unreasonable glare on such properties.
8. The mail box locations shall comply with postal regulations, and shall
be reviewed and approved by the Director of Planning prior to instal-
lation.
9. That a color and materials board, (i.e., materials to be used in con-
struction), be provided to the Director of Planning for review and
approval, prior to submitting construction plans for building plan
check.
10. That a professionally prepared landscape plan be prepared which reflects
a mature landscape theme along the Marshall Street frontage, (use of
24-inch box materials), and the western planting area. Said landscape
plan shall include a sprinkler plan which indicates the specific types
and sizes of equipment to be used and incorporates automatic timers
and moisture sensing devices. The landscape plans shall be subject to
the review and approval of the Director of Planning prior to the
issuance of building permits.

12. Within ten (10) days of approval of this project, the applicant shall
submit a signed, notarized Affidavit of Acceptance of all conditions,
to the Planning Department.
Section 5. This action shall become final and effective ten (10) days after
this decision by the Planning Commission unless within such time, a written appeal is
filed with the City Clerk for consideration by the Rosemead City Council, as provided
in the Zoning Ordinance.
Section 6. This resolution is the result of an action taken by the Planning
Commission on June 21, 1982, by the following vote:

Section 7. The secretary shall certify to the adoption of this Resolution
and shall transmit copies of same to the applicant and Rosemead City Clerk.

*Amended as follows: That the project shall be developed in accordance with the development
plans dated July 11, 1982, (Reference: File, Design Review 82-8), and accept the driveway
ramp of 17% from the 'st'reet, with the grade transition between Buildings 1 and 2 so that the
first floor level of Units 8 and 9 shall not exceed 3 feet from the existing adjacent
grade.
