A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING
CONDITIONAL USE PERMIT 82-246 FOR THE SALE OF ALCOHOLIC BEVERAGES ON
PROPERTY LOCATED AT 9341 VALLEY BOULEVARD, ROSEMEAD, CALIFORNIA.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
Section 1. The Planning Commission of the City of Rosemead does hereby
find and determine that an application was duly filed by Neil Yuan and Philip Lui,
requesting the sale of alcoholic beverages for off-site consumption, in conjunction
with an existing liquor store, known as "Mission Valley Liquor Mart", and located at:
9341 East Valley Boulevard, Rosemead, California;
and that a public hearing was duly scheduled for June 7, 1982, at 7:30 p.m., in the
Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California;
and that notice of the time, date, place and purpose of the aforesaid hearing was
duly given; and that a public hearing was duly conducted at the aforementioned time
and place.
Section 2. The Planning Commission further finds and determines that facts
do exist as required by Section 9180., et. seq., of the Ordinances of the City of
Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
4. On the basis of evaluation, this project has been determined to be a
Class Nine categorical exemption under the provisions of the California
Environmental Quality Act.
Section 4. Based on the aforementioned findings, the Planning Commission
hereby grants a conditional use permit with respect to the property described in
Section 1, subject to the following conditions:
1. Applicant to apply for a City of Rosemead Business License and Occupancy
Permit. All herein must be complied with before said permits are issued.
2. Comply with the requirements of the Building, Fire, and Health
Departments.
3. The storage area located to the rear of the lot shall be cleaned and
maintained free of trash, litter, and debris.
4. Comply with Section 5401-5415 of the Rosemead Municipal Code which
deals with the storage, accumulation, collection and disposal of
garbage, rubbish, trash and debris.
5. This permit shall be approved for a period of one (1) year at which
time the Planning Commission may revieweit,for renewal without benefit
of a public hearing.
6. Within.ten (10) days of approval, the applicant shall submit a notarized
Affidavit of Agreement to all conditions.
7. An enclosure for the existing trash containers shall be constructed to
conform to city standards and the existing architecture of the building,
and subject to the approval of the Planning Director.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission, unless within such time, a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council,
as provided in the Zoning Ordinance.
Section 6. This resolution is the result of an action taken by the Planning
Commission on June 7, 1982, by the following vote:

Section 7. The secretary shall certify to the adoption of this Resolution
and shall transmit copies of same to the applicant and Rosemead City Clerk.
