A RESOLUTION OF THE PLANNING COMMISSION OF THECITY OF ROSEMEAD
GRANTING A ZONE VARIANCE FOR A PROPOSED DIVISION OF LAND LOCATED
AT 9415 DE ADELENA AND 3802 RIO HONDO AVENUE. (ZONE VARIANCE 82-100)
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:

Section 1. The Planning Commission of the City of Rosemead does
hereby find and determine that an application was filed by Nicholas Galalich
requesting zone variances to Sections 9104.4, 9102.13 (C), 9104.5, and 9104.3
Yard Setback Zone Variances Requirements, for property located at:
9415 De Adelena and 3802 Rio Hondo Avenue, Rosemead, Calfiornia;
and that a public hearing was duly scheduled for April 5, 1982, at 7:30 p.m.,
in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead,
Califoria; and that notice of the time, date, place, and purpose of the aforesaid
hearing was duly given; and that a hearing was duly held at the aforementioned
time and place.
Section 2. The Planning Commission further finds that facts do exist,
as required by Section 9171., at. seq., of the Rosemead Zoning Code, justifying
the granting of zone variances as described within the following:
1. Sec. 9104.4 - side yard. A four (4) foot variance is approved
(ten (10) feet required) for the existing house and property
generally known as 3802 Rio Hondo Avenue, for that southerly
portion of the property which is immediately adjacent to and
parallel with the public right-of-way known as De Adelena or
is otherwise known as the side yard setback identified within
the plot plan dated February 10, 1982 and which is contained
within zone variance file 82-100.-
2. Sec. 9104.5 - rear yard. A nine (9) foot variance is approved
(fifteen (15) feet required) for the existing house and property
..generally known as 9415 De-Adelena, for that northern portion of
the property which is immediately adjacent to and runs parallel
with the common northern property line or is otherwise known as
the rear yard setback identified within the plot plan dated
February 10, 1982 and which is contained within zone variance
file 82-100.
3. Sec. 9104.3 - front yard. A three (3) inch variance is approved
(twenty (20) feet required) for the existing house and property
generally known as 9415 De Adelena, for that southerly portion of
the property which is immediately adjacent to and runs parallel
with the public right-of-way known as De Adelena or is otherwise
known as the front yard setback identified within the plot plan
dated February 10, 1982 and which is contained within the zone
variance file 82-100.
Section 3. The Planning Commission further finds:
1. That the granting of the application for variances would not
constitute the granting of a special privilege inconsistent with
the limitations upon other properties in the vicinity and zone in
which the property is situated.
2. That the granting of such variances will not be materially
detrimental to the public health or welfare, or injurious to the
property or improvements in such zone or vicinity in which the
property is located.
3. There are special circumstances applicable to the subject property
including size, shape, topography, location or surroundings which
would justify a variance from the strict application of the
Zoning ordinance.

4. That the granting of such application will not adversely effect the
General Plan.
5. That a Negative Declaration was prepared for this project in
accordance with the provisions of CEQA.
Section 4. Based on the aforementioned findings, the Planning Commission
hereby grants the zone variance with respect to the property described in
Section 1 subject to the following conditions:
1. That the applicant file a parcel map within one '(1) year from
Variance approva.

3. That Condition No. 2, described above, shall be complied with prior
to recordation of the Parcel Map.

4. That should a carport be constructed, it shall provide storage space
i and painted built-up walls on three (3) sides of the structure. Further,
such structure shall be subject to review and approval of the Director
of Planning to assure a pleasing appearance.
Section 5. This action shall become final and effective ten (10) days after
this decision by the Planning Commission unless within such time a written appeal is
filed with the City Clerk for consideration by the City Council as provided in
the Zoning Ordinance.
Section 6. This resolution is the result of an action taken by the Planning
Commission on April 5, 1982, by the following vote:

2. That the existing garage serving the house known as 3802 Rio Hondo Avenue be
relocated to the northeast corner of the proposed parcel, and brought up to
current city standards; or the existing garage be demolished and a new garage
or carport be constructed to city standards.
